GENERAL DESCRIPTION:

Firm Fixed Price, Non-Personal Service Purchase Order for Solid Waste Disposal Services, at the Cheyenne River Health Center, Eagle Butte, SD.

Contractor shall perform in accordance with the PWS. The quoted “unit price” shall be an all-inclusive price.

This RFQ is issued as a 100% Small Business Set-Aside, with weighted preference given to IEE Set-Asides and the associated NAICS code is 562111 with a small business size standard of $38.5 million.

BASIS FOR AWARD:

The basis for award will be based on "Best Value" with trade-offs that takes in consideration the evaluation factors listed below. Therefore, in addition to price the government will consider the evaluation factors in determining the successful quote that represent best value to the government. Under best value principles, there is no requirement that a contract be awarded on the basis of lowest price. Offeror is to bid on the Base Year and each Option Year. IHS reserves the right to make a single award or multiple awards, whichever is most advantageous to the Government. This is a competitive solicitation and the offer your firm submits will be used by the Indian Health Service to determine, which offer is the "Best Value" to the government.

Evaluation Criteria No. 1) PAST PERFORMANCE

The Past Performance evaluation factor will assess the relevance and breadth of the offeror's experience and the quality of the offeror's past performance on contracts consistent in scope and complexity with Solid Waste Management(s) Services at the Cheyenne River Health Center, in Eagle Butte, South Dakota.

The offeror must demonstrate its record of successful performance in past contracts and subcontracts, Government and/or commercial. Each offeror will be evaluated on its performance under existing and prior contracts and subcontracts for similar services. The offeror shall fill out the past performance questionnaire and/or include the information in there proposal.

Evaluation Criteria No. 2) MANAGEMENT/ABILITY TO MEET PWS

Evaluation of this criteria will assess the offeror's overall understanding of the complexities and logistical requirements associated with the provision of Solid Waste Management Services at the Cheyenne River Health Center, in Eagle Butte, South Dakota and the offeror's ability to successfully manage such project. This criteria will be based upon the offeror adequately addressing each of the following elements and including sufficiently detailed information to allow a complete analysis of the offeror's technical capabilities and responsibility:

A. Provide the name, location, and proof of EPA certification of the Municipal Solid Waste Landfill(s) (MSWLs), in which the refuse will be disposed of. Proof of subcontracting plan if the MSWL is a subsidiary of the submitting party.

C. Proof of ability to provide appropriate equipment, personnel, and management, to handle all technical requirements provided in the PWS.

D. The proposal submitted should clearly show how the aspects of the PWS is to be accomplished. The technical approach should be in as much detail necessary to fully explain the proposal technical approach or methodology. Particular attention should be directed toward the scheduling of manpower and approach overcome any unforeseen circumstances (including but not limited to blizzards, equipment breakdowns, personnel issues, inclement weather).

E. The proposal indicates how documentation will be handled in compliance with the PWS.

Evaluation Criteria No. 3) Personnel

The Offeror shall submit resumes for all Key Personnel to be utilized in the performance of these requirements.

The contractor is to determine and provide a list of key personnel and their proposed role leading significant areas of operation. Offeror shall clearly state which requirements section that the individual being proposed would work in. Also, the Offeror shall certify that the information on each key personnel submitted is true and complete. Resumes of personnel directly involved in providing services under the contract shall be included in the proposal. The Cheyenne River Health Center requests the following:

ADJECTIVAL RATINGS

The Technical Evaluation Team will identify strengths, weaknesses, and deficiencies.

Since factors are listed in descending order of importance, as technical ratings and relative advantages and disadvantages become less distinct, difference in price between proposals are of increased importance in determining the most advantageous proposal. Conversely, as differences in price become less distinct, differences in rating and relative advantages and disadvantages between proposals are of increased importance to the determination.

The technical evaluation will be attained through a determination and analysis of strengths, weaknesses, and risks of each proposal. Technical risks will be included in the final evaluation of each factor and will not be evaluated as a separate factor. In the assessment of technical risk, the Government evaluators will consider all available information.

The following is an adjectival rating system that will be used to evaluate Offeror’s proposals:

proposal needs major revisions; very low probability of success.

1. RESPONSIBILITY

To be eligible for an award, an Offeror must be determined responsible in accordance with the standards in FAR Part 9.104.

