This is a combined synopsis/solicitation for commercial items prepared in accordance with the Federal Acquisition Regulation (FAR) format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;

proposals are being requested and a written solicitation will not be issued. This requirement is being issued in conjunction with FAR Part 13 Simplified Acquisition Procedures and FAR 13.5 Simplified Procedures for Certain Commercial Items. The solicitation number is 1237756. This solicitation is issued as a Request for Quote (RFQ).

The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2021-03 February 16, 2021.

The associated North American Industry Classification System (NAICS) Code is-332999- All Other Miscellaneous Fabricated Metal Product Manufacturing; Small Business Size Standard is 750 employees. This RFQ is issued as a total small business set-aside.

BACKGROUND:

The Food and Drug Administration (FDA) and Center for Biologics Evaluation and Research (CBER) has a requirement for primate racks. CBER’s mission is to regulate biological products for human use under applicable federal laws, including the Public Health Service Act and the Federal Food, Drug and Cosmetic Act. CBER protects and advances the public health by ensuring the safety and efficacy of gene therapy and biological products that are available to those who need them. CBER also provides the public with information to promote the safe and appropriate use of biological products.

To support FDA’s overall mission, CBER’s Division of Veterinary Services (DVS), which is responsible for the support of all aspects of FDA White Oak Animal Program (WOC AP), ensures compliance with the Occupational Health and Safety Act (OSHA), the NIH Guide for the Care and Use of Animals and the Association for Assessment and Accreditation of Laboratory Animal Care International (AAALAC). DVS administers a comprehensive set of animal-related services, providing for the humane care and health of research animals. Routine services include animal procurement, quarantine, transportation and housing, provision of diet, water, and enrichment, daily observation of animals with reporting of abnormal health conditions, as well as sanitization of rooms, cages, racks, and other equipment

OBJECTIVE:

CBER/DVS has a requirement to purchase Primate Racks for the WO AP vivarium located in Silver Spring, Maryland. The racks will be used in support of the Food and Drug Administration (FDA) laboratory animal care and use program.

TECHNICAL SPECIFICATIONS:

In order to assure the DVS staff that the racks being procured will provide the same reliable functional capability of the existing Primate Racks it is crucial that these specifications be

Solicitation 1237756 1 of 39 followed with precision to maintain the necessary consistency and commonality of the racks needed in executing the day-to-day operation of the DVS mission.

Primate one over one rack (2 cages stacked one on top the other):

A. The wire mesh cages must consist of 1” sq. wire mesh, with ½ sq. inch mesh on shuttle doors.

B. All mesh must be reinforced with steel frames on the front doors, sides, bottom, top and sliding doors.

C. Front horizontal door must slide to the right (when facing rack) to open.

D. Racks must have shuttle doors on the sides of each top and bottom cage. Must be equipped with a lexan, solid 304 stainless steel and a ½ sq. inch wire mesh shuttle doors on the right side for social housing. Must have a solid 304 stainless-steel shuttle door and a lexan door on the left side of the cage.

E. Cages must have a 36-inch interior height.

F. Cages must have a 1-inch square wire mesh backing with automated watering devices attached.

G. Cages must be able to connect and lock together to provide double wide spacing for social housing, for moving animals from cage to cage for sanitation purposes, and to keep animals from escaping by separating the cages. Cages must be connected with locking devices.

H. Cages must have dual bar perch in each cage.

I. Cages must have a pedal lift brake mechanism to stabilize and lock in place.

J. Cages must have a feature that allows horizontal sliding door to be locked with a padlock and must have secondary spring-loaded lock to keep sliding door secure.

K. Racks must have a permanent foraging board on the front of each cage top and bottom above the front horizontal sliding doors. Foraging board must be firmly affixed to cage to avoid noise.

L. Cages must be dual purpose designed for flushing waste and must be able to accept waste pans for bedding that are fully removable.

M. Cages must be designed with removeable solid floors between top and bottom cage.

N. Cages must have removable feed cups, preferably a simple box design, no lexan, no lid, but tall enough to avoid reaching out.

O. Cages must include a balcony to be attached to front of each cage, covering horizontal sliding door opening. (This balcony allows animals access to see other animals housed on each side of cage)

P. Top and bottom cages must have bottle holders for 32oz bottles. 5/8" sipper tube opening on water botte holders.

Q. Cages must have minimum 6.0 square feet of floor space.

R. Casters 2 fixed in back and 2 swivel in front with high temp 4 inch phenolic wheels.

S. Horizontal sliding door must be at least 18 inches tall and 12 inches wide for the pass-through opening and be made with ½ sq. inch wire mesh reinforced with full frame.

T. Shuttle doors on sides of cages must be at least an opening of 13 inches wide by 23 inches tall, be made with ½ inch wire mesh and reinforced with full frame.

U. Cages must be built with NO GAPS around the perimeter of the cage interior, between frames, doors, dividers, or where rack comes together with mesh panels. This is to prevent animals getting their fingers or hands through cage gap openings and being trapped.

