SECTION 1 – INTRODUCTION

1.1 GENERAL

This solicitation is being issued by the Department of the Interior (DOI)/Interior Business Center, Acquisition Services Directorate (AQD), on behalf of FirstNet, pursuant to Federal Acquisition Regulation (FAR) Part 12— Commercial Items and FAR Part 13 — Simplified Acquisition Procedures.

This solicitation has been totally set aside for Small Business Concerns. All Small Business Concerns vendors are invited to submit a quote.

This solicitation is a “brand name or equal” requirement for Programmable Attenuators.

AQD operates as a Federal Franchise Fund Contracting Office under the authority of the Government Management Reform Act and provides contracting support to Federal Civilian and Department of Defense Agencies. AQD will handle the solicitation and resultant contract administration, as well as payment of invoices.

Anticipated Award Type: The Government anticipates an award of a fixed-price Purchase Order as a result of this RFQ.

Anticipated Period of Performance: All items must be delivered no later than 30 days after award.

RFQ QUESTIONS: Offerors must submit all questions concerning this solicitation in writing by e-mail to the Contracting Officer, Leonard Nadybal at leonard_nadybal@ibc.doi.gov and Contract Specialist José Jiménez at jose_jimenez-figueroa@ibc.doi.gov. All questions must be submitted via e-mail, and received no later than 12:00 PM Eastern Time (ET) on December 29, 2016.

Acquisition Services Directorate will answer questions and submit the questions and its answers in an amended solicitation via the Federal Business Opportunities website (www.fbo.gov). Government answers to the questions may affect offers. Please be advised that the Government reserves the right to transmit those questions and answers of a common interest to all prospective offerors. The offeror or source of the question will not be referenced when issuing an amendment to the solicitation. Questions received after the specified deadline date/time may not be accepted. It is the responsibility of the offeror to get their submission in on time and ensure successful delivery to the Contracting Officer and Contract Specialist listed above.

QUOTES DUE DATE: The due date for response to this RFQ is on or before 12:00 PM ET January 6, 2017.

The Government reserves the right to not accept quotes received after the closing date and time. It is the responsibility of the offeror to get their submission in on time and ensure successful delivery to the Government.

SECTION 3 - GENERAL TASK ORDER TERMS AND CONDITIONS

Period of Performance: All items must be delivered no later than 30 days after award.

Shipping Instructions: F.O.B Destination only. The Programmable Attenuators shall be delivered to FirstNet at 3122 Sterling Circle, Suite 100, Boulder, Colorado, 80301.

Delivery Summary: The government expects the contractor shall fully comply with the delivery requirements.

FirstNet does not require installation by the contractor.

Government Furnished Property: The Government will provide any additional information requested by the contractor. We anticipate no government owned property will be provided.

DOI-AAAP-0028 Electronic Invoicing and Payment Requirements – Internet Payment Platform (IPP) (April 2013) Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IFP invoice

INVOICE CONTENTS:

Invoices must include, as a minimum, the following information:

1. CLIN/Item number of deliverable

2. Description of deliverable

3. Price of deliverable

4. Quantity of deliverable

5. Date deliverable was provided to the Government for inspection

6. Serial number/part number if applicable

7. Other Direct Costs (ODC’s) incurred (including supporting documentation/receipts of all other charges) for the current billing period and cumulative to date The contractor is responsible for ensuring invoices submitted are accurate and complete, and all labor, travel and other direct costs are in accordance with federal guidelines, the FTR and other Government mandates and directives.

Additional supporting documentation MAY BE REQUESTED at the discretion of the COR or CO.

PAYMENT:

a. Payments under this order will be due 30 calendar days after the date of actual receipt of proper invoice in the office designated to receive the original invoice or final acceptance of the goods or services, whichever is later.

b. The date of the check issued in payment or the date of payment by wire transfer through the Treasury Financial Communications System shall be considered to be the day payment is made.

FINAL INVOICE:

Within sixty calendar days of product acceptance and/or completion of services:

a. The contractor shall submit a final invoice, designated as such by a clear statement of “FINAL INVOICE” on the face of the invoice document.

b. The contractor shall provide a certificate of completion which certifies all goods and service have been provided as required by this contract.

c. The contractor shall provide a release of claims against the government for any further payment under this contract.

The sixty calendar day submission timeframe shall not be extended without written authorization from the contracting officer. In the event items a, b, or c above are not submitted within the authorized timeframe, the contracting officer will make final cost determinations in order to make final payment and close out the contract unilaterally.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 - 5 business days of the contract award date.

Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

Payment for Unauthorized Work: No payments will be made for any unauthorized supplies and/or services or for any unauthorized changes to the work specified herein. This includes any services performed by the Contractor of their own volition or at the request of an individual other than a duly appointed Contracting Officer. Only a duly appointed Contracting Officer is authorized to change the specifications, terms, and conditions under this effort.

Authority to Obligate the Government: The Contracting Officer is the only individual who can legally commit or obligate the Government to the expenditure of public funds. No cost chargeable to the proposed contract can be incurred before receipt of a fully executed contract or specific authorization from the Contracting Officer.

Use of Options: Pursuant to FAR Section 17.203, Solicitations, options prices shall be no higher than those for the initial requirement. The use of options is limited to no more than 50% of the initial quantity of the same contract line item.

DIAR 1452.201-70 AUTHORITIES AND DELEGATIONS (MAY 2010)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

The COR for this contract will be appointed at a later date.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.

The Contractor need not proceed with direction that it considers to have been issued without proper authority.

The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

The Government may increase the quantity of supplies called for in the Schedule at the unit price specified. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days before expiration of the purchase order. (d) Comptroller General Examination of Record. (As used in this clause, the term 'brand name' includes identification of products by make and model.)

(a) If items called for by this solicitation have been identified in the schedule by a 'brand name or equal' description, such identification is intended to be descriptive, but not restrictive, and is to indicate the quality and characteristics of products that will be satisfactory. Quotes offering 'equal' products (including products of the brand name manufacturer other than the one described by brand name) will be considered for award if such products are clearly identified in the offer and are determined by the Government to meet fully the salient characteristics requirements listed in the solicitation.

DIAR 1452.216-71 Use and Disclosure of Proposal Information –Department of the Interior (Apr 1984)

(a) Definitions. For the purposes of this provision and the Freedom of Information Act (5 U.S.C. 552), the following terms shall have the meaning set forth below:

(1) "Trade Secret" means an unpatented, secret, commercially valuable plan, appliance, formula, or process, which is used for making, preparing, compounding, treating or processing articles or materials, which are trade commodities.

(d) Information in a proposal identified by an offeror as trade secret information or confidential commercial and financial information shall be used by the Government only for the purpose of evaluating the proposal, except that (i) If a contract is awarded to the offeror as a result of or in connection with submission of the proposal, the Government shall have the right to use the information as provided in the contract, and (ii) if the same information is obtained from another source without restriction it may be used without restriction.

(e) If a request under the Freedom of Information Act seeks access to information in a proposal identified as trade secret information or confidential commercial and financial information, full consideration will be given to the offeror's view that the information constitutes trade secrets or confidential…