2. PRICE EVALUATION

The price proposal shall be evaluated to determine the Offeror's ability to carry out its proposed technical approach and indicate that the Offeror understands the nature and extent of the work to be performed. The total price of each contract line item shall be added together to arrive at an overall total. The total of all options years shall be added together to arrive at an overall evaluated total, which will be evaluated for overall reasonableness of price. Offerors must include the formulas and factors used in calculation of the data.

AWARD WITHOUT DISCUSSIONS & COMPETITIVE RANGE DETERMINATIONS

The Government intends to evaluate proposals and award a contract without discussions with Offerors (except for clarifications as described in FAR 15.306(a)). Therefore, the Offeror's initial proposal should contain the Offeror's best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event discussions are held, a competitive range determination will be made. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

Questions in regards to this solicitation shall be submitted in writing by email to (Paige.Kerstiens@ihs.gov). The last day to submit questions is July 1, 2021, 1:00pm, MST.

ACCEPTANCE PERIOD: Your quote must stipulate that it is predicated upon all the terms and conditions of this Solicitation. In addition, it must contain a statement to the effect that it is firm for a period of at least 60 days from the date of receipt by the Government.

SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR TO NOTIFY THE ACQUISITION

OFFICIAL IF THERE IS A CHANGE IN PROVIDER.

SECURITY CLEARANCE

Performance of this contract will require access by employees of the Contractor or its subcontractors to facilities or systems controlled by the Indian Health Service (I.H.S.). The Contractor is responsible for conducting security preclearance investigations in sufficient depth to ensure that each Contractor or subcontractor employee are favorable.

The Contractor, at his discretion, is responsible for completing investigations and background checks for all employees, including sub-contractors and their employees that perform work under this contract at the physical job site. The contractor is responsible for any and all actions of prime contractor and sub-contractor employees (at any tier) permitted access to the job site during the performance of work under this contract. The contractor is responsible to ensure all employees’ access is limited to authorized work zones.

The employees of the Contractor or its subcontractors, during their performance on-site will be accompanied by an IHS employee the entire time they are on-site.

The Contractor assumes responsibility for all damage or injury to persons or property occasioned through the use, maintenance, and operation of the Contractor’s vehicles or other equipment by, or the action of, the

Contractor or the Contractor’s employees and agents. The Contractor assumes responsibility for any and all damage and/or injury to persons or property resulting from any action of prime contractor and subcontractor employees (at any tier).

The Contractor, at the Contractor’s expense, shall maintain adequate public liability and property damage insurance during the continuance of this contract, insuring the Contractor against all claims for injury or damage.

The Contractor shall maintain Workers’ Compensation and other legally required insurance with respect to the Contractor’s own employees and agents.

The Government shall in no event be liable or responsible for damage or injury to any person or property occasioned through the use, maintenance, or operation of any vehicle or other equipment by, or the action of, the Contractor or the Contractor’s employees and agents in performing under this contract, and the Government shall be indemnified and held harmless against claims for damage or injury in such cases.

In accordance with Indian Health Service Circular No. 19-05, that all Indian Health Service (IHS) health care providers, including (but not limited to) employees, volunteers, and CONTRACTORS shall review, Chapter 20

– Protecting Children from Sexual Abuse by Health Care Providers (Policy can be found at https://www.ihs.gov/ihm/pc/part-3/p3c20/) and review the training titled, “Child Sexual Abuse Briefing-IHS June 2019 (Training slides are available at Orientation or Contact the Contacting Officer).

Quotation must set forth full, accurate, and complete information as required by this Solicitation, Offer and Award form, and be returned no later than the date referenced in Block #9 of the SF-33.

PERFORMANCE WORK STATEMENT

SOLID WASTE MANAGEMENT SERVICES CONTRACT

INDIAN HEALTH SERVICE

CHEYENNE RIVER HEALTH CENTER

1. Introduction

This specification defines requirements for developing contracts for solid waste management services to serve Indian Health Service (IHS) medical facilities and housing quarters. The

Cheyenne River Health Center currently has a contract for the disposal of solid waste. The contractor will be responsible for utilizing a compliant landfill or disposal method during this requirement.

