BRAND NAME JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY

FOR REQUIREMENTS NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

Any order against a multiple award contracts, including Governmentwide acquisition contracts (GWACs) and valued between the micro-purchase threshold and simplified acquisition threshold that do not allow for fair opportunity (see FAR 16.505(b)(1)) on the basis of a brand name specification must be documented in accordance with Federal Acquisition Regulations (FAR) 16.505(b)(2)(ii)(A)). This template may be used for this purpose. The customer shall provide the following information:

Brief description of supplies or services required and the intended use:

Acquisition of 22,000 CounterTack “Sentinel” Licenses.

Describe the rationale and facts that demonstrate that no other supplies and/or services will meet the Government’s need and that an exception to fair opportunity based on the use of a brand name specification is justified. The exception to fair opportunity when brand name descriptions are used is based on FAR 16.505(b)(2)(i)(B) – “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.”

DEA has made a substantial investment (researching, evaluating, testing, hardware capability, training, funds & time)in this brand of technology to support the

Department mandated for endpoint protect capabilities. The requested licenses are the same brand currently deployed and are intended to upgrade current licenses to leverage new product enhancements and capabilities. Replacing the licenses with another brand will require DEA to invest additional time and resources conducting extensive testing and evaluations to determine compatibility, time training staff on the different technology, and funds for additional maintenance support.

This requirement can be posted on SEWP and awarded to any authorized Countertack

Sentinel reseller.

The Contracting Officer hereby certifies that:

(1) No supplies and/or services other than the supplies and/or services described in this justification will meet the Government’s need;

(2) An order for the supplies or services will not be placed unless the price is determined to be fair and reasonable; and

(3) If the acquisition exceeds $30,000, this Brand Name Justification for Exception to Fair Opportunity will be made available together with the solicitation to all contract awardees.
