U.S. Department of Justice Drug Enforcement Administration
FBO Synopsis
The U.S. Department of Justice, Drug Enforcement Administration (DEA) has a requirement for AN/PRC-152A radios. The NAICS code is 334220, Radio Television Broadcasting and Wireless Communications Equipment Manufacturing. The size standard is 750 Employees. The requirement is unrestricted. The Government intends to award a single, firm-fixed price purchase order in accordance with FAR Part 13 – Simplified Acquisition Procedures to Harris RF Communication. THIS IS A BRAND NAME REQUIREMENT and a Limited Sources Documentation is approved and included in this notice. No substitution for the Brand Name will be accepted. If the quote includes items that are not the Brand Names included in this notice, they will be not be considered for award. This is an ALL or NONE requirement. Award -technically acceptable quote with the lowest price. The Government may reject all offers received in response to this solicitation, if doing so is in the best interest of the Government. Late submissions will not be accepted. No telephone or fax requests will be accepted. This solicitation does not commit the Government to pay any costs incurred in the submission of a quotation.

DEA-2852.209-75 NATIONAL SECURITY RISK ASSESSMENT (JUN 2014)
(a) Any offeror responding to this solicitation acknowledges that before acquiring information technology equipment or software, the U.S. Department of Justice and its component entities will assess the supply chain risk of cyber-espionage or sabotage associated with the acquisition of such equipment or software, including any risk associated with such equipment or software being produced, manufactured, or assembled by one or more entities identified as posing a cyber-threat, including but not limited to, those that may be owned, directed, or subsidized by the People’s Republic of China.
(b) By submitting an offer to this solicitation, the Offeror understands and agrees that the Government retains the right to reject any offer or response to this solicitation made by the Offeror, without any further recourse by, or explanation to, the Offeror, if the Government determines the Offeror or the equipment or software offered by the Offeror, in whole or in part, presents an unacceptable risk to national security.
(c) To assist the Government in assessing whether the acquisition poses a national security risk, offerors are required to complete and submit with its offer or quotation the National Security Acquisition Risk Assessment Questions, which are attached to this solicitation. Offerors must answer all questions completely and accurately to the best of their knowledge and belief. All answers are to be reflective of the parent and subsidiary levels of an organization.

(d) Offerors are also required to request, collect, and forward with its offer or quotation completed National Security Acquisition Risk Assessment Questions from all subcontractors that will provide any equipment or software in performance of the contract or order. Offerors are responsible for the thoroughness and completeness of each subcontractor's submission.
(e) Failure to provide any such requested information may render a proposal unacceptable.
DEA-2852.209-77 CERTIFICATION REGARDING RESTRICTIONS ON USE OF APPROPRIATED FUNDS (SEP 2015)
Offerors must complete the certifications and submit them with their offers or quotes regardless of dollar value.
(a) Section 523 of Title V, Division B of the Consolidated & Continuing Appropriations Act, 2015 (the Act) requires that none of the funds appropriated or otherwise made available by this Act may be used to enter into a contract in an amount greater than $5,000,000 unless the prospective contractor or grantee certifies in writing to the agency awarding the contract or grant that, to the best of its knowledge and belief, the contractor or grantee has filed all Federal tax returns required during the three years preceding the certification, has not been convicted of a criminal offense under the Internal Revenue Code of 1986, and has not, more than 90 days prior to certification, been notified of any unpaid Federal tax assessment for which the liability remains unsatisfied, unless the assessment is the subject of an installment agreement or offer in compromise that has been approved by the Internal Revenue Service and is not in default, or the assessment is the subject of a non-frivolous administrative or judicial proceeding.
(b) Section 743 of Title VII, Division E of the Act prohibits an agency from using any funds appropriated by the Act to enter into a contract with any corporation that requires employees or contractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. This limitation shall not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(c) Sections 744 and 745 of Title VII, Division E of the Act prohibits an agency from using any funds appropriated by the Act to enter into a contract with any corporation that (1) has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, and (2) has been convicted of a felony criminal violation of any Federal law within the preceding 24 months unless an agency first considers suspension and debarment and makes a determination that such actions are not necessary to protect the interests of the Government before entering into a contract.
(d) Restrictions similar to those as described in paragraphs (a), (b), and (c) are expected to be included in subsequent appropriations acts.
(e) The offeror/contractor hereby certifies that –
(1) The offeror/contractor does does not require employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(2) The offeror/contractor is is not a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and
(3) The offeror/contractor is not a corporation convicted of a felony criminal violation under any Federal law within the preceding 24 months.
(f) If this the offer or contract exceeds, or will exceed, $5,000,000, the offeror/contractor also represents that –
(1) It has has not filed all Federal tax returns required during the three years preceding the date of its offer or date of award, whichever is earlier;
(2) It has has not been convicted of a criminal offense under the Internal Revenue Code of 1986; and

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form.
This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
