Section B – Supplies or Services and Prices/Costs

B.1. Supplies/Services

Under this contract, the Contractor shall provide all the necessary supplies and services (other than that identified in this contract as being government-furnished) to perform a Firm Fixed Price (FFP) Contract. Work shall be performed in accordance with this Contract’s Statement of Work, Section C, and other terms and conditions of this Contract.

SECTION C- STATEMENT OF WORK (SOW)

Training on Evidence-Based Practices (EBP) and Cognitive Behavioral Intervention (CBI) Strategies

1.0 GENERAL

This is a non-personnel services contract to provide training on Evidence-Based Practices (EBP) and Cognitive Behavioral Intervention (CBI) strategies. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

1.1 Background: Court Services Offenders Supervision Agency (CSOSA) was established under Section 11232 of the National Capital Revitalization and Self-Government Improvement Act of 1997 to effectuate the reorganization and transition of functions relating to pretrial services, parole, adult probation and offender supervision in the District of Columbia to a Federal Branch Agency. The mission of CSOSA is to increase public safety, prevent crime, reduce recidivism, and support the fair administration of justice in close collaboration with the community. CSOSA is responsible for the supervision of all probationers and parolees held under the authority of any United States or District of Columbia statute, or any other lawful authority and entrusted to the District.

1.1.1 Key to upholding CSOSA’s mission is the ability of staff to effectively contribute to reducing recidivism among the supervised population. To do so, our staff must be fully trained and proficient in implementing cutting edge evidence-based practices and cognitive-behavioral interventions so that they can develop risk reduction strategies appropriate to their clientele within the field of community corrections. In the Fall of 2002, CSOSA embraced EBP/CBI and developed a comprehensive, detailed plan to implement EBP (also known as “What Works”) in the Agency to improve offender (hereinafter referred to as “client” or “clients”) outcomes and the client’s successful reintegration in the community. Introduction of the concept with CSOSA staff began in January 2003, with awareness building of EBP for managers. In September of 2003, CSOSA began training its line staff on EBP and its application within the Agency. Over the years, CSOSA staff have participated in various EBP/CBI trainings as indicated in Attachment J-1, Evidence-Based Practices Training Phases Implemented in CSOSA.

1.1.2 Evidence-Based Practices (EBPs) is the objective, balanced and responsible use of current research and the best available data to guide policy and practice decisions, such that outcomes for clients are improved. EBPs were used originally in the health care and social science fields, and EBP focuses on approaches demonstrated to be effective through empirical research, rather than through anecdotal or professional experience alone. In contrast to the terms "best practices" and "what works," evidence-based practice implies that: 1) there is a definable outcome(s); 2) it is measurable; and 3) it is defined according to practical realities (recidivism, victim satisfaction, etc.). Thus, while these three terms are often used interchangeably, EBP is more appropriate for outcome-focused human service disciplines.

1.1.3 Cognitive behavioral interventions (CBIs) are based on the simple principle that thinking (an internal behavior) controls overt actions (external behavior). Therefore, through CBI programs (or curricula), clients learn new ways of thinking that can lead to changes in their behavior and actions, and ultimately affect their criminal conduct. CBI programs use a combination of approaches to increase a client’s awareness of self and others. This awareness is coupled with the teaching of social skills to assist the client with intrapersonal and interpersonal problems. In other words, these specific types of intervention programs assist clients in restructuring their thought processes, disrupt criminogenic beliefs, and teach cognitive disputation skills to assist in basic decision-making and problem solving.

1.1.4 As shown in Attachment J-1, Evidence-Based Practices Training Phases Implemented in CSOSA, CSOSA staff have participated in numerous EBP/CBI trainings and refresher trainings, both with internal and external trainers. CSOSA is confident that its staff has a solid understanding and foundation in EBP/CBI ideas and concepts. However, CSOSA’s management and line staff have changed over time, and they have varying skill levels of EBP and CBI. In addition, CSOSA’s supervisors have not been specifically trained and coached in the application of EBP/CBI with clients and on how to coach their staff. CSOSA’s supervisors need hands on training and coaching on how to coach, mentor, model, measure, and apply EBP/CBI with their staff so that they, in turn, can apply it with their clients. In addition, CSOSA needs the ability to maintain fidelity to EBP/CBI and would like a plan with recommendations developed to create an internal continuous quality improvement program. CSOSA also would like to create the internal capacity to train staff in EBP/CBI moving forward by receiving EBP/CBI Training-of- Trainers (TOT) for Adjunct Trainers. Finally, CSOSA would like a pre-post training analysis conducted to measure the success of the training initiative.

