N10 - CONTRACTS AND BUSINESS MANAGEMENT DIRECTORATE
COMBINED SYNOPSIS/SOLICITATION
Military Sealift Command Combined Synopsis and Solicitation Notice Information
1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in
FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
2. Solicitation number is N32205-20-Q-3014 and is being issued as a Request for Quotes (RFQ).
Quotes are due by Wednesday, 05 August 2020 at 1:00pm Eastern Standard Time.
3. The solicitation document and incorporated provisions and clauses are those in effect through:

6. PERFORMANCE WORK STATEMENT (PWS)
1. BACKGROUND
Military Sealift Command (MSC) has an immediate requirement for scheduled use of a shooting range in the San
Diego area, suitable for the conduct of small arms training of Civilian Mariners (CIVMARs). Small Arms qualified
CIVMARS are necessary for the fulfillment of vessels’ competency matrix and manning requirements. Renewal of this training is required annually.
2. SCOPE
Due to current coronavirus disease 2019 (COVID-19) pandemic, the Government may anticipate the need to request additional shooting stations and/or range time to adhere to Centers for Disease Control and Prevention guidance concerning social distancing measures. If the need occurs, the government intends to modify the contract in accordance with FAR 52.212-4(c) to exercise the appropriate OPTION CLIN(s).
The Contractor shall provide the following items in support of MSC’s Small Arms Training program:
2.1. Shooting range, where MSC personnel are capable of shooting the weapons required to satisfy the practical training, demonstration and qualification portions of the Small Arms Training and Qualification process, as detailed in OPNAVINST 3591.1 (series).
2.1.1. MSC will provide the weapons, ammunition and instructional staff needed to conduct this training.
2.2. The range may be either an outdoor or indoor facility and must be in compliance with Naval Occupational
Safety and Health regulations, including requirements found in OPNAV 5100.23 series.
2.2.1. For indoor ranges, local exhaust ventilation is required and must be adequate to ensure that atmospheric levels of lead particulate do not exceed the Permissible Exposure Limit (PEL). The
Contractor’s management must allow periodic inspection, including lead monitoring, to ensure compliance with the regulations.
2.3. Vendor must provide services as per the schedule of classes specified in this Performance Work Statement
(PWS). Classes require three (3) range days.
2.4. The range should be constructed and configured in a way that allows students to shoot rifles in standing, kneeling and prone positions; draw & fire a pistol from a holster in both standing and kneeling positions;
and fire a shotgun from various shooting stations and locations (i.e. moving forward and/or laterally to engage targets from prepositioned barricades or other simulated sources of cover).
2.5. The range must be free of obstructions and capable of establishing clear lines of fire for all shooters at distances of 3, 7, 10, 15 and 25 yards. The range will have a minimum of eight (8) shooting lanes and adequate space behind shooters to facilitate the Range Safety Officer (RSO), line coaches and other instructional and safety personnel.
2.6. All classes will be limited to a maximum of 16 students. The minimum number of rounds per student are as follows:
2.6.1. Shotgun: 18 rounds (standard issue .00 buck shot)
2.6.2. Pistol: 100 rounds (standard issue 9mm ball)
2.6.3. Rifle: 90 rounds (standard issue 7.62mm and/or 5.56mm ball)
2.6.4. All: Additional rounds as necessary for practice, familiarization, sighting and remedial training.
2.7. The range will provide a Public Address (PA) speaker system. The PA may be permanently installed or portable, but must be capable of one-handed operation.
2.8. The range will provide potable water for instructors and students.
2.9. The range will provide bathroom facilities on site.
2.10. Contract spaces will be cleaned and subject to the satisfaction of the MSC instructor prior to each use.
Trash receptacles will be available for miscellaneous waste generated during training (i.e. used targets, cardboard ammunition boxes and spent shotgun shells).
2.11. MSC will be responsible for picking up and disposing of spent brass cartridges.
3. PLACE OF PERFORMANCE
The location of the range shall be within 15 driving miles of MSC’s Balboa Avenue Training Site (BATS), located at 9284 Balboa Avenue, San Diego, CA 92123.
4. REQUIREMENTS
4.1. The vendor shall provide services as follows:
4.1.1. Exclusive use of the range
4.1.2. Three days per scheduled class
4.1.3. Three consecutive hours per day
4.1.4. Earliest start time will be 0700 local time
4.1.5. Latest end time will be 1600 local time
4.1.6. Range days as per dates specified in the PWS
4.2. MSC reserves the right to conduct a site inspection prior to the awarding of this contract, which will be established at a time mutually agreeable to the parties involved.
4.3. Technical Points of Contact:

