About this file

This document is a determination to solicit from a single source for Solicitation Number 140R123P0082 for 7J--FCU SPARES. The Bureau of Reclamation requires Control Systems International to furnish nine units of pre-configured UCOS FCU and microFCU hardware licensed with UCOS software. Reclamation currently has a service agreement in place with CSI for the proprietary UCOS software installed on its YDP DCS, and CSI is the only vendor that can provide software support, engineering, and sales for the UCOS control system and branded hardware. Any other company would need to work through CSI to offer UCOS software upgrades, modifications, or assess the custom features of Reclamation's existing UCOS system. Fair and reasonable pricing will be determined by comparing the proposed price to previous purchases, market research, and an independent government estimate.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Acquisition and Assistance Operations Branch, Denver, Colorado.

2. Name and Address of Single Source. Control Systems International (CSI), 1 Sterling.

Irvine CA, 92618-2517

3. Description of Supplies/Services and Estimated Cost.

The supply contract will require CSI to furnish three units each of UCOS FCUs IPC427E and six units each of UCOS microFCU IPC127E hardware that are pre-configured at the factory and licensed with UCOS.

4. Description of Circumstances, including why only one source is reasonably available.

Reclamation currently has a service agreement in place with CSI for the User Configurable Open System (UCOS) software on the YDP DCS. CSI holds all proprietary rights to the UCOS software and services and CSI is the only vendor that offers software support, engineering, and sales relating to the UCOS control system including UCOS branded FCU and microFCU hardware installed at the YDP. Any other company attempting to offer UCOS software upgrades or make changes to UCOS’s unique OPC interface on the Government’s system must work through CSI. Any other company attempting to assess or learn the custom features of the YDP’s UCOS must be familiar with CSI’s UCOS system already in place. Software upgrades and modifications for the UCOS system are only offered by CSI as they developed the system and own all proprietary rights.

If award was made to a different vendor, Reclamation would have to completely start over with new software and new equipment. At this time, Reclamation has invested approximately into the existing platform. Reclamation would also need to retrain staff and end users on the new equipment. IAW FAR 13.106-1(b)(1)(i), only one source will be solicited because circumstances of the contract deem only one source reasonably available.

5. Determination of Fair and Reasonable Price. Fair and reasonable pricing will be based on comparison of the proposed price with prices found reasonable on previous purchases, market research and comparison to an independent Government estimate.