1.2 Objectives: The primary purpose of this contract is to procure training curricula and training services that are customized for CSOSA from a contractor experienced in providing EBP/CBI training to community supervision staff. CSOSA would like an existing curricula that can be customized for CSOSA and which has been found through recent research to be effective in improving supervision outcomes with an urban minority population. Exercises, activities, and training materials should be relevant to CSOSA, its population, and its business practices.

Curricula and training on the following four courses is sought: EBP/CBI Overview for Leadership; EBP/CBI Training and Coaching for Supervisors; EBP/CBI Training for Line Staff;

and EBP/CBI Training-of-Trainers (TOT) for Adjunct Trainers. The contractor shall include all needed tools, materials, and instruments necessary to train staff in the courses. In addition, CSOSA requires a plan to be developed with recommendations on how CSOSA can create and operationalize a continuous quality improvement program within CSOSA for EBP/CBI. Finally, CSOSA wants the contractor to measure staff’s pre- and post-training knowledge base, and application of EBP/CBIs and improvements in their EBP/CBI skill sets, in order to measure the success of the training.

2.0 SCOPE

2.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, tools, materials, curricula (participants and facilitator manuals), PowerPoints, and other items and non-personal services necessary to complete the work as defined in this Statement of Work (SOW), except for those items specified as government furnished property and services. The contractor shall perform to the standards established in this SOW to assess and train supervision and treatment staff. Under this SOW, up to 194 employees will receive training. Of this number, up to 26 staff selected as adjunct trainers will participate in both the line staff training and TOT training, in addition to the training for supervisors. After the line staff training in the first class, the adjunct trainers will assist the contractor in the second and third line staff cohort trainings.

2.1.1 The target groups to be serviced under this contract include:

1. The Senior Executive Leadership Team (SELT),

2. Community Supervision Services (CSS) Associate Director’s (AD’s) Office,

3. Community Justice Programs (CJP) AD Office,

4. Office of Human Resources’ (OHR’s) AD’s Office, Training and Career, Development Center (TCDC),

5. CSS Branch Chiefs (BCs),

6. CSS Supervisory Community Supervision Officers (SCSOs),

7. CJP Treatment Supervisors,

8. Community Engagement and Achievement Center (CEAC) Supervisor,

9. Vocational Opportunities, Training, Education, and Employment (VOTEE)

Supervisor,

10. Victim Services Coordinator,

11. OHR-TCDC Trainers,

12. CJP Treatment Specialists,

13. CEAC Staff,

14. VOTEE Staff, and

15. Community Supervision Officers (CSOs).

2.1.2 The Contractor shall assume that personnel have various levels of EBP and CBI knowledge. However, courses should include a short basic EBP/CBI skills set review.

Nonetheless, the primary focus of the training should be on building skills and application of

EBP/CBI.

2.1.3 Services to be provided under this SOW include:

2.1.3.1 CURRICULUM IDENTIFICATION AND TRAINING

2.1.3.1.1 For CSOSA’s approval, the contractor will identify and recommend an EBP/CBI training program. The program to be implemented should be one that, based on EBP/CBI research to date, has been found to improve outcomes for clients on parole, supervised release, and probation in an urban environment. The contractor should include the rationale for the proposed EBP/CBI training program, clearly stating the pros (benefits) and cons (to include and associated costs), as well as the literature findings on the effectiveness of the proposed model in improving supervision outcomes for an urban minority population.

2.1.3.1.2 The curriculum should be customized for CSOSA’s business operations and focus on skills applications to include exercises and scenarios for urban clients that will improve supervision outcomes. Customization includes incorporating the CSOSA logo, hands on exercises, and CSOSA-specific materials. The contractor shall provide EBP/CBI trainings and all necessary materials, tools, and instruments, for the following courses:

2.1.3.1.2.1 EBP/CBI Overview for Leadership (1 day)

Principles of EBP/CBI, Importance of EBP/CBI for supervision and treatment program success, and

Role of leadership in successfully implementing, maintaining, and sustaining EBP/CBI principles and practices.

