Request for Quotation 1242819 BayesiaLab or equivalent Software and Maintenance
Statement of Work-BayesiaLab (or equal) Page 1
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This synopsis is to notify contractors that the government intends to issue a Purchase Order in accordance with FAR Part 13 for the following, under simplified acquisition procedures. The Request for Proposal number is 75F40121Q00068.
Provisions and clauses in effect through Federal Acquisition Circular 2005-97 are incorporated into this request. It is the contractor's responsibility to be familiar with the applicable clauses and provisions. The provisions and clauses may be accessed in full text at www.acquisition.gov/far.
The NAICS code is 511210, Applications development and publishing, except on a custom basis.
All qualified vendors are encouraged to respond. The purpose of this procurement is to procure a software that is BRAND NAME OR EQUAL to Bayesialab for a twelve (12) month period.
Product shall support the U.S. Food and Drug Administration’s (FDA) Center for Tobacco Products (CTP). This requirement will allow models developed by CTP to be transferred to the World Wide Web for user-friendly public use.
The FDA requests proposal responses from qualified sources capable of meeting the requirements as outlined in the Statement of Work (SOW).

Software and Maintenance Services
1.0 Background
The primary function of the Food and Drug Administration (FDA) is to promote public health associated with the use of foods, dietary supplements, cosmetics, drugs, tobacco, and other products under its jurisdiction. FDA's Center for Tobacco Products (CTP) implements PL 111-31, the Family Smoking Prevention and Tobacco Control Act that was signed into law on June 22, 2009. The Tobacco Control Act grants FDA authority to regulate the manufacturing, marketing, and distribution of tobacco products to protect the public health.
• Several research projects being conducted by the Statistics Branch in the Office of Science (OS) of the Center for Tobacco Products (CTP) require access to software that allows the development and generation of structural network models through Bayesian Network Analysis. The software is required to estimate dependencies between variables in a system without distinguishing between dependent and independent variables. The software provides a comprehensive machine environment which allows integration of external code and interactive sharing of models and presentations with external researchers. The software allows models developed by CTP to be transferred to the World Wide Web for user-friendly public use.
1.1 Projects
This software will be used for the following future projects:
• Population health modeling for tobacco-related mortality and disease rates in the U.S.
population as a function of either population-level tobacco-use rates or networks between individuals
• Development of disease risk assessment models from toxicological data.
• Convert programs previously developed in BayesiaLab to SAS and R code to facilitate sharing with internal and external researchers.

2.0 Description of Product and Services
The contractor shall provide annual licenses for 2 BayesiaLab-Professional software licenses with continental token or equal, 2 BayesiaLab export licenses or equal, and 2 Bayesia Engine API Licenses or equal.
2.1 BayesiaLab – Professional (or equal)
The software shall perform the following functions
• The software shall allow the user to perform Bayesian Network Analysis by interactively specifying network dependencies using a Directed Acyclic Graph and examining the resulting local conditional probability distributions.
• The software shall allow for both user specified model dependences and identification of unspecified dependencies in the data using both probabilistic constraint-based Bayesian algorithms and scoring based algorithms to identify candidate networks.
• The software shall accommodate either discrete or continuous network nodes.
• The software shall allow interactive development of Dynamic Bayesian Networks for
Markov Chains to estimate transitional state change probabilities over time.
• The software shall allow the user to easily assess the effect of a particular intervention given the causal structure and dependencies within a user developed network.
• The software shall provide a variety of structured or unstructured learning algorithms to assess network dependencies.
• The software shall provide algorithms for the assessment of clustering of variables in order to develop structural equation models.
• The software shall allow the user to perform the above functions without having to perform additional statistical programming. The software license shall allow for multiple users on multiple machines.
• The software shall allow publication of Bayesian Networks developed by researchers at CTP to be published on Web, so that internet users can perform inference by entering their own input values.
• The license shall allow for the simultaneous use for at least two users on different machines in order to accommodate simultaneous use by both the Population Health Project and Risk Assessment Projects.
2.2 BayesiaLab Export (or equal)
• The software shall convert Markov Blankets developed within into SAS, R, and Java script in order to facilitate collaboration with outside researchers.

