New Contract Award to upgrade the Main Academy Building's Building Automation System (BAS), located at the DEA Office of Training (TR). The existing system was installed in 1997 and is outdated, discontinued, and is not energy efficient.

The existing Building Automation System at DEA TR is out of date and becoming less serviceable each year. It was designed around a Windows 2.5 operating system using analogue wiring and devices. The technology is outdated by current standards, the communications are very slow, and the system is lacking in energy efficiency and environmental control.

To meet the current and future needs of DEA's mission, and provide a comfortable, efficient, and dependable environment conducive to learning, we need to upgrade the Automated Logic (AL) Building Automation System (BAS), and the associated equipment located at the DEA TR, 2500 Investigation Parkway, Quantico, VA 22135.

JUSTIFICAI ION FOR OTHER THAN FULL AND OPEN LoMPETITION

Period of performance or Total estimated value: $1,185,032.00 final delivery date: 8/17'/2015 - 7 /31/2016

4. An identification of the.statutory authority permitting other than full and open competition.

41 U.S.C. 3304(a)(l)

5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.

The programming and engineering of the current BAS system are copyrights/patents of the Automated Logic Company, and therefore, can only be serviced by a certified Automated Logic Company Representative. Market research results demonstrated that EMS Technologies is the only Automated Logic Company Representative.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

In accordance with the Federal Acquisition Regulations (FAR), Part 5, Subpart 5.2, the contract Support Specialist posted the requirement on Fed Biz Opps on June 3, 2015 to broaden industry participation in meeting the government requirement.

7. A determination by the.contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contract Support Specialist used price analysis techniques and procedures to ensure tfair and reasonable prices in accordance with FAR 13.106-3(a)(2)(ii) comparison of the proposed prices to current prices paid for the same or similar services. The Contract Support Specialist requested a job price breakdown from EMS Technologies and compared prices provided in DEA contracts for same or similar services. EMS Technologies provided lower or comparable prices to current prices in contracts for same or similar services. Based on the price analysis, the prices proposed by EMS are considered to be fair and reasonable.

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

The Contract Support Specialist conducted market research to determine: (1) if more than one vendor could satisfy the agency's requirement (posting a notice to Fed Biz Opps), and (2) if the price is fair and reasonable. Through the Fed Biz Opps posting, as well as internet research, the Contract Support Specialist determined that only Automated Logic Representatives are able to provide the services requested and EMS is the only Automated Logic Representative found.

9. Any other facts supporting the use of other than full and open competition, such as:

i. Explanation of why.technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.