2.1.3.1.2.2 EBP/CBI Training and Coaching for Supervisors (3 days—Two days of training, followed up by one day for a coaching session)

EBP/CBI hands on skills training on EBP/CBI application, The role of the supervisor in successfully implementing EBP/CBI, Hands on training/coaching for supervisors for successful implementation of EBP/CBI with clients, and

Guidance for supervisors on how to assess staff’s utilization of these practices with their clients and to provide constructive feedback.

2.1.3.1.2.3 EBP/CBI Training for Line Staff (3 days)

Brief overview of EBP/CBI to include core correctional practices, motivational interviewing/coaching, and risk reduction skills and tools, Hands on skills application in identifying and addressing criminogenic needs, Building and managing effective case management supervision plans, and

Applying appropriate responses, including incentives, to address behaviors that impact criminogenic risk factors.

2.1.3.1.2.4 EBP/CBI Training-of-Trainers for Adjunct Trainers (3 days) Training for select supervisors, adjunct trainers, who will participate in the TOT training, Hands on experience in training line staff on EBP/CBI, Hands on experience in training supervisors on EBP/CBI and coaching, and

Constructive feedback for the adjunct trainers on their training delivery for both courses as they subsequently train the line staff and the supervisors under the vendor’s guidance.

2.1.3.2 CONTINUOUS QUALITY IMPROVEMENT PROGRAM

The contractor shall develop a Continuous Quality Improvement (CQI) program plan with recommendations:

Develop written recommendations for a Continuous Quality Improvement (CQI)

Program to maintain the fidelity of EBPs and CBI in the Agency post contract support.

The plan should include recommendations for CSOSA on how such a program could be structured organizationally within CSOSA, implemented (including timelines), and operated within CSOSA, given its organizational structure. The report should provide at least two different options for consideration and reference prior experience in developing CQI programs.

2.1.3.3 MEASURE TRAINING SUCCESS

To determine the success of the training, the contractor shall:

Develop a new, or customize existing off-the-shelf, pre- and post-training instruments to measure the success of the training in increasing staff’s knowledge base in and application of EBPs/CBI skills, Administer the pre- and post-training instrument to the training participants the same day that each individual course training starts, before training begins (pre-training instrument), and the same day each individual course training is completed (post-training instrument).

Analyze results, and Submit a written report summarizing the findings for each individual course taught, to include those where a course is taught more than once.

2.2 Provision of Training to Program Participants: The following table presents the estimated number of staff to be trained for each course. The total number of staff and number of staff targeted for training may fluctuate. Also, the number of sessions, days, and total number of days are projected with the numbers listed as an upper limit. The capacity for each course will be: up to 35 staff for the EBP/CBI Overview for Leadership; up to 25 staff per course for EBP/CBI Training and Coaching for Supervisors and the EBP/CBI Training for Line Staff; and up to 15 staff per EBP/CBI Training-of-Trainers (TOT) for Adjunct Trainers course.

2.2.1 The TOT adjunct staff will be selected by CSOSA, in consultation with the contractor, from the supervisors who attend the EBP/CBI Training and Coaching for Supervisors course.

The TOT adjunct trainers (selected supervisors) are to be trained on how to effectively deliver the EBP/CBI Training and Coaching for Supervisors course and the EBP/CBI Training for Line Staff course. After completing the TOT course, the adjunct trainers will co-facilitate the supervisory and line staff training courses with the Contractor and the contractor shall provide constructive feedback and coaching on how the adjunct trainers delivered the content.

3.0 REQUIREMENTS

3.1 Pre-Training Informational Kickoff Meeting:

The contractor shall participate in a pre-training informational kickoff meeting scheduled by CSOSA to review the contract goals and objectives and to ensure that the training is based upon CSOSA’s mission, business practices, and systems. Additionally, the Contractor and

CSOSA will discuss the customization required (hands on exercises, CSOSA-specific materials, etc.) required for training course customization. This kickoff meeting will take place no later than ten (10) business days of contract award. CSOSA has extensive information on its website about CSOSA’s mission, organizational structure, policies and practices.