2. Compliance

A. Disposal at Municipal Solid Waste Landfills: Documentation must be provided to prove that all solid waste collected from Cheyenne River Health Center was properly disposed of at a municipal solid waste landfills (MSWLFs). All MSWLFs must comply with the federal regulations in 40 CFR Part 258 (Subtitle D of RCRA), or equivalent state or

Tribal regulations. Federal MSWLF standards include but are not limited to:

1. Location restrictions ensure that landfills are built in suitable geological areas away from faults, wetlands, flood plains, or other restricted areas.

2. Liner requirements include a flexible membrane (geomembrane) overlaying two feet of compacted clay soil lining the bottom and sides of the landfill to protect groundwater and the underlying soil from leachate releases. Landfills utilizing EPA approved liner variances will be considered.

3. Leachate collection and removal systems constructed on top of the composite liner and removes leachate from the landfill for treatment and disposal.

4. Operating practices include compacting and covering waste daily with several inches of soil to help reduce odor; control litter, insects, and rodents; and protect public health.

5. Groundwater monitoring requirement requires testing groundwater wells to determine whether waste materials have escaped from the landfill.

6. Closure and post-closure care requirements include covering landfills and providing long-term care of closed landfills.

7. Corrective action provisions control and clean up landfill releases to achieve groundwater protection standards.

B. Storage and Collection of Residential, Commercial, and Institutional Solid Waste: All storage and collection activities must comply with the federal regulations and guidelines in 40 CFR Part 243 (Subtitle D of RCRA), or equivalent state or Tribal regulations.

Standards must include but are not limited to:

Section C-H

1. Storage:

(a) All solid wastes shall be stored in such a manner that they do not constitute a fire, health, or safety hazard or provide food or harborage for vectors, and shall be contained or bundled so as not to result in spillage.

(b) All solid waste containing food wastes shall be securely stored in covered or closed containers which are nonabsorbent, leak-proof, durable, easily cleanable (if reusable), and designed for safe handling.

(c) Containers shall be of adequate size and in sufficient numbers to contain all food wastes, rubbish, and ashes that a residence or other establishment generates in the period between collections. Containers shall be maintained in a clean condition so that they do not constitute a nuisance, and to retard the harborage, feeding, and breeding of vectors.

(d) When serviced, storage containers should be emptied of all solid waste.

2. Operations:

(a) All solid waste collection personnel should receive instructions and training in safe container and waste handling techniques and the proper operation of collection equipment.

(b) Collection employees, as appropriate, should use personal protective equipment such as gloves, safety glasses, respirators, and footwear. This equipment should meet the applicable provisions of the Occupational Safety and Health

Administration Standards for Subpart I-- Personal Protective Equipment (29 CFR

1910.132 through 1910.137).

(c) Scavenging should be prohibited at all times to avoid injury and to prevent interference with collection operations.

(d) When conducting carry out collection, a leak-proof and puncture-proof carrying container should be used to minimize the potential for physical contact between the collector and the solid waste or the liquids which may derive from it.

3. Collection:

(a) Solid waste should not be allowed to remain in collection vehicles over 24 hours and should only be left in a vehicle overnight when this practice does not constitute a fire, health, or safety hazard.

(b) Solid wastes shall be collected with a frequency sufficient to inhibit the propagation or attraction of vectors and the creation of nuisances. Solid wastes which contain food wastes shall be collected a minimum of once each week.

(c) The collection of solid wastes shall be conducted in a safe, efficient manner, strictly obeying all applicable traffic and other laws. The collection vehicle operator shall be responsible for immediately cleaning up all spillage caused by his operations, for protecting private and public property from damage resulting from his operations, and for creating no undue disturbance of the peace and quiet in residential areas in and through which he operates.

Section C-H

(d) Records should be maintained detailing all costs (capital, operating, and maintenance) associated with the collection system. These records should be used for scheduling maintenance and replacement, budgeting, and system evaluation and comparison.

(e) The collection system should be reviewed on a regular schedule to assure that environmentally adequate, economical, and efficient service is maintained.

(f) Solid waste collection systems should be operated in a manner designed to minimize fuel consumption.

3. General Contract Specifications

A. Scope: The contractor shall provide all labor, equipment, supplies, materials, and incidentals, except as otherwise noted herein, necessary for the collection, transfer, and disposal of solid wastes from those areas listed for twelve (12) months for the base year with four (4) option year renewals from the date of the award.