V. Rear rack bumpers on each rack to guard against damaging water lines and wall guards

W. Top cage of each rack must have wire floor that opens 50% to allow interior space to double.

X. Maximum rack height must be 87.5 inches including height of wheels.

Y. True prototype shall be shipped to CBER for acceptance of rack and design prior to manufacturing production units.

Z. Rack design and drawings are to be provided for evaluation prior to producing prototype rack.

Installation, Training and Additional System Requirements.

The contractor shall provide in-side delivery, installation/assembly if racks do not come assembled and operator familiarization training for the rack system. The contractor shall provide a minimum of one (1) day of on-site training (in addition to installation of the system) for up to six personnel to include operations, calibration, optimization, basic and routine preventative maintenance procedures and cleaning requirements.

Offered racks shall be a turn-key solution i.e. the contractor shall be responsible for providing all hardware and components otherwise required to meet these specifications and the FDA’s stated need. Racks shall be delivered with all necessary supplies and accessories required for installation and start-up.

Racks shall be warranted for not less than one (1) year from FDA acceptance of the equipment to include on-site training. Warranty service shall include trouble-shooting capabilities based on complete knowledge of the entire system, immediate access to replacement parts, and immediate access to system improvements and updates. Phone and email technical support shall be included for a minimum of 1-year.

The components and/or equipment shall be newly manufactured, not used, refurbished, or previously used for demonstration.

Offered systems shall be a turn-key solution i.e. the contractor shall be responsible for providing all hardware, components, instruments, computers, software, and that otherwise required to meet these specifications and the FDA’s stated need. The systems shall be delivered with all necessary supplies and accessories required for installation and start-up.

Period of Performance

FOB Point Destination. All items shall include shipping, handling, in-side delivery, assembly and training to the destination identified herein. Delivery/installation/training shall be completed within 120 calendar days after receipt of order. FOB Point of Delivery for Services and Supplies will be the FDA located at 10903 New Hampshire Avenue, Silver Spring, MD 20993.

Final Rack design/plans shall be available for FDA review 14 calendar days after award;

Prototype shall be delivered for review at FDA facility identified above within 21 calendar days after FDA approval of rack design/plans. The FDA shall review the true prototype within 21 calendar days after the Government receives the true prototype.

Delivery, installation/assembly and staff familiarization training for the production primate racks shall occur within the contractor’s normal manufacturing lead times for these items but shall be no more than 120 calendars days from date of award. Delivery for Option Item shall be within 120 calendar days from option exercise date.

The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option for one or more of the optional items identified in the schedule, at less than or more than the estimated quantities in the Schedule, by written notice to the Contractor within 365 calendar days of contract award. This option may be exercised more than once.

Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

The supplies and/or services delivered hereunder shall be inspected and accepted at destination by the COR specified at award. If the supplies or services are acceptable, the COR shall promptly forward a report of inspection and acceptance to the paying office. If the supplies or services are not acceptable, the COR shall document the nonconforming items/services and immediately notify the contracting officer.

The COR is responsible for:

(1) Monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements;

(2) Interpreting the statement of work and any other technical performance requirements;

(3) Performing technical evaluation as required;

(4) Performing technical inspections and acceptances required by this contract; and

(5) Assisting in the resolution of technical problems encountered during performance.

The Contracting Officer is the only person with authority to act as agent of the Government under this contract. Only the Contracting Officer has authority to:

(1) Direct or negotiate any changes in the statement of work;

(2) Modify or extend the period of performance;

(3) change the delivery schedule;

(4) Authorize reimbursement to the Contractor any costs incurred during the performance of this contract; or

(5) Otherwise change any terms and conditions of this contract.

Contractor Performance Evaluation (s)

In accordance with Federal Acquisition Regulation (FAR) 42.15, FDA will complete annual and final contractor performance evaluations. Annual evaluations will be prepared to coincide with the anniversary date of the contract. Additional interim performance evaluations may be prepared at the CO’s discretion, as necessary. Final performance evaluations will be completed upon contract expiration.

FDA will utilize the Contractor Performance Assessment Reporting System (CPARS) in order to execute annual and final contractor performance evaluations. CPARS is a secure Internet website located at https://www.cpars.gov/. FDA will register the contractor in CPARS upon receipt of the name and email address of two (2) individuals who will be responsible for serving as the Contractor’s primary and alternate CPARS contacts. Once FDA registers the contractor in

CPARS, the Contractor will receive an automated CPARS email message which contains User IDs and instructions for creating a password.

Once a performance evaluation is issued, the Contractor’s primary and alternate CPARS contact will receive an email instructing them to logon to CPARS in order to review the performance evaluation. The Contractor has 14 calendar days from the date of performance evaluation issuance in which to review the evaluation. If the Contractor is in agreement with the performance evaluation outcome, the evaluation becomes final. Should the Contractor be in disagreement with the performance evaluation outcome, rebuttal comments must be submitted via the CPARS within 14 days from date the evaluation was issued by FDA. Any disagreement between the CO and the Contractor will be referred to a contracting official one level above the CO, whose decision will be final.

Copies of each performance evaluation and contractor responses, if any, will be retained as part of the official contract file and will be used to support future award decisions. Evaluations will also be stored for a 3 year period (6 years for construction) in the CPARS System.

Contractors may obtain CPARS training material and register for on-line training at https://www.cpars.gov/webtrain.htm. There is no fee for registration or use of the CPARS system.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