2.3 Bayesia Engine API (or equal)
• The software should allow outside research collaborators who are developing models for input parameters using other software to interface with models created by CTP researchers by specifying input parameters. .
2.4 Maintenance
Licenses shall include full technical support for correction of programming errors and maintenance services. Maintenance includes free revised or updated releases of the software and technical support for error correction services. Correction of programming errors shall be provided through e-mail or telephone contact. Licensor shall correct and resolve reported errors. The licensor shall communicate within 1-day for critical error and 3-days for non-critical errors. Critical errors are defined as those that are fatal or cause severe impact to the functionality of the software.
3.0 Deliverables
4.0 Inspection and Acceptance
FDA will load the software and licensing to verify that the media is functioning properly. The Government will inspect and verify that the software is operational, functional and compatible with FDA server and software. The Government will provide written notification of acceptance or rejection within 10 working days of receipt. The Contractor shall correct any deficiencies within thirty (30) days of when the Government issues the rejection notice. If the Contractor cannot correct the deficiencies within this time frame, the Contractor shall immediately notify the COR or technical POC of the reason for the delay and provide a proposed corrective action plan within ten (10) business days.

The contractor shall provide maintenance services for a period of twelve (12) months, 09/25/2019-09/24/2020.

7.0 Authorized Reseller/Services Agent
The Contractor shall be an authorized reseller and/or servicing agent of the software manufacturer while performing on this contract.
The Quoter shall notify the Contract Specialist/Contracting Officer immediately if this requirement is registered by a reseller with the Original Equipment Manufacturer (OEM)
8.0 Information Technology Investment Management/Master Approved Technology List
The item acquired may require approval by the Food and Drug Administration (FDA) Office of Information Management (OIM) for operation in FDA’s Information Technology environment (IT Investment Management Process/Master Approved Technologies List). (a) If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation.
(b) To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must—
(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;
(2) Clearly identify the item by—
(i) Brand name, if any; and
(ii) Make or model number;
(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer;
and
(4) Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification.
(c) The Contracting Officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The

12.0 Order of Precedence
The Contractor shall follow the terms and conditions of this order. Should the Contractor include any additional terms and conditions resulting in conflicts between this document and the Contractor’s document, the Order of Precedence shall be as specified in FAR Clauses 52.212-4, dated January 2017. Any governing law language appearing in any Contractor terms or conditions shall be treated as null, void, and stricken. Any additional terms and conditions identified with a web link and/or incorporated by reference shall be stricken and removed from this order. The Contractor shall provide all terms and conditions with their quotations as attachments, appendixes, etc.
13.0 Instruction to Quoters
All quotes shall be valid for 30 days.
Quoters are advised to provide their best prices in their quotation. The Government does not intend to have discussions to allow revision of quotations. The Government reserves the right to communicate with Quoters should the Government determine it is necessary for quotation revisions prior to award.
All Quoters providing quotations must clearly state the overall cost to the Government.
All quotes will be evaluated on a Lowest Priced Technically Acceptable (LPTA) basis. Quotes shall be firm fixed price and include all quantities listed. Failure to include a listed quantity may be deemed as technically unacceptable and as such not be considered for award.

Quoters shall submit one (1) copy of their quotation with pricing information. Equal to quotes must meet all the salient characteristics in order to be considered technically acceptable. If the part numbers are different from the vendors’ part numbers, Quoters shall map their part numbers to the vendors’ part numbers.
Equal to quotes must submit a separate Technical quote with a detailed point-by-point description of how the equal to products meet all the salient characteristics of this SOW.
Quotes with the specified BayesiaLab software and maintenance service meeting all the salient characteristics of this SOW are not required to submit separate Technical Quotes. Technical quotes shall not contain pricing information.
Quoters shall submit all applicable terms and conditions in full text as attachments, appendix, or exhibits. Quoters are advised that additional terms and conditions submitted with their quotations that are in conflict with the terms and conditions of this solicitation may be deemed as technically unacceptable and as such not be considered for award.
Quoters shall submit an Accessibility Conformance Report (ACR) in full text with their quotations. Failure to submit an ACR may render a quote technically unacceptable, and, as such, it may not be considered for award. Quoters shall submit all assumptions in their quotation.
The Quoter shall notify the Contract Specialist/Contracting Officer immediately if this requirement is registered by a reseller with the Original Equipment Manufacturer (OEM).
14.0 Award Determination
All quotations will be evaluated on a Lowest Priced Technically Acceptable (LPTA) basis. The award will be made to the lowest price Quoter that demonstrated that they can meet all the requirements of this solicitation. Failure to demonstrate meeting any of the requirements or instructions will result in a rating of technically unacceptable and will not be considered for award. Incomplete quotation will not be considered for award.