B. Summary of Work: The work covered by these specifications consists of furnishing all necessary equipment, labor, supervision, and materials for performing all operations necessary for the collection, transportation, and disposal of all refuse specified in this contract, complete and in accordance with these specifications and subject to the terms and conditions of the contract.

1. The Cheyenne River Health Center currently has a stationary compactor with a 40

Cubic Yard (CY) dumpster configured for a hook truck.

2. The contractor shall return the Cheyenne River Health Center’s 40 CY bin prior to close of business (5 PM MST) the same date of pickup. The contractor shall be responsible for the loss or damage of government-furnished dumpster.

3. The housing unit locations shall require 133 containers, no less than 90 gallons each, provided by the contractor, and shall be serviced within the scope of the contract.

C. Location: This contract is to be performed in accordance with approved routes between the Cheyenne River Health Center and the respective landfills, including:

D. Performance of Work: Refuse collection and disposal will be conducted in conformity with applicable regulations to provide satisfactory protection of property and the environment. These regulations include but are not limited to the Resource Conservation and Recovery Act (RCRA), The Federal Facilities Compliance Act, 40 CFR Part 257

Classification of Solid Waste Disposal Facilities and Practices, and 40 CFR Part 258

Criteria for Municipal Solid Waste Landfills.

E. Supervision: The contractor will provide competent supervision at all times when work is in progress. The contractor is responsible for scheduling and coordinating various

Section C-H trade activities. The contractor is responsible for assuring that all work accomplished and materials used are in accordance with the specifications.

F. Government-Furnished Equipment:

1. The Government will provide One (1) 40 CY dumpster

G. Contractor-Furnished Equipment:

1. The contractor shall provide all necessary equipment required for performing the services under this contract.

2. The contractor shall provide 133 containers with lids, each of which are at least 90 gallons.

H. Applicable Publications, Laws, and Regulations: Unless specifically exempted by these specifications, all work accomplished under this contract will conform to the requirements of all applicable Federal, Tribal, state, and local regulations about environmental protection and occupational safety and health.

I. Inspection: All work performed, the methods and manner of performance, all areas assigned for use by the contractor, and all equipment, materials, and supplies used for the work, shall be subject to inspection at any times by the Contracting Officer’s authorized representatives. All notices of unsatisfactory conditions or services will be issued in writing to the contractor by the Contracting Officer.

J. Performance-Based Service Delivery Summary: The contractor’s performance will be measured based on the following Performance Requirements. The Performance

Requirements will be measured against Government Performance Standards and monitored in accordance with the following Methods of Government Surveillance or what is known as a Quality Assurance Surveillance Plan (QASP) to determine compliance.

K. Performance Evaluation: If the contractor fails to perform required services at the acceptable quality level, payment may be deducted by 5% until the contractor makes corrections. If the contractor fails to perform any required services, the COR will provide written notice of such to the Contracting Specialist and CCO and the contractor. The

Contracting Officer will issue the contractor a cure notice. The contractor shall have seven (7) calendar days to provide the Contracting Officer with their response to the cure notice. Upon evaluation of the contractor’s response to the cure notice for tasks surveilled, the contractor’s payment for the month in which the performance question occurred will be calculated as outlined above.

Section C-H

The COR is responsible for:

a. Monitoring the contractor’s technical progress;

b. Interpreting the statement of work;

c. Technical evaluation as required;

d. Technical inspections and acceptance required by this contract; and,

e. Assisting the contractor in the resolution of technical problems encountered during performance of this contract.

The contractor shall be paid a fixed-flat rate per month. No differential pay for government holidays, compensation time, and night differential. Price is an all-inclusive rate.

M. Quality Assurance Surveillance Plan (QASP): The purpose of the QASP is to provide a government developed system to assure the use of quality assurance methods in the administration of the performance based acquisition standards. The intent is to ensure that the contractor performs services for the Cheyenne River Health Center that are provided in accordance with performance requirements outlined in the contract documents, that the government receives the quality of services called for in the contract and that the government only pays for the acceptable level of services received.

The plan provides the basis for the COR to evaluate the quality of the contractor’s performance. The oversight provided for in the contract and this plan will help ensure that service levels reach and maintain the required levels throughout the contract term.

