There are thirty-one (31) locations throughout the Continental United States (CONUS), Hawaii, Puerto Rico, Saipan, and America Samoa that rely on services provided by this contract. The current contract does not have any remaining options. It is necessary to start this modification on 28 February 2022 to ensure there is not an interruption in services.

Period of Performance: 28 February 2022 to 27 August 2022

4. Authority Cited. 10 U.S.C. 2304(c)(1), as implemented in Federal Acquisition Regulation 6.302-1 (a)(2)(iii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited. As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

a. Pursuant to FAR 6.302-1(a)(2)(iii), the current contractor, Rapier Solutions, Inc. is the only responsible source to provide these services for the period required, as they are currently performing these services. As further described in FAR 6.302-1(a)(2) (iii)(B), services may be deemed to be available only from the original source for the continued provision of highly specialized skills when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements. This contract modification will allow for the continuation of mission critical ID card services to 31 locations as reservists cannot be mobilized, travel with orders, and receive necessary services prior to travel to the MOB stations without ID cards. This modification is a bridge so that the GAO Protest can be resolved.

During the base period for Contract W91247-20-C-9001, the Requiring Activity identified additional necessary requirements that emerged. Therefore, on 11 December 2020, FAR Clause 52.217-8 (Option to Extend Services), was utilized, instead of FAR Clause 52.217-9 (Option to Extend the Term of the Contract) to extend services under the contract to 11 June 2021. Due to the additional requirements that were identified during the base period, the Government initiated the reprocurement process (solicitation

no. W91247-21-R-0050) for follow-on services to W91247-20-C-9001.

The follow-on procurement documentation was not submitted to the MICC-Fort

Bragg Office until 5 February 2021 due to delays incorporating the new changes. Due to the current contract ending on 11 June 2021, in addition to key contractor personnel

ongoing competitive procurement, would likely result in a break in services as it would still require the same procurement acquisition lead-time (PALT) as the current follow-on competition. Additionally, it would duplicate the 30-day phase-in and phase out costs, which would not be recovered through competition, as the entire bridge is only six months.

a. Effective Competition. Because this is a sole source action, effective competition is not applicable.

b. Subcontracting Competition. Rapier Solutions is a certified Service-Disabled Veteran-Owned Small Business (SDVOSB) firm.

AR Clause 52.219-14 has been implemented into contract W91247-

20-C-9001. The 2021 deviation for FAR Clause 52.219-14 will be incorporated into the modification.

7. Actions to Increase Competition. The MICC-Fort Bragg awarded the USARC G1 follow-on competitive requirement, W91247-22-C-0006, on 28 January 2022 before issuing a stop work order as a result of the GAO protest.

8. Market Research. There is not sufficient time to conduct thorough market research of companies capable/ willing to perform the services required for a six (6) month extension for the required services. Moreover, the need for continued services without interruption is imperative to ensure continuity of these critical services.

9. Interested Sources. In accordance with DFARS PGI 206.302-1(d), MICC has issued a waiver, attached to this J&A, for waiving the requirement to post a sources sought synopsis under the following limited circumstance: when, as a result of a protest, a contract must be extended on a sole source basis pursuant to the authority of FAR 6.302-1.