3.2 Training Plan: No later than 30 calendar days of contract award, the contractor shall develop a proposed training plan that defines how the contractor proposes to conduct the CSOSA training and ensure that a high quality training program is delivered. The proposed training plan shall include a proposed timeline for the overall project and scheduling of the training courses, performance objectives, associated instructional strategies, proposed materials and assessment tools, learning formats to include experiential learning opportunities to be employed for each course, and include a discussion of the quality control measures that the contractor will implement to ensure that a high quality training program is delivered. The contractor should provide an approach to ensure that all of the trainings requested will take place within the one year period of performance.

3.2.1 Training Curricula: No later than 30 calendar days of the proposed start date for each course, the contractor shall provide and submit to the Contracting Officer’s Representative (COR) for review and approval an EBP/CBI training curricula for each training course that is: state-of-the art; skills application-based, including hands on training and role playing; has experiential learning opportunities; uses exercises and scenarios that are realistic and specialized to CSOSA’s operations and clientele; and has been customized for CSOSA through the use of CSOSA logos and CSOSA-specific exercises. Each course shall include a facilitator and participant guide, performance goals and objectives, associated instructional strategies, materials, CSOSA-client relevant examples and scenarios, skills building exercises and applications, and PowerPoint presentation slides. The contractor shall use various visual aides to present the training, including the incorporation of PowerPoint, videos, or similar presentation media. The training format should include a description of how the learning opportunities connect to the training’s goal(s) and objective(s).The training experience shall include opportunities for experiential, as well as theoretical learning, exposing the participants to skills that can be immediately practiced, developed, and applied over time, for use with employees and clients. The contractor also shall incorporate adult learning theories, by accommodating for different learning styles, by using various instructional strategies, such as group work, practice exercises, modeling, and other interactive instruction whenever possible to enhance transfer of knowledge and skills.

3.3 Training Materials and Tools: The contractor shall provide all training materials for each participant to include participant guides, facilitator guides, PowerPoints, tools, and documents.

The contractor shall provide all kits, tools, guides, manuals, etc., necessary to implement the strategies included in the training (e.g., guides for addressing criminogenic needs, criminogenic skill practice tools, tools to address skill deficits, tools to supervise EBP/CBI implementation and efforts). All materials should be available in hard-copy and electronic formats. The contractor shall deliver draft copies of all materials and tools for each training curricula to the COR for review and approval at the same time that the training curricula for each course is submitted, which is no later than 30 calendar days of the proposed start date for each course .

The COR will review and return the training curricula, materials, and tools within 10 calendar days. Final materials and tools are to be delivered at least 15 calendar days prior to the start of training and are subject to the final approval of the COR. Hard copies should be supplied for all participants.

3.4 Provide Training: The contractor shall provide the approved training as specified under

2.1.3.1.2. Under this SOW, the contractor shall train CSOSA’s leadership staff, all of its managers, and a portion of its line staff. In addition, up to 26 managers will participate in TOT training and have the opportunity to train line staff in concert with the contractor. The Contractor shall use instructors whose resumes demonstrate the relevant qualifications, knowledge, and experience in the field of Evidence Based Practices (EBP)/Cognitive Behavioral Interventions (CBI). Each instructor should have a combination of at least five (5) years’ experience working in and/or training on EBP/CBI in a community corrections and/or correctional setting. Training instructors who have recent training experience (within the past two (2) years) and who have a masters’ degree or higher are preferred. The number of instructors proposed by the contractor is sufficient and qualified to provide and deliver high quality training within the one year period of performance. Personnel proposed by the contractor are subject to CSOSA approval.

3.5 Recommendations for a Continuous Quality Improvement (CQI) Program: Within 180 calendar days of contract award, the contractor shall submit to the Government a written report with recommendations for the creation of a Continuous Quality Improvement (CQI) Program within CSOSA to maintain the fidelity of EBPs and CBI. This report should include recommendations on how a CQI program could be structured organizationally within CSOSA, implemented (including timelines), and operated within CSOSA, given its organizational structure. The report should provide at least two different options for consideration.

