JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR

Part 2) UP TO SAT (See FAR 13.106-1)

Date: 7 March 2022 PR Number: 40611913

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

Provide adequate deep water docking for the installation of a floating dock and a 50 x 30 parking area.

The Lakeshore will install a floating dock on the premises for the Lakeshore’s 28’ Personnel Transport Vessel and 40’ Peckman Landing Craft. The estimated cost for services is $9,500 per fiscal year.

2. Sole Source Justification rationale (Check one and explain below):

__X____ Only one responsible source.

______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

______ Other _____________________________________________________

Explain:

The Leland Harbor is the only safe harbor marina within reasonable distance. The next usable marinas are over 1 hour farther away. The additional time and cost associated with traveling to the Manitou Islands from alternate locations is prohibitive. Leland is the base for the Manitou Island Transit (MIT) private ferry concession serving Lakeshore visitors traveling to the Manitou Islands. The Lakeshore needs support space to coordinate visitor orientation and contact at Leland due to the location of MIT.

The MIT also provides transportation of Lakeshore employees, contractors, volunteers, and government agencies conducting Lakeshore business when those needs are unable to be met with Lakeshore watercraft.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

There are other marinas however no other practical ones. The Lakeshore previously had rented the exact same spaces for the last 10 years for the exact same price of $9,500 per fiscal year. Under contracts 140P13PX00203 and 140P60118P0037. The marina is owned and rented out by the local township.

Consequently, the vendor is considered an other than a small business due to being a government entity - Leland Harbor is owned by the local government.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
