This acquisition is conducted under the authorities for procurements under the Simplified Acquisition Threshold (SAT) in accordance with Federal Acquisition Regulation (FAR) Part 13 for other than full and open competition (including brand name) and not using Federal Supply Schedule (FSS) also known as the GSA Schedules Program or the Multiple Award Schedules (MAS) and FAR Part 8 – Required Sources of Supplies and Services to meet the agency’s needs.

This Justification for Other than Full and Open Competition (JOFOC) authorizes and approves the issuance of a sole source, firm-fixed price purchase order for the acquisition of Dismounted EOD-OPS-PAK III disruptor kits which are currently only developed and fielded by Concept Development Corporation (CDC), a maker of First Line Bomb technician and Tactical disruption tools.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.

ATF’s Bomb Technicians have a requirement for a reliable, portable, cartridge powered, dynamic energetic disruption tool, for the render safe of improvised explosive devices and certain other pieces of military ordnance and similar materials and devices. This requisition is for the purchase of the highly specialized and proprietary ammunition currently used in this disruptor listed under Line (2), which is fielded to all current ATF bomb technicians. The CarbonFire disruptor is designed to only work safely and reliably with the ammunition listed under Line (3) Description of Requirement.

I have attended numerous vendors shows at International Association of Bomb Technicians and Investigators (IABTI) Training Sessions where I have had the opportunity to speak with vendor representatives and examine various types of Explosives Protective Equipment. Additionally, I am in regular contact with other Bomb Technicians and EOD Operators and maintain currency in availability of equipment in the Bomb Technician Community.

There are three main manufacturers of disruptor tools for Bomb Technicians:

Ideal Blasting – The Pneumatic Actuated Non-Electric (PAN) disruptor is a common disruptor used throughout bomb squads in the USA. This disruptor is the primary disruptor used to instruct new bomb technicians at the FBI Hazardous Devices School in Huntsville, AL. The PAN disruptor uses ammunition produced by L-Tech Enterprises. ATF does not currently stock L- Tech ammunition. L-Tech ammunition may cease to produce PAN ammunition in the future.

The ATF Bomb Tech Program has not purchased PAN ammunition or required accessories in years as this would cause a major financial burden on the Bomb Tech Program.

Royal Arms – Royal Arms produces numerous size disruptor for various Bomb Disposal and EOD mission sets. ATF has not purchased Royal Arms disruptors in the last 20 years.

Consequently, ATF Bomb Technicians are not familiar with this system. The Royal Arms disruptors use specific ammunition produced solely for their deployment and is not compatible with the current ATF issued disruptor system.

Concept Development Corporation – The ATF Bomb Technician Program chose the CarbonFire disruptor system over other disruptor systems approximately 10 years ago. The CarbonFire system is lighter weight, more compact in size and is competitively priced as the other available disruptor systems. The ATF Bomb Technician Program has invested significant time and money to equip it’s more than 50 active bomb techs who are operating around the United States. The other disruptor systems still do not offer the requirements needed by the ATF bomb technicians in versatility, compactness and mobility. ATF also stocks and maintains a large quantity of CarbonFire specific ammunition for training, operational and emergency deployment needs.

In the current environment that requires Explosive Ordnance Disposal/Public Safety Bomb Technicians to operate in a Tactical Environment yet maintain the ability to conduct safe and effective render safe procedures, a suitable disruptor kit is required. The Concept Development Corporation, Dismounted EOD-OPS-PAK III meets the needs of the ATF Bomb Technician, who needs a lightweight, versatile, and easily mobile package.