3.6 Measuring Training Success: For all courses, the contractor shall develop and administer a pre- and post-training tool (instrument) that will evaluate the effectiveness of the training provided by the contractor in meeting the training objectives. The contractor shall provide the proposed tools to the COR for review and approval at the time that the training curricula for each individual course are delivered. The contractor shall administer the pre- and post-training instrument to the training participants the same day that each individual course training starts, before training begins (pre-training instrument), and the same day each individual course training is completed (post-training instrument). The contractor shall analyze the data and develop and submit a written report summarizing the findings for each course taught, to include those where a course is taught more than once. The report is to include recommendations to address any noted deficiencies or unsatisfactory ratings related to the provision of the training, as well as include recommendations to improve the training content and delivery within 45 calendar days of the final training class.

3.7 Status Meetings: The Contractor shall participate in status meetings at least every 90 calendar days in person and/or via teleconference to review results of participant surveys and propose improvements for moving forward. In between meetings, the Contractor is expected to be reachable during the contract period and shall respond to phone calls and/or emails from the Government as soon as possible but no later than two business days.

3.8 Quarterly Written Status Reports: Every 90 calendar days following award, the Contractor shall provide quarterly written status reports to detail progress made toward fulfilling the requirements addressed in the SOW in accordance with this Section 3.0. If deemed necessary by the Government, this report will be followed up by formal discussion of contractor progress.

3.9 Final Closeout Written Report: Within 45 calendar days after the last training class, the Contractor will submit a written report on the contract’s goals, objectives, and deliverables attained; recommendations from the CQI and measuring success reports; an overall summary of the effectiveness of the training program implementation; and next steps for CSOSA.

3.10 Project Management: The Contractor shall utilize a Principal Investigator/ Project Manager whose resume reflects the qualifications, skills, and experience necessary to effectively and efficiently manage the contract and contractual staff in order to meet CSOSA’s stated project goals and objectives.

Section D - Packaging and Marking

D.1. General Instructions

D.1.1 Preservation and packaging of all shipments or mailing of all work delivered under this contract shall be done in accordance with good commercial practices and to insure acceptance by common carrier (if applicable) and safe transportation at the most economical rate(s).

D.1.2 Any deliverables required by this contract shall be submitted to the Contracting Officer’s Representative (COR). Due to security concerns, deliverables transmitted via regular U.S. Mail experience significant delay in reaching an intended destination and, as part of the screening process, may be damaged. For these reasons, the U.S. Mail should not be used to transmit deliverables. Rather, the Contractor is encouraged to use electronic mail to the maximum extent possible, except for course materials required for each class attendee.

D.2. Deliverables

Deliverables provided electronically shall be formatted with read/write capability using Microsoft WORD 2010 format, or other than text files any other application compatible with software included Microsoft Office Suite applications. Font type of Times New Roman with a font size of 12 shall be used throughout the document. The Contractor shall minimize additional formatting as much as possible (e.g. avoid use of columns). Avoid using any design/layout elements.

E.2 Inspection and Acceptance

Inspection and acceptance will be performed at the CSOSA, 633 Indiana Avenue, NW, Washington, DC 20004. Acceptance of all deliverables will be in accordance with FAR 52.212- 4(a) and contingent upon COR review and approval. Unless valid justification is cited to the contrary, the Government’s recommended modifications will be incorporated into the respective final documents. If the Government’s comments do not conform to standard business practices, or are deemed technically unsound, it is the responsibility of the Contractor to advise the Contracting Officer (CO). Consensus is required between the Government and the Contractor;

however if consensus is not achieved, actions will be as directed by the CO.

SECTION F – Deliveries or Performance

F.1 Period of Performance

The government contemplates an overall period of performance of twelve (12) months structured as follows:

F.2 Place of Performance

The contractor shall perform all work identified in this contract, other than the work to conduct the training courses, at the Contractor’s facility. The Contractor shall conduct training courses at any CSOSA location (within the Washington D.C. metro area) identified by the COR. The Contractor shall request the COR to provide the specific training location when the Contractor is ready to schedule training.

SECTION G – Contract Administration Data

G.1 Contracting Officer’s Representative (COR)

G.1.1 The COR for this contract is:

G.1.2 The COR is responsible for the technical aspects of the contract and serves as the liaison with the contractor. The COR is responsible for the final inspection and acceptance of all deliverables and such other responsibilities as may be specified in the contract.

