“Whenever agencies are required to publicize notice of proposed contract actions under 5.201, they must proceed as follows:

The Department of Homeland Security (DHS), Federal Protective Service (FPS) is soliciting quotes for a Generator and Equipment Lease in Leesburg, VA 20176. Specific requirements are contained in the Federal Protective Service (FPS) Region 11 Statement of Work (SOW). The aforementioned commercial services shall be secured through a streamlined solicitation as outlined under FAR 12.603. As such the following synopsis information as required under FAR 5.207 is being provided:

(11) Description: Solicitation 70RFP222QEC000006 shall procure the lease of a Generator and Equipment in accordance with the attached SOW. DHS/FPS intends to award a Firm Fixed Price, Commercial Type Purchase Order in response to Request for Quote (RFQ) 70RFP222QEC000006. This requirement is being competed on an unrestricted basis.

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation: quotes are being requested and a written solicitation is hereby included.
A complete description of the requirements briefly described herein, to include Statement of Work, terms and conditions, provisions, clauses and associated attachments are all included in the formal Request for Quote (RFQ) 70RFP222QEC000006 attached to this synopsis/solicitation announcement.
The Government will conduct a best value procurement in accordance with FAR 13.106-2 to the lowest quote, responsible quoter.
Schedule Of Item(s) - Responsible quoters shall provide a Firm Fixed Price (FFP) for the items described in the SOW:
Contract Line Item Number (CLIN) 0001:
· Contractor shall provide all equipment, materials, supplies, tools, supervision, and labor to provide a Generator and Equipment lease at Leesburg, VA 20176-3876, in accordance with the attached Statement of Work (SOW).
· Quoters shall include itemized pricing for the system components.
· Quoters shall include specifications of all proposed equipment within their quotes.
Contract Line Item Number (CLIN) 0002:
· Fuel (Not-To-Exceed Amount)
Fuel will be reimbursed at actual cost not-to-exceed $18,480.00 to include no more than $1.00 per gallon over the actual cost for delivery.
Questions concerning the RFQ must be submitted via e-mail to the Contracting Officer, Angela Haviland, at angela.haviland@fps.dhs.gov, no later than 2:00 P.M. ET on 04/14/2022. Telephonic questions will not be accepted.
Quotations are due no later than 4:00 P.M. ET on 04/18/2022 and shall be submitted electronically to the Contracting Officer, Angela Haviland, at angela.haviland@fps.dhs.gov. Facsimile proposals are not permitted and will be disregarded if received.

STATEMENT OF WORK (SOW)
FOR
GENERATOR’s & EQUIPMENT LEASE
1.0 GENERAL
1.1 BACKGROUND
The Federal Protective Service (FPS) is a federal law enforcement agency that provides integrated security and law enforcement services to federally owned and leased buildings, facilities, properties, and other assets. The FPS mission is to render Federal properties safe and secure for Federal employees, officials, and visitors in a professional and cost-effective manner by deploying a highly trained and multi-disciplined police force.
FPS protects its buildings through a combination of FPS inspector personnel, security guards and physical countermeasures (such as bollards, x-rays, and cameras). FPS works to ensure that there are sound and cost-effective financial management policies, standards, and systems consistent with agency goals and programs. FPS also works to fulfill the financial information requirements of customers by efficiently completing payment, revenue, and reconciliation activities.
FPS, Region 11 has a need for Generators and auxiliary Equipment, to assist in accomplishing its assigned mission.
1.2 SCOPE
The Contractor shall provide the below required leased equipment to Leesburg, VA. The Specs are as follows:
· Provide standalone power source for two separate locations located approximately 1,500 feet apart.
· Each location will consist of power generation for a guard booth with interior light, heat, and air condition, along with exterior LED spotlights capable of 24/7 operation.
· Require LED external flood lights with four adjustable light fixtures on a cart capable of producing a minimum of 30,000 lumens per light fixture at 4000 Watt. Also, compatible to the provided power source.
· Power source will require the connections to the guard booth (110 AC standard outlet with minimum of 20amp circuit breaker) with minimum of 20KW power generation at both sites.
· Power source requires a powerpack (24kW/90Kwhr) consistent of standalone batteries to generate power at each location with primary recharging through solar panels and alternate fuel powered back up generator for inclement weather. The alternate fuel power generator requires an external fuel reservoir with minimum storage of 250-gallon tank and set up within applicable environmental codes. The powerpack should be capable of providing power demands for 75% of daily operations with aid of the solar panels and alternate fuel generator 25% of daily use. Note, with inclement weather the fuel generator use may be increased due to lack of sun for solar panels.
· Require provider to provide all necessary connections to link the powerpack, solar panels, fuel generator, and external fuel tank together and to the guard booth and LED spotlights.
· Fuel generator should operate between 60-65db during operation.
· Provide fuel for the generators and external fuel tank, in addition to refueling the external tank periodically during use.
· Require delivery and set-up for use, and tear-down and removal at the end of the performance period.
· Provide extensions cords to allow proper placement of LED flood lights at the location, not to exceed 200 feet from power source.
· Provide that the generator is set to an automatic transfer switch (ATS) if power is lost for any reason.
· Provide or installed grounding protection system for generator set as per described by National Electric code.
· The contractor shall demonstrate that all equipment is properly functioning upon completion of installation.
Maintenance/Repair
· Support should be available 24/7 and physical support within 24 hours of receiving service call notification.

