JUSTIFICATION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
IN ACCORDANCE WITH 41 USC 253( C)(1)
Requisition Number: DJF-15-2000-PR-0020201
Date: 07/13/2015 Estimated Contract Dollar Value: $2,564,315.39
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation, Information Technology Contracts Unit (ITCU), has prepared this justification for other than full and open competition for maintenance of the Rocket Data z/Direct license suite (includes Data z/Direct Server License [1 seat], Data z/Direct Adapter Suite License [ADO.NET Client], Data z/Direct Adapter Suite License [JDBC Client], Data z/Services for ACI/Batch/Natural License, Data z/Direct for Adabas License, Data z/Direct Advanced Components License [Enterprise Auditing], and Data z/Direct Advanced Components License [Enterprise Transactions]) on behalf of the Information Technology Infrastructure Division (ITID), Data Center Hardware and Operating Systems Section (DCHOSS), System Programming and Operating System Support Unit (SPOSSU).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
A new contract is contemplated on a firm-fixed price basis with Rocket Software Inc., 77 Fourth Avenue, Suite 100, Waltham, MA 02451, for a base year and four one year option periods.
3. A description of the supplies or services required to meet the agency’s needs.
The Federal Bureau of Investigation (FBI) has several legacy databases and applications hosted on the Enterprise Servers running on the z/OS platform. In 2006 there were over 40 of these legacy applications (such as Automated Case Support) which were targeted for migration into the FBI’s new program called Sentinel. Other programs and applications were to be ported over to COTS products or customized with application development efforts as funding and priorities were identified management. For the past decade, several of these applications were successfully converted; however, until all of the legacy applications and databases are fully converted, the legacy systems need to be supported and/or accessed until ported over to their new environment. The enterprise servers are hosts to several remaining applications and databases which support both investigative and administrative functions within the FBI. As part of their integration or connectivity to their new hosts, several tools and custom code was created using proprietary software which is used to leverage code and data on the legacy ADABAS/NATURAL systems to the new systems such as Sentinel, Investigative Case Management, Bureau Personnel Management System Payroll, and Clearance Processing System (CPS/RPO).
The Rocket Data z/Direct products were used to integrate, connect and access legacy ADABAS/NATURAL systems required for continued mission use.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
The Rocket Data z/Direct products are proprietary to the original equipment manufacturer (OEM), Rocket Software Inc. Due to this proprietary nature, the maintenance can only be obtained from the OEM to support product enhancements, upgrades, bug fixes, problem resolution, etc.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
Due to the proprietary nature of the products requiring maintenance, no other sources are available to meet the Government’s minimum need. The Government’s intent to use other than full and open competition procedures to satisfy this requirement will be publicized as a Part 12 Commercial Items buy utilizing a synopsis/solicitation. Should a source be identified through this procedures, due diligence will be provided to determine whether minimum Government requirements can be met.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated acquisition dollar value, inclusive of options, totals $2,564,315.39. The Contracting Officer (CO) will perform a price analysis to reach the determination that the pricing proposed is fair and reasonable. Data at the disposal of the CO, such as a corporate commercial price list and previous acquisition history will be the tools utilized to determine fair and reasonable pricing.
8. A description of the market research conducted and the results.
Market research has determined that no other sources are available to provide software maintenance on the proprietary products in use.
9. Any other facts supporting the use of other than full and open competition.
Functional requirements regarding this capability are as follows:
- direct access to mainframe data and programs;
- leave in place and access;
- run on z/OS platform;
- direct SQL access to mainframe programs and data stored in an array of relational and non-relational formats to include ADABAS and NATURAL;
- data connectivity between distributed ODBC, ADO.NET, and JDBC client drivers and mainframes;
- enterprise-class scalability;
- load balancing and virtual connection facility;
- supports virtually unlimited concurrent users and transaction rates;
- secure integration with mainframe RACF, CA-TopSecret and CA-ACF2, as well as SSL and client-side, certificate-based authentication on distributed platforms;
- supports SSL between the application platform suite and the mainframe;
- provides both SQL and SOAP interfaces to access a wide range of mainframe; databases, all within a single integration architecture; and,
- full relational metadata support for dynamic integration with distributed application development initiatives.
The FBI has been actively converting legacy databases to new environments. The FBI’s plans are to retire all of the legacy “green screen” applications.
Attempting to replace the current product that provide access to these legacy databases would be cost prohibitive (estimated $650,000+), time consuming (18 – 24 months) and also not move the FBI towards its ultimate goal of eliminating them altogether.
10. A listing of any sources that expressed a written interest in the acquisition.
Not applicable
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
Through the planned publicizing of the synopsis/solicitation, any and all sources identified with the potential to meet either the ability to maintain the existing Rocket products or meet the FBI’s minimum requirements will be duly considered to determine whether a competitive environment exist and can be utilized both now and in the future until all of the legacy databases are retired. .