G.1.4 The COR is not authorized to make any commitments or otherwise obligate the Government or authorize any changes which affect the contract price, terms or conditions. Any contractor request for changes shall be referred to the Contracting Officer directly or through the COR. No such changes shall be made without the express written prior authorization of the Contacting Officer.

G.2 Contracting Officer (CO)

G.2.1 The CO is the only person authorized to approve changes to any of the terms and conditions of this contract. In the event the contractor effects any changes at the direction of any person other than the CO, the changes will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof. The CO shall be the only individual authorized to accept nonconforming work, waive any requirement of the contract, or to modify any term or condition of the contract. The CO is the only individual who can legally obligate government funds. No cost chargeable to the proposed contract can be incurred before receipt of a fully executed contract, which includes any subsequent contract modifications or other specific written authorization from the CO.

G.2.2 The contractor shall not comply with any order, direction or request of government personnel unless it is issued in writing and signed by the CO, or is pursuant to specific authority otherwise included as a part of this contract. No order, statement, or conduct of government personnel, other than the CO, who visit the contractor’s facilities or in any other manner communicate with contractor personnel during the performance of this contract shall constitute a change under the Changes clause of this contract.

G.3. Submission of Invoices

G.3.1 Invoices shall be submitted on a timely basis upon the completion of all services or the delivery of all items required by the contract. For contracts requiring services or the delivery of items over several months, the contractor shall invoice on a monthly basis.

Invoices sent electronically to ANY OTHER LOCATION than Invoices.mailbox@csosa.gov are not considered officially received by the CSOSA until actually received and date stamped by that mailbox.

G.3.3 The following information must be contained on the invoice:

1. Contractor Tax Identification Number.

2. Contractor Mailing Address.

3. Contractor Phone Number.

4. Date of Invoice.

5. Contractor Invoice Number (unique).

6. CSOSA Contract Number.

7. CSOSA Contract Line Item Number (CLIN) and, if applicable, sub-CLIN.

8. Description of services performed for or merchandise provided to CSOSA.

9. Detailed list of date(s) and hour(s) of services performed or merchandise provided to CSOSA.

G.3.4 The invoice must identify the specific Contract Line Item Number (CLIN) for which the contractor is seeking payment under the contract. If the invoice covers multiple CLINs, the invoice must identify specific amounts and activity applicable to each.

G.3.5 CSOSA is bound by the Prompt Payment Act (5 CFR Part 1315) to reimburse contractors on the 30th calendar day after a proper and valid invoice is officially received by the Agency. Invoices submitted without required information are not considered proper. If the invoice is disputed / rejected by CSOSA, the CO appointed to the contract will notify the contractor in writing of the dispute within seven (7) days of the CSOSA invoice official receipt date (the received date stamped on the invoice by the CSOSA Office of Financial Management (OFM)). The CO’s dispute / rejection notification will identify the specific invoice items and amounts being disputed, reason the items or amounts are disputed, a reference to the specific terms of the contract which supports the government’s dispute and a request for an immediate explanation and / or corrected invoice. Properly disputed invoice amounts are not subject to late payment interest computations during the period of dispute.

Per FAR Part 32 the CO has the final authority to approve payment of an invoice.

G.3.6 Contractor inquiries concerning an invoice payment may be made to OFM thirty (30) calendar days after a proper invoice has been submitted. The contractor may make payment inquires to Invoices.mailbox@csosa.gov or by calling OFM, Ms. Rolanda White, at 202-220- 5464 or emailing OFM at rolanda.white@csosa.gov .

G.3.7 Contractors must inform CSOSA of any changes in banking information using the Invoicing email address: Invoices.mailbox@csosa.gov

Section H - Special Contract Requirements

H.1 Hours of Operation

CSOSA hours of operation are 7:00 a.m. to 6:00 p.m., Monday through Friday, except federal holidays. The Contractor shall coordinate work at CSOSA facilities with the COR. The Contractor shall not perform work at CSOSA facilities on federal holidays or other non-business days without prior approval of the COR. Work to be performed at CSOSA facilities must be accomplished within the CSOSA hours of operation identified above. Any work at the CSOSA facilities outside the above identified hours of operation is not authorized unless written approval is provided by the COR.

