2. Nature/Description of Action being approved, i.e., sole source, limited competition, establishment of a new source, etc:

This Justification for Other than Full and Open Competition (JOFOC) authorizes and approves the issuance of a sole source justification, firm-fixed-price purchase order for three (3) Leica Geosystem BLK360 Laser Scanner.

3. Description of Supplies/Services and estimated value, including options:

The Fire and Arson Investigation Branch (FAIB) of the Fire Investigation and Arson Enforcement Division (FIAED) now intends to purchase Leica Geosystem BLK360 Laser Scanners. By purchasing Leica BLK360 scanners, the National Response Team will be able to utilize currently used Leica Software such as IMS Map 360. The integration of the BLK Laser scanner will be a seamless process to the NRT. See attached Leica Geosystems, Inc. quote 95279B for additional specifications and details.

Quoted costs are $87,911.00 Period of Performance is 09/05/2019 to 11/30/2019

4. Pursuant to FAR subpart 6.3 and in accordance with the requirement of FAR 6.303, this J&A is supported by the following statutory authority and reason for the statutory authority cited:

5. Demonstration of Contractor’s Unique Qualifications or Nature of the Acquisition that Requires use of Authority Cited:

Leica Geosystems, Inc. is the designer and producer of this equipment. This is proprietary property and is manufactured by the vendor. By purchasing directly from the manufacturer, Leica will provide unlimited monthly live virtual classroom sessions.

Leica has combined proprietary key features that other manufactures cannot offer such as integrated FLIR technology. The purchase of additional equipment will provide access for additional agents during fire and explosives scene investigations. These agents will, in turn, increase the trained resources that FIAED will have available for use in support of their mission.

6. Description of efforts made to ensure that offers were solicited from as many potential sources as practicable. Include whether or not a FBO announcement will be issued and attached a draft of the FBO notice. Include any exception under FAR 5.202, when not synopsizing. If the justification covers a brand name requirement this section should address compliance with 5.102(a)(6). Identify if any/similar requirements are anticipated in the future:

Additional offers were not solicited for this acquisition due to the fact that these property and services are only available from the proposed contractor, Leica Geosystems, Inc. As such, they are uniquely qualified to provide the product and services. Therefore, the circumstances did not warrant researching of other resources.

7. Determination by the Contracting Officer that the anticipated Dollar Value, including options demonstrates of fair and reasonable cost.

In accordance with FAR 13.106-3 (a)(ii) Comparison of the proposed price with prices found reasonable on previous purchases for the same and/or similar services. Previous purchases of similar equipment are listed below.

8. Market Research:

Market research for alternative product resulted in zero availability of similar products with key features necessary for the NRT’s mission.

9. Additional Supporting Facts:

a) Explanation of why technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition have not been developed or are not available:

b) If FAR 6.302-1 is cited for follow-on, state the estimate of cost to the Government that would be duplicated and how the estimate was derived. In addition, state the data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.

10. Listing of Sources that expressed a written interest in this acquisition:

No other sources other than Leica Geosystems, Inc have expressed an interest in writing to ATF regarding this procurement.

11. Actions Taken to Remove or Overcome any Barriers to Competition:

The Bureau makes every effort to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The Acquisitions Branch will continue to utilize bidding websites as well as other competitive procedures to promote competition to the maximum extent practicable.

The Requesting Office will continue to research the marketplace and communicate with other agencies to determine if similar products and /or services can meet its needs in the future to remedy the restricted competition on future requirements of this technical nature.