4.4. Contractor Responsibility for Safety. Nothing in this PWS, nor any Government action or failure to act in surveillance of this contract, shall relieve the Contractor of its responsibility for the safety of the Contractor’s personnel and property, the Government’s personnel and property, and the general public whether it is
Instructor Only support or turnkey. Furthermore, nothing in this PWS shall relieve the Contractor of its responsibility for complying with applicable Federal, State, and Local Laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.

6.2. Dates of classes for Option Years (FY2022, 2023, 2024, 2025) will be determined at least 30 days prior to start of renewal period, if applicable.
7. AUTHORIZED CHANGES BY THE CONTRACTING OFFICER
The Government may request training outside scheduled times or on non-standard workdays (i.e. Saturday or Sunday) to accommodate emergencies, student military commitments or operation requirements. If weekend training or training outside scheduled times is requested, the COR will coordinate with the Contractor with a minimum of 30 days’ notice. If changes in the schedule are required, they will be done via contract modification issued by an MSC warranted Contracting Officer.
Enterprise -Wide Contractor Manpower Reporting Application (ECMRA):
The Contractor shall report ALL Contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Military Sealift Command via a secure data collection site. Contracted services excluded from reporting are based on Product Service codes (PSCs).
The excluded PSCs are:

(4) D, Automatic data Processing and Telecommunications, IT and Telecom- Telecommunications

The Contractor is required to completely fill in all required data fields using the following web address:
https://doncmra.nmci.navy.mil.
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year
(FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at https://doncmra.nmci.navy.mil.

7. The Government anticipates a firm-fixed price (FFP) contract will result from this solicitation. The intent is to award a base year and four (4) option years (including COVID-19 Options), as shown in Paragraph 5 of the above
Performance Work Statement.
8. The provision at FAR 52.212-1, Instructions to Offerors – Commercial applies to this acquisition and is incorporated by reference. The provision is amended as follows:
52.212-1 (ADDENDUM) ADDITIONAL INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS
a. Any inconsistency between FAR Provision 52.212-1 and the Addendum to FAR 52.212-1 shall be solved by giving precedence to the Addendum to FAR 52.212-1.
b. After receipt of quotes the Government may, with or without notice, negotiate with and, if desired, seek quote revisions from as many or as few quoters as it, in its discretion, deems appropriate.
c. The term “offeror” or “offer” as used in FAR 52.212-1 shall be understood to mean “quoter” and
“quote,” respectively. Further, the term “award” shall be understood to describe the Government’s issuance of an order.
d. The Government will consider all quotes that are timely received and may consider late quotes.
Failure of a quote to address any items required in the submission package may make a quote unacceptable.
e. Paragraph (b) of FAR Provision 52.212-1, Submission of Offers, is amended as follows:
In addition to the quote submission requirements stated in FAR provision 52.212-1, quoters shall provide the following, as part of the quote submission package, no later than the required time and date for quote submission:
Responsible sources shall provide the following:
1. Price quote which identifies the requested item(s), unit price inclusive of shipping (if any), and extended price
2. Total Firm Fixed price
3. Any Discount Terms
4. Estimated time of delivery (for supply buys)
5. Technical Submission Requirements
a. For Parts/Supply buy, the quote shall contain a description including part number and title for each item listed in the solicitation to allow the Government to verify that the quoted parts match the requirements listed in the requirements schedule.
b. For a Services buy, the quote shall contain all pre-award submission/certification requirements as defined in the Performance Work Statement (PWS).
6. Responses to the solicitation are due by Wednesday, 05 August 2020 at 1:00pm Eastern
Standard Time. Quotes may be e-mailed to lawren.wolf@navy.mil. To be considered timely, an E-mail quote must be received in its entirety in the designated E-mail inbox by the due date and time for quote submission. Quotes received after that time will be considered at the Government’s sole discretion. Please reference the solicitation number on your quote.