H.2 Observance of Legal Holidays and Excused Absence

H.2.1 Legal Holidays.

H.2.1.1 CSOSA personnel observe the following days as holidays:

(1) New Year's Day (6) Labor Day

(2) Martin Luther King's Birthday (7) Columbus Day

(3) President’s Day (8) Veterans' Day

(4) Memorial Day (9) Thanksgiving Day

(5) Independence Day (10) Christmas Day

H.2.1.2. If a holiday falls on Sunday, the following Monday will be observed as the legal holiday.

H.2.1.3 When a holiday falls on a Saturday, the preceding Friday is observed as a legal holiday by U.S. Government agencies.

H.2.2 In addition to the days designated as holidays, CSOSA observes the following days:

(1) Any other day designated by Federal Statute

(2) Any other day designated by Executive Order

(3) Any other day designated by the President’s Proclamation

H.2.3 It is understood and agreed between CSOSA and the Contractor that observance of such days by CSOSA personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation except as set forth within the contract. No work is authorized to be performed by the Contractor on any legal holiday or other day as designated by paragraph H.2.2 above.

H.3 Unforeseen Closures, Work Stoppage and CSOSA Closures

Uncontrollable or unforeseeable circumstances such as, acts of God or the public enemy, acts of the Government in its sovereign or contractual capacity, fire, floods, epidemics, quarantine restrictions, inclement weather or special Federal or ceremonial events, may cause CSOSA to close. Under such circumstances, CSOSA will not pay for training not performed.

H.4 Confidentiality of Reports and Other Data

Neither the Contractor, nor any affiliate, subsidiary, consultant, subcontractor, nor personnel thereof, shall divulge to any third party any information concerning deliverables produced, work performed, results obtained, or any information provided by CSOSA in connection with this Contract without the prior written approval of the CO. The provisions of this clause shall survive the expiration of the Contract.

H.5 Review of Announcements or Publishing

Neither the Contractor, nor any affiliate, subsidiary, consultant, subcontractor, nor personnel thereof, shall make public releases of information or any matter pertaining to this Contract, including, but not limited to, advertising in any medium, or presentation before technical, scientific, or industry groups, without the prior written approval of the CO. The provisions of this clause shall survive the expiration of the Contract.

H.6 Proprietary Rights in Reports

All proprietary rights, including publication rights, in any work produced by the Contractor in connection with this contract shall vest in CSOSA. The Contractor shall not publish any of the results of the work provided for in the Contract without the prior written approval of the CO.

H.7 Access to Sensitive Information

H.7.1 Work under this Contract may involve access to sensitive information* which shall not be disclosed by the Contractor unless authorized by the CO. To protect sensitive information, the Contractor shall provide training to any Contractor employee authorized access to sensitive information and, upon request of CSOSA, provide information as to an individual’s suitability to have such authorization. Contractor employees found by CSOSA to be un-suitable or whose employment is deemed contrary to the public interest or inconsistent with the best interest of national security, may be prevented from performing work under the particular contract when requested by the CO.

H.7.2 The Contractor shall ensure that Contractor employees are citizens of the United States of America or an alien who has been lawfully admitted for permanent residence or employment (indicated by immigration status) as evidenced by investigations. The Contractor shall include the above requirements in any subcontract awarded involving access to CSOSA facilities, sensitive information, and/or resources.

*Sensitive Information is proprietary data or other information that, if subject to unauthorized access, modification, loss or misuse could adversely affect national interest, conduct of Federal programs, or privacy of individuals specified in the Privacy Act, but has not been specifically authorized to be kept secret in the interest of national defense or foreign policy under an Executive Order or Act of Congress.

H.8 Government Furnished Items and Services

H.8.1 CSOSA will provide training space and technological support to include a laptop, screens, and a LCD projector.

H.8.2 CSOSA will issue training attendance rosters for all training administered by the

Contractor. The Contractor shall ensure that each training participant signs in and out on the attendance rosters each day the training is offered. The Contractor must provide these completed attendance records to CSOSA, at the conclusion of each training session and not later than the next business day.