The Contractor shall furnish all materials, supplies, and services necessary to fulfill the requirements of this contract.
4.0 INVOICING
4.1 Payments shall not be made for any unauthorized supplies or for any unauthorized changes to the work specified herein. This includes any supplies or services performed by the Contractor of their own volition or at the request of an individual other than a duly appointed CO. Only a duly appointed CO is authorized to change the specifications, terms, and conditions under this effort.
4.2 The Contractor shall submit invoices within 15 business days after acceptance of shipment.
4.3 The invoice shall have the following information:
· Name of Contractor
· Contract Number
· Date of Order
· Quantity, Unit Price, and Extension of each item
5.0. AUTHORITY:
Only the DHS Contracting Officer has authority to modify the terms and conditions of this task order.
6.0. INVOICING:
After award of this contract, but prior to performance, the contractor shall meet with the Contracting Officer and Contracting Officer’s Representative upon request to discuss proper invoice preparation and submission. The contractor and government shall agree on a standardized invoice format to be used for submission of all invoices under this contract that meets the requirements of FAR 52.212-4 Contract Terms and Conditions – Commercial Items, Paragraph (g) “Invoice.” Use of a standardized invoice format will facilitate timely invoice reviews and approvals. Failure to use the agreed standardized invoice format shall result in rejection of invoices.
Invoices shall be submitted for payment within 30 days after completion of the prior month’s services. Invoices shall not contain any employee Personally Identifiable Information (PII). Invoices shall be submitted via one of the following three methods:

2. by facsimile (fax): # 802-288-7658. The invoice submission shall include a cover sheet with the contractor’s point of contact information and # of pages.
3. by e-mail: NPPDInvoice.Consolidation@ice.dhs.gov The invoice number and FPS Region 11 shall be annotated in the subject line of the e-mail. Only (1) invoice shall be submitted per e-mail message. The invoice attached to the e-mail shall be in Portable Document Format (PDF) Invoices submitted by other than these three methods will not be processed and will be returned.
Contractors shall provide an informational copy of each invoice to the Contracting Officer, the Contract Specialist and the Contracting Officer’s Representative concurrent with submission to the designated billing office referenced above.
In addition to the information required for a proper invoice as identified in FAR 52.212-4 (g)(1), Contract Terms and Conditions – Commercial Items, (FEB 2012), the contractor shall include the following information:
1. Annotate “FPS Region 11” on the face of each invoice
2. Clearly identify the period of performance for which the services were rendered or the date the supplies were delivered to the government (invoices for periods of performance that encompass less than a full month of service must show the specific dates that services were rendered).
3. Cite the identical CLIN description on the invoice as what is cited within the CLIN description listed in the contract.
4. Where there are variances between the requirements cited in the task order(s) and the work actually performed, the Contractor shall attach a separate sheet to the invoice detailing each instance of a variance.
Contractors shall submit only one invoice per contract or order per month. Failure to comply with these submission requirements will result in rejection of the invoice.
Final invoices shall be marked “FINAL” and be accompanied by an executed “Contractor’s Release” (DHS Form 700-3 (12/07)) available at http://dhsconnect.dhs.gov/forms/documents/DHS_Form_700-3.pdf or by request to the Contracting Officer. A release discharging the Government, its officers, agents and employees of and from all liabilities, obligations, and claims arising out of or under this contract subject only to the exceptions listed at FAR 52.212-4 (ALT1), paragraph (i)(7)(i)-(iii) is a condition precedent to final payment.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)