Further, this plan provides the COR with a proactive way to avoid unacceptable or deficient performance and provides verifiable input for the required past performance evaluations.

N. Collection of Waste:

1. Points of collection: The points of collection for pickup of waste by the contractor will be as shown on the attached maps. Any increase or decrease in the number of points may be a cause for adjusting the contract cost.

3. Schedule of Operations: The contractor will establish a schedule of proposed operations. This schedule will govern the days and time of day collections will be made. The schedule will be subject to change, provided the proposed schedule contributes toward a more satisfactory service for the government. The schedule and any changes thereof must meet the Contracting Officer’s approval.

4. Non-Compliant Waste: The contractor is required to notify the COR immediately upon identification of non-compliant waste, including but not limited to, hazardous materials, furniture, appliance, etc. If the contractor fails to notify the Government before disposal of non-compliant waste, the contractor cannot invoice for any additional costs incurred.

5. Hours of Operation: The contractor shall confine his operations to daylight hours commencing not earlier than 7:00 am and continuing no later than 7:00 pm unless otherwise approved by the Contracting Officer.

O. Transportation: All waste shall be transported from the collection point to the disposal area in closed packer-type bodies mounted on suitable trucks approved for hauling waste.

Transportation equipment shall be in an acceptable sanitary condition. Transportation equipment shall not exceed maximum weight limit restrictions.

P. Containers:

1. Containers provided by the contractor shall be consistent with the best practices of the industry and compatible with the contractor’s collection equipment.

2. Each collection station and the adjacent area shall be left free of loose waste at the end of each regularly scheduled collection. Waste placed at the collection station in sacks, cartons, cans, or boxes shall be removed by the contractor in the same manner and time as if it were placed in the regularly provided containers.

3. Containers which, in the opinion of the contracting office become unserviceable shall be replaced with new or serviceable units.

4. The contractor shall thoroughly clean and wash all containers and lids as necessary to maintain sanitary conditions. At a minimum, biannual sanitizing to control odor and infestation risks shall be performed on all waste receptacles. The contractor uses water located at the Hospital to clean containers as long as the area is left free of debris, waste, or odors. The contractor must obtain permission with at least 24 hours’ notice to ensure loading dock operations are not hampered. A tag must be affixed onto the container with the date of the last cleaning or a similar method to track compliance will be proposed by contractor.

Q. Vehicles: Only trucks specially designed for collecting waste and of the type approved by the Contracting Officer will be used. The cost of maintenance and repair of the contractor-owned vehicles will be the sole responsibility of the contractor.

R. Report Requirements: Documentation must be provided to prove that all solid waste collected from Cheyenne River Health Center was properly disposed at municipal solid

Section C-H waste landfills (MSWLFs). Documentation must detail transporter’s name, picked up location, total number of containers from the Good River Community, total number of dumpster(s) from the Cheyenne River Health Center Lower Level, signature from designated CRHC employee, signature of transporter, dates picked up, dates disposed of, and ultimate destination of refuse disposal. All documentation must be submitted by the

5th business day of every month. Documentation may be in the form of an approved bill of lading procedure with tipping fee receipts provided all required information is included.

S. Submittals:

1. The contractor shall include procedures and methods for garbage disposal, protection of affected adjacent areas, operating on occupied facilities, MSDS sheets for chemicals to be used for cleaning, and insect/rodent control.

2. Provide a comprehensive statement of the scope and purpose of the project.

Include a detailed description of the proposed work involved to accomplish the objectives of the statement of work. Include either by chart or narrative: reason for subcontracts; estimated time frames for equipment delivery; proposed collection schedule for each location; proposed receptacle maintenance schedule for cleaning; and explanation of how missed services will be addressed.

3. Provide the name, location, and proof of EPA certification for the landfill and alternate landfill to be used for disposal.

4. Include at least 3 references of past performance on similar projects. Include contact person name and title, company, address, phone number, and a brief description of service performed or product supplied. A signed, written reference on company letterhead is preferred. Written references should include contractor’s quality, workmanship, timeliness, professionalism, and overall performance rating

5. Include a listing of key personnel with job descriptions, work experience, and any certifications or licensures that they may possess. Also include contact information for key personnel.

6. The total contract price shall be itemized and include dumpster rental, dumpster maintenance, collection charges, disposal fees, TERO fees, and/or tipping fees.
