Period of Performance: 1 January 2021 through 31 December 2021 Option Year 1 PoP: 1 January 2022 to 31 December 2022 Option Year 2 PoP: 1 January 2023 to 31 December 2023

This requirement will be procured using Operations and Maintenance 3400 funds.

A Rough Order Magnitude (ROM) for this effort was provided by the Original Equipment Manufacturer, Analytical Graphics Inc.

IV. Statutory authority permitting other than full and open competition.

In accordance with 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures in accordance with procedures of FAR 13.5, Simplified Procedures for Certain Commercial Items.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

This effort, being acquired via a sole source, was identified as such by the Original Equipment Manufacturer as the Sole Provider of these products. This is commercial-off-the-shelf (COTS) technology.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

AGI does not actively maintain or support a domestic reseller network for its suite of commercial software products.

AGI's Business Partners are not authorized to sell STK products on a commercial basis unless sold in conjunction with their third party products and/or services.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The overall cost of this acquisition will be negotiated in accordance with procedures in FAR Part 12 and FAR 13.106-3(a) (2), and include a statement of price reasonableness confirming the ultimate price to the Government is fair and reasonable. Additional pricing methodologies to negotiate fair and reasonable price may include reviewing publicly offered catalogs, comparison to historical contractor sales, and/or analysis of limited cost or pricing information provided by the contractor. In the event that limited cost or pricing information is made available, the Government's negotiation objective will be developed using local technical analysis and direct and indirect rate factors recommended by the Defense Contract Management Agency.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research was conducted and reviewed on the DoD ESI BPA site, GSA Advantage, MAS and NASA SEWP V and concluded that there is no vendor on any of those listed contract vehicles that can provide the items on this requirement. Typically, AGI Business Partners are service providers that utilize AGI products to create and offer an integrated service solution to their respect client base. AGI is on the beta.SAM; which is the recommended procurement method for this acquisition.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

X. List of any sources that expressed, in writing, an interest in the acquisition.

None.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

In an effort to remove or overcome such a barrier to competition in the future, the market will be scanned frequently for new companies and products that could satisfy the government's requirements. Vendor and trade magazines are scanned for new, open technologies that can satisfy future infrastructure requirements. As an integration lab, the agency will continually revisit the brand name equipment currently being used and will research for the manufacturers and products that will be in the government's best interest as best value for future replacement equipment at the agency's site and at sites the agency supports. The current situation dictates the purchase of Enterprise Collection Planner licenses for the previously stated standardization reasons. Since there is a continual revisit to the brand names currently being used by the agency for the present equipment, if/when alternatives to the requested equipment become available, they will be reviewed for approval to use.

XII. Certification by the Contracting Officer.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.

XIII. Certification by the technical/requirements personnel.