(a) Definitions. As used in this clause "Covered article" means any hardware, software, or service that
(1) Is developed or provided by a covered entity;
(2) Includes any hardware, software, or service developed or provided in whole or in part by a covered entity; or
(3) Contains components using any hardware or software developed in whole or in part by a covered entity.
"Covered entity" means
(1) Kaspersky Lab;
(2) Any successor entity to Kaspersky Lab;
(3) Any entity that controls, is controlled by, or is under common control with Kaspersky Lab; or
(4) Any entity of which Kaspersky Lab has a majority ownership.
(b) Prohibition. Section 1634 of Division A of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L. 115-91) prohibits Government use of any covered article. The Contractor is prohibited from
(1) Providing any covered article that the Government will use on or after October 1, 2018; and
(2) Using any covered article on or after October 1, 2018, in the development of data or deliverables first produced in the performance of the contract.
(c) Reporting requirement.
(1) In the event the Contractor identifies covered article provided to the Government during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report, in writing, via email, to the Contracting Officer, Contracting Officer's Representative, and the Enterprise Security Operations Center (SOC) at NDAA Incidents@hq.dhs.gov, with required information in the body of the email. In the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Enterprise SOC, Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) and Contracting Officer's Representative(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (c)(1) of this clause:
(i) Within 1 business day from the date of such identification or notification: the contract number; the order number( s ), if applicable; supplier name; brand; model number (Original Equipment Manufacturer (OEM) number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the report pursuant to paragraph (c)(l) of this clause: any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of a covered article, any reasons that led to the use or submission of the covered article, and any additional efforts that will be incorporated to prevent future use or submission of covered articles.
(c) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts, including subcontracts for the acquisition of commercial items.

FAR 52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021) (DEVIATION 20-05)
(a) Definitions. As used in this clause— “Backhaul” means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).
“Covered foreign country” means The People’s Republic of China.
“Covered telecommunications equipment or services” means–
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
“Critical technology” means–
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
“Interconnection arrangements” means arrangements governing the physical connection of two or more networks to allow the use of another’s network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.
“Reasonable inquiry” means an inquiry designed to uncover any information in the entity’s possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.
“Roaming” means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.
“Substantial or essential component” means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
(c) Exceptions. This clause does not prohibit contractors from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement.
(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause in writing via email to the Contracting Officer, Contracting Officer’s Representative, and the Network Operations Security Center (NOSC) at NDAA_Incidents@hq.dhs.gov, with required information in the body of the email. In the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the NOSC, Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) and Contracting Officer’s Representative(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause
(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.
(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.
(End of clause) FAR 52.232-40 PROVIDING ACCELERATED PAYMENTS TO SMALL BUSINESS SUBCONTRACTORS (APR 2020) (DEVIATION)
(a)(l) In accordance with 31 U.S.C. 3903 and 10 U.S.C. 2307, upon receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract in accordance with the accelerated payment date established, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, with a goal of 15 days after receipt of a proper invoice and all other required documentation from the small business subcontractor if a specific payment date is not established by contract.
(2) The Contractor agrees to make such payments to its small business subcontractors without any further consideration from or fees charged to the subcontractor.
(b) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act.
