COMBINED SYNOPSIS/ SOLICITATION FOR COMMERCIAL ITEMS
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR
Subpart 12.6, and 13.5 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Proposals are requested and a written solicitation will not be issued.
This solicitation/synopsis reference number is FA5422-21-Q-0006 and is being issued as a Request for
Quote (RFQ).
This solicitation document and incorporated provisions and clauses are those in effect through Federal
Acquisition Circular 2021-04, Dated 19 Jan 2021.
Response to this combined synopsis/solicitation must be received via email by 24 June 21 no later than 12:00
HOURS AGADEZ LOCAL TIME. Requests should be marked with solicitation number FA5422-21-Q-0006.
This acquisition is unrestricted under NAICS code 333415, Air-Conditioning and Warm Air Heating Equipment and
Commercial and Industrial Refrigeration Equipment Manufacturing, with a size standard of $16.5M.
The delivery shall be 45 days after award of contract. FOB: Destination
Quote submission information: Quotes shall be e-mailed to william.washington@agdz.deployed.af.mil as the preferred method for offer submission. Your offer shall include a signed copy of the attached RFQ document or company equivalent with all of the requested information. Address questions by email no later than 17 June
2021 1800 HOURS AGADEZ LOCAL TIME.
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation provides the lowest priced quotation that is found to be technically acceptable.
Required items: This is a Brand Name requirement for the procurement of an Alaska Structures 5-Ton ECU (AK-
ECU-5T) in accordance with the below salient characteristics for use at AB 201 in Agadez, Niger.

3-Phase, 208/240V, 60 HZ, 16" Duct Diameter, 25' Duct Length, -25° F to 135° F Ext Temp
INFORMATION MUST BE DETAILED ENOUGH TO ALLOW THE GOVERNMENT TO MAKE A
TECHNICALLY ACCEPTABLE DETERMINATION.
Delivery: The delivery shall be 45 days after award of contract. FOB: Destination
TERMS AND CONDITIONS
Pricing: Prices are Firm-Fixed Priced based on the contractor’s pricing submitted in response to the RFQ.
Invoices: Invoices shall be submitted through Wide Area Work Flow (https://wawf.eb.mil), or they shall be submitted via email if payment via bank transfer or local currency. Invoices will be paid in U.S. Dollars or CFA depending on the payment method selected.
Payment: The contractor shall accept Electronic Payments, payments via Bank Transfer, or local currency payment.

The contractor shall indicate what payment method they prefer on the RFQ sheet.
Inspection and Acceptance: Acceptance of supplies shall be indicated by signature and date on the delivery ticket(s) after inspection of items and quantities has been performed.
Contract Administration: The contract will be administered by the 724 EABS/CONS, Air Base 201, Agadez, Niger.

52.212-2 Evaluation-Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further https://acquisition.gov/ action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. (a) The Contractor shall—
(1) Exercise due diligence to ensure that none of the funds, including supplies and services, received under this contract are provided directly or indirectly (including through subcontracts) to a person or entity who is actively opposing United States or Coalition forces involved in a contingency operation in which members of the Armed
Forces are actively engaged in hostilities;
(2) Check the list of prohibited/restricted sources in the System for Award Management at www.sam.gov
(i) Prior to subcontract award; and
(ii) At least on a monthly basis; and
(3) Terminate or void in whole or in part any subcontract with a person or entity listed in SAM as a prohibited or restricted source pursuant to subtitle E of Title VIII of the NDAA for FY 2015, unless the Contracting
Officer provides to the Contractor written approval of the Head of the Contracting Activity to continue the subcontract.
(b) The Head of the Contracting Activity has the authority to—
(1) Terminate this contract for default, in whole or in part, if the Head of the Contracting Activity determines in writing that the contractor failed to exercise due diligence as required by paragraph (a) of this clause;
or
(2)(i) Void this contract, in whole or in part, if the Head of the Contracting Activity determines in writing that any funds received under this contract have been provided directly or indirectly to a person or entity who is actively opposing United States or Coalition forces involved in a contingency operation in which members of the

(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area
WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and
Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training
Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data
Interchange, or File Transfer Protocol.

5352.201-9101 OMBUDSMAN (JUN 2016)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution.