The Government will consider all quotes that are timely received and may consider late quotes in accordance with 52.212-1. Failure of a quote to address any items listed in the attached submission package may make a quote unacceptable.
Basis for Award: Award will be made to the responsible, technically acceptable quoter, whose quote, conforming to the combined synopsis/solicitation, offers the lowest evaluated price.

9. Provision 52.212-2 Evaluation—Commercial Items (OCT 2014) applies to this acquisition.
(a) The Government may award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) technical capability of the item or service offered to meet the Government requirement;
(ii) price;
(ii) past performance;
Award shall be made to the lowest priced technically acceptable offeror in LPTA solicitations.
To be considered a technically acceptable solution for a parts procurement, the quoted parts shall meet the solicitation requirements including required parts, delivery dates, and terms and conditions stated in the solicitation.
To be considered a technically acceptable solution for a service, the quoted service shall meet the solicitation requirements including terms and conditions stated in the solicitation. The quote shall state that all aspects of the technical requirement, including required delivery date and part numbers (if applicable), can be met.
If utilized, a past performance evaluation will be conducted in accordance with FAR 13.106-2(b)(3)(ii)(C). The
Government intends to utilize the Government Wide Contractor Performance Assessment Report System (CPARS), formerly known as Past Performance Information Retrieval System (PPIRS) for past performance evaluations as a basis for anticipating successful/unsuccessful performance on this required effort. To be considered acceptable for past performance, a search of the CPARS must reveal no negative past performance information for the recent and relevant records. In the event there are no recent and/or relevant CPARS records, the quoter may submit information on recent and relevant subcontracts and/or commercial contracts. If no recent and relevant contracts are available in CPARS or submitted by the offeror, the quoter’s past performance record shall be considered
“unknown.” In the context of acceptable or unacceptable, “unknown” past performance shall be considered
“acceptable.” To be considered recent, the effort must either still be in progress or have been completed within the previous three (3) years from date of this solicitation. To be considered relevant the record should be similar in terms of complexity, scope, and magnitude. “Scope” is defined as experience in areas defined in the SOW.
“Magnitude” is defined as the measure of similarity of the volume, dollar value, and/or duration of work actually performed under the quoter’s submitted contracts to the SOW. At the quoter’s discretion, additional past performance information may be submitted with the quote as a supplement to CPARS. If furnished, this submission will be evaluated in accordance with the procedures described above.
The Government will evaluate quoted pricing for reasonableness utilizing techniques described in FAR 13.106-3.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror by the Government within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
10. All Offerors must include a completed copy of FAR 52.212-3 including Alternate I, Offeror
Representations and Certifications – Commercial Items (JUN 2020) with its offer.
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.
(a) Definitions. As used in this provision—
“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
Forced or indentured child labor means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the
Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.“Sensitive technology”—
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3)of the International Emergency Economic Powers
Act (50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veteransor, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service connected, as defined in 38 U.S.C. 101(16).
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
Small disadvantaged business concern, consistent with13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—
(i) One or more socially disadvantaged (as defined at13 CFR 124.103) and economically disadvantaged
(as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
Subsidiary means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation
Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
Veteran-owned small business concern means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the
United States.

(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least51 percent of the stock of which is owned by one or more women; and

For line items covered by the WTO GPA, the Government will evaluate offers of U.S.-made or designated country end products without regard to the restrictions of the Buy American statute. (h) Certification Regarding Responsibility Matters (Executive Order 12689). (Applies only if the contract value is expected to exceed the simplified acquisition threshold.) The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals–

(i) Taxes are considered delinquent if both of the following criteria apply:
(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.
Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability.
Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
(i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126). [The
Contracting Officer must list in paragraph (i)(1) any end products being acquired under this solicitation that are included in the List of Products Requiring Contractor Certification as to Forced or Indentured Child Labor, unless excluded at 22.1503(b).]