H.8.3 CSOSA will issue evaluation forms for all training administered by the Contractor. The

Contractor shall disseminate and collect CSOSA issued training evaluation forms to the training participants. The Contractor must provide the completed training evaluation forms to CSOSA at the conclusion of the training session.

H.9 Access to CSOSA Property or Facilities

The Contractor will be allowed limited access to CSOSA facilities, as necessary. In order to maintain a healthy and safe working environment for all employees, and to assist in preventing a pandemic for Contractor employees working at a CSOSA facility, CSOSA reserves the right to refuse a Contractor employee access to the CSOSA facility if the individual is displaying symptoms of a contagious illness, such as the flu. If such a situation arises, the COR shall communicate CSOSA’s decision regarding the employee to the Contractor.

H.10 Personnel Security

The Contractor agrees to adhere to all regulations prescribed by CSOSA in regards to the safety and security of staff and offenders/defendants. All Contractor personnel (employees and subcontractors) utilized under this contract shall submit to a CSOSA background check and if necessary, a background investigation prior to performing. The intent and purpose of the background check/ investigation is to preclude the assignment of any individual who poses a threat to CSOSA or successful work completion due to past unlawful or inappropriate behavior.

Contractor personnel must be U.S. citizens, or be lawfully permitted to reside in the United States and possess a valid work permit. The Contractor shall ensure that an individual does not begin work under this contract until the background checks are conducted and approved by the CSOSA Office of Security.

H.11 Background Checks

H.11.1 The CO will provide the Contractor point-of-contact with the security forms. Forms to be completed are:

CSOSA Security Form for Temporary Contractors (Form # CSOSA-SEC-0010) CSOSA Credit Release PIV Form (to be completed by CO if proximity card is needed. If an access card is not needed, this form is not required).

H.11.2 The CO will provide the completed security forms to the Office of Security to conduct the CSOSA background checks. Once the CSOSA background checks are conducted and approved, the Office of Security will issue security approval to/through the CO, who in turn will notify the Contractor and the COR. Only at that time may the Contractor notify an individual to begin work under this contract.

H.11.3 Once an individual has been granted security approval, they can begin work. The

Contractor must allow up to 30 days for the Office of Security to process the CSOSA background checks.

H.11.4 Derogatory information, falsification of any forms, or refusal to supply information and/or forms may be considered justification for immediate security denial/removal of the individual. CSOSA has the right to request any additional information necessary to complete the CSOSA background check. If Contractor personnel fail to provide any of the above information or cooperate with the CSOSA Office of Security, he/she will be disapproved/removed immediately.

H.12 Office of Personnel Management (OPM) Background Investigation

H.12.1 Contracts of 180 days or more must undergo a background investigation by OPM in addition to the CSOSA background checks. The Office of Security will provide the additional security forms required for initiation of the OPM background investigation. The Contractor will ensure that each individual assigned to this contract provides the following forms to the Office of Security:

SF-85P, Questionnaire for Public Trust Positions (web-accessible form- The Office of

Security will provide the link for individuals to complete this form electronically.)

OF 306, Declaration for Federal Employment FD 258, Fingerprint Cards

H.12.2 If an individual is terminated, reassigned, or for any other reason is no longer working on the contract, the Contractor shall ensure that all previously issued CSOSA equipment and material (including CSOSA identification card, if one has been issued) is retrieved from that individual and returned to the CO immediately. The Contractor must notify the CO immediately when an individual is no longer working on the contract. The CO must immediately notify the Office of Security and Office of Information Technology in writing so all electronic access can be promptly terminated. In addition, the Contractor shall coordinate with the CO or COR to identify a replacement if necessary. Replacements cannot start work until the Office of Security provides approval.

H.12.3 Both the CO and the COR shall ensure that all Contractor employees who provide services under the contract have been approved by the Office of Security.

H.12.4 Contractor personnel shall wear or display CSOSA issued identification at all times when performing work at a CSOSA facility. Contractor personnel shall not share or loan any CSOSA identification. All individuals assigned to this contract must report the loss or misplacement of agency identification immediately to the Office of Security.

H.12.5 Any individual who has been temporarily removed or reassigned may be required to undergo another CSOSA background check before resuming work.
