(viii) Submission Instructions
FAR 52.212-1, Instructions to Offerors--Commercial Items (JUN2020), applies to this acquisition.
The vendor is required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. The vendor shall be compliant with the requirements as stated in sections (v) and (vi). Failure to meet a requirement may result in the vendor being ineligible for award. The vendor must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.
(ix) Basis for Award
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a single contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The
Government will first evaluate the Technical Acceptability of all timely quotes. Vendors shall quote on all line items in the Schedule of Items. Any quote that fails to cite a price for each item or fails to make an entry that indicates line item will be provided at no charge will be rejected as Technically Unacceptable. The following factors will be used to evaluate offers:
(i) Technical Acceptability. In order to be determined technically acceptable the quote must clearly demonstrate that the items in the quote meet or exceed the minimum requirements outlined in the Schedule of Items.
(ii) Vendors must provide a price on the supplies specified in contract line item (CLIN) or the quote will not be eligible for award. Only quotes rated as technically acceptable will be eligible for award. The Government will evaluate the lowest priced quote for technical acceptability first. If the lowest quote is deemed technically acceptable, then the evaluation process stops at this point. Award will be made to that vendor without further consideration of any other quotes. If the lowest quote is not technically acceptable, then the next lowest will be evaluated for technical acceptability, and so forth, until a quote is found to be technically acceptable.
(iii) The Government will use the following ratings and descriptions to determine Technical Acceptability.
Technical Acceptable/Unacceptable Ratings Rating Description
Acceptable Offer clearly meets the minimum requirements of the solicitation.
Unacceptable Offer does not clearly meet the minimum requirements of the solicitation.
(a) Discussions: The Government intends to award a contract without discussions. The Government however, reserves the right to conduct discussions if deemed in its best interest. Therefore, the offeror's initial proposal should contain the offeror's best terms from a technical and price standpoint.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
