FAR 52.212-1 ADDENDUM Instructions to Offerers -- Commercial Items
1. SUMMARY: This is a request for quotation. Responses to this solicitation are considered quotations and not offers. In those instances where the words offer, offeror, and proposal are used, the reader should understand that the use of such words does not change the nature of this request for quotation.
2. SUBMISSION OF QUOTATIONS: Quotations must be returned to the email address(es) listed below no later than the date and time specified in block #8, page #1 – 20:00 Arabia Standard Time, 22 April 2020 13:00 Eastern Daylight Time, 22 April 2020 10:00 Pacific Daylight Time, 22 April 2020
Faxed quotations will not be accepted. When submitting via Email, offerors should limit attachment size to 2MB. If necessary, multiple Emails should be submitted. In all cases, quoters should obtain a proof of deliver/proof of receipt submission. If the quoter does not receive proof of receipt, quoter should assume his/her submission did not reach the individual(s) below. The Government reserves the right to make an award solely on initial quotes received. Quoter’s bear the burden of ensuring that all portions of the quote (and any authorized amendments) reach the designated office on or before the deadline specified in the solicitation. 3. QUESTIONS: Questions shall be submitted by email no later than (2) days after issuance of the solicitation to the email addresses listed above. No phone questions will be accepted. The deadline is necessary to ensure timely award and the Government may, in its sole discretion, choose not to respond to questions received after the deadline. All questions will be reviewed and responded to by an amendment to the solicitation.
4. PERIOD FOR ACCEPTANCE OF OFFERS: The offeror shall hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers.
5. SYSTEM FOR AWARD MANAGEMENT (SAM): Contractors must be currently registered in the System for Award Management (SAM) to be eligible for award. For information and registration, go to http://www.sam.gov Note: Not required to complete Provision 52.212-3 if registered in http://www.sam.gov
6. WIDE-AREA WORKFLOW – RECIEPT AND ACCEPTANCE: As a condition of receipt of any resulting order, the Contractor agrees to implement the Department of Defense (DOD) web-based application.
Information on registering in WAWF/iRAPT may be obtained from https://wawf.eb.mil/xhtml/unauth/registration/notice.xtml or by calling 866-618-5988. Registration in WAWF/iRAPT is free.
COMPLETE SUBMISSION: At a minimum, offerors must meet the requirements set forth in FAR 52.212-1(b) Submission of Offers. Offerors are encouraged to submit quotations on this SF 1449. However, if the if the offer is not submitted on the SF1449, the offerer will include a statement specifying the agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
52.212-2 (AMENDED) EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Price –
All quotes must be the Contractor’s Best Pricing. Price analysis shall be used to verify that the overall price is fair and reasonable. In order to be considered for award, price must be determined fair and reasonable. All pricing shall be in US DOLLARS with no more than (2) decimal points.
(b) Contract Authority and Basis for Award
1. The Government will solicit and award this contract using Simplified Acquisition Procedures, in accordance with FAR part 13 and FAR part 12. As a result of this authority, certain requirements for soliciting, awarding, and notifying quoters are streamlined. In accordance with FAR 12.102(c), when a policy in another part is inconsistent with FAR Part 12, FAR Part 12 shall take precedence.
2. Basis for Award: Award will be made to the offer, whose offer conforms to the solicitation and represents the best value to the Government.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. 252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (DEC 2018)
(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:
(1) Document type. The Contractor shall submit payment requests using the following document type(s):

(2) Fast Pay requests are only permitted when Federal Acquisition Regulation (FAR) 52.213-1 is included in the contract.
