WBR 1413.106-1 Form 1 40410246 (February 2017)

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

PR No: 40410246 Award No.: 140R3018P0084 Project Name: Replace Broken Gates and Upgrade Security Access Controls for PXAO Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1), for purchases not exceeding the simplified acquisition threshold (SAT). Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

When a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3. Must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

Bureau of Reclamation (Reclamation), Lower Colorado Region (LCRO), Phoenix Area Office (PXAO), Glendale, AZ

2. Name and Address of Single Source.

APL Access & Security, Inc.

115 S. William Dillard Drive Gilbert, AZ 85233

3. Description of Supplies/Services and Estimated Cost.

Urgent need to repair broken gate and provide upgrade to security access controls to work with new gate at Reclamation’s PXAO.

Background: The PXAO facility entrance utilizes a bar arm gate barrier and intercom security system. The system is outdated and has been working intermittently, often remaining upright or card reader inoperable until Reclamation maintenance employees were able to refurbish them, as replacement parts are obsolete.

Currently, the gates, intercom and card readers are inoperable and beyond repair. There is now a high security risk at the entrance of the PXAO facility.

In accordance with a physical security assessment performed in accordance with the “Risk Management Process for Federal Facilities: An Interagency Security Committee Standard-August 2013 first Edition”, PXAO has a Facility Security Level (FSL) determination of Level l. Based on this FSL determination, certain countermeasures need to be in place. Section B.7.4 “Facility Entrance Security Criteria: 38” states requirements for Visitor Access Control as follows: “Entrances are open to the public during business hours [and] after hours, visitor entrances are secured and have a means to verify the identity of persons requesting access prior to allowing entry into the facility.”

4. Description of Circumstances, including why only one source is reasonably available.

Unusual and compelling urgency is why only one source is reasonably available.

The PXAO facility does not meet the required Physical Security Standards requiring secured entrances to the facility after hours because the entrance gates suddenly became inoperable. Reclamation maintenance employees were unable to fix the gates. Additionally, upgrade of the security system is required for the facility to be compliant.

5. Determination of Fair and Reasonable Cost.

Pricing will be compared to an existing contract for similar (security) services and will also be compared to the IGCE.

6. Description of Market Research.

PXAO contacted current LCRO security contractor. Since this is an urgent requirement no other market research was conducted.
