MALMSTROM AFB, MT

Local Telecommunications Services

12 August 2021

(i) This is a combined synopsis/solicitation for a commercial item prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

(ii) This solicitation is issued as a request for quote (RFQ). Submit written quotes (oral quotes will not be accepted) on RFQ reference number FA4626-21-Q-0014.

(iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-06.

(iv) This procurement is being solicited as full and open competition. The North American Industry Classification System (NAICS) code is 517919 with a small business size standard of $35.0M.

(v) Requirement: When submitting your quotation, please utilize Attachment 2, Bid Schedule, for a five-year ordering period on an Indefinite Delivery Indefinite Quantity (IDIQ) contact. The award Contract Line Item Number (CLIN) structure will be made in accordance with formatting within the Bid Schedule.

(vi) Please refer to Attachment 1 Performance Work Statement (PWS), dated 15 July 2021, for all Local Telecommunications Services requirements.

(vii) Period of Performance:

5 years estimated to start: 01 October 2021 – 30 September 2026.

(viii) The provision at FAR 52.212-1, Instructions to Offerors—Commercial Items (Jul 2021), applies to this acquisition.

FAR 52.212-1 Addenda:

A. Offerors’ quotation shall conform to the required specifications as references in paragraph (vi) above and as attached to this solicitation therein. Any offeror not conforming to the required specifications shall be deemed unacceptable and therefore ineligible for award.

B. Offerors shall submit:

1. Volume I- Offerors shall complete the workbook at Attachment 2, Bid Schedule, in accordance with (IAW) the associated Performance Work Statement.

2. Volume II – Attachment 3 Past Performance Worksheet

C. REAL ID ACT: For either the site visit (if required) or submission of quotations, all personnel requesting access to Malmstrom Air Force Base must possess a valid State or U.S. Government picture identification card. Furthermore, individuals presenting identification cards from a state that are non-compliant with the REAL ID Act will require additional documentation to gain unescorted base access.

Additional documentation includes a valid U.S. or foreign government-issued passport, an employment authorization document that contains a photograph, or identification cards issued by federal, state, or local government agencies that include a photo and biographic information. A full list of REAL ID Act compliant and non-complaint states can be found at https://www.dhs.gov/current-status-states-territories.

Personnel requesting vehicle access to Malmstrom Air Force Base must provide a valid driver’s license, current vehicle registration, and valid insurance.

D. System for Award Management (SAM.gov): Prospective offerors shall be registered in the System for Award Management (SAM) database when submitting an offer or quotation, and shall continue to be registered until time of award, during performance and through final payment of any contract, basic agreement, basic ordering agreement or blanket purchasing agreement resulting from this solicitation.

SAM must be current at the time of award and have completed the annual representations and certifications section IAW FAR 4.1102. Notice: Effective 11 June 2018, entities registering in SAM (and those renewing expired registrations) will be required to submit a notarized letter appointing their authorized Entity Administrator. E. Ombudsman: The specific Ombudsman information for this acquisition is: If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, for AFGSC (Air Force Global Strike Command) acquisitions please contact the Director of Contracts, Air Force Installation Contracting Center, Operating Location – Global Strike (AFICC/KG OL-GSC) via the following e-mail workflow address: ig.afica_kg.workflow@us.af.mil. F. Notice to Offerors/Suppliers: Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs.

G. Section 889 Compliance: Offerors shall either update their responses in the System for Award Management or complete Attachment 5 regarding Section 889 compliance.

Your quotation must remain valid for a minimum of 90 calendar days.

H. The Contract Ceiling Value: $249,999.99

The minimum contract value for each order issued against this contract: $2,500.00 The maximum contract value for each order issued against this contact: $50,000.00

(ix) The provision at FAR 52.212-2, Evaluation—Commercial Items (Oct 2014), applies to this acquisition. Specific evaluation criteria are included in paragraph (a) of this provision:

i. Price; and

ii. Past Performance.

FAR 52.212-2 Addenda:

A. The Government seeks to award to the responsible offeror with whom provides a complete quote and conforms to the requirements of the solicitations herein. Unacceptable, unsatisfactory rated offerors will be ineligible for award. Offerors are cautioned to provide all information requested under the Addenda to FAR 52.212-1. Failure to provide a complete quote may result in an unacceptable determination and therefore ineligible for award.

B. Evaluation shall be conducted as follows:

1. Completeness – does the offer conform and provide all requirements outlined within the solicitation. This includes but is not limited to completing FAR 52.212-3 Representations and Certifications within the System for Award Management (SAM).

2. Factor 1: Price – Offerors shall be sorted by price in ascending order from lowest priced to highest priced by the Total Evaluated Price (TEP).

a. The offeror’s TEP will be determined by multiplying the maximum quantities identified in the Bid Schedule, Attachment 2, by the unit price, limited to two decimal places for each line item, to confirm the extended total amount for each line item. Each line item within each year will be summed to equate to the total of five years of the ordering period.

b. In order to meet the requirements of FAR Parts 6 and 17, the Government will evaluate the option to extend services under FAR Clause 52.217-8 by adding one-half of the offeror’s final year of the five-year ordering period prices to the offeror’s total proposed price. Offerors are required only to price the five years of the ordering period. Offerors shall NOT submit a price for the potential six-month extension of services period.

c. The offeror’s TEP will include the five years of ordering period and the potential six-month extension of services period.

d. The techniques and procedures described under FAR 13.106-3 will be the primary means of assessing offers’ reasonableness.

3. Factor 2: Past Performance – The Government will evaluate past performance starting with the lowest priced offeror. The Government will review Attachment 3, Past Performance Worksheet, IAW FAR 13.106-2(b)(3). In the event complete, acceptable offerors are unable to provide three (3) references, the missing references will be rated as neutral, neither favorable nor unfavorable. For evaluation purposes, recent is defined as within three years from issuance of the solicitation. For evaluation purposes, relevant is defined as within the scope of work identified within Attachment 1.

*Offerors will be afforded the opportunity to respond to negative past performance information obtained by the Government.

4. Best Value Determination – The Government will conduct an integrated assessment of the complete, acceptable offers to determine best value on a minimum of three (3) offerors from lowest to highest priced, unless fewer are received. As such, this may result in award to a higher priced, greater past performance rated offeror.

(x) The provision at FAR 52.212-3, Offeror Representations and Certifications—Commercial Items (Feb 2021) with its Alternate I (Oct 2014), applies to this acquisition. All Contractors are required to have an active registration in the System for Award Management (SAM). Please fill out and provide a copy of this provision with your quotation.

(xi) The clause at FAR 52.212-4, Contract Terms and Conditions—Commercial Items (Oct 2018), applies to this acquisition.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.216-18 Ordering (Aug 2020)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 01 October 2021 through 30 September 2026.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) A delivery order or task order is considered "issued" when—

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or

(3) If sent electronically, the Government either—

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or

(ii) Distributes the delivery order or task order via email to the Contractor's email address.

(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

52.216-19 Ordering Limitations (Oct 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500.00 the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor-

(1) Any order for a single item in excess of $30,000.00;

(2) Any order for a combination of items in excess of $50,000.00

(3) A series of orders from the same ordering office within five (5) days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph

(b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within two (2) days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 Indefinite Quantity (Oct 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 30 September 2027)

52.217-8 Options to Extend Services (Nov 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

(xiii) Defense Priorities and Allocations System (DPAS) is not applicable.

(xiv) Quotes shall be received NO LATER THAN 2:00 PM MST, Tuesday, 14 September 2021.
