JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)

CONTRACT SPE2D0-19-D-0006

Dressing, Hemostatic Combat Gauze – XL

(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Medical Readiness Support Division, is the contracting activity.

(2) The action submitted for approval is a JEFO for the acquisition under Phoenix Textile’s contract SPE2D0-19-D-0006 valid through August 24, 2029.

(3) The action submitted for approval is the acquisition of a Medical Surgical item for the Marine Corps Logistics Command. The total estimated dollar value of this action is $392,300.00.

(4) The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(B), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

Medical Readiness currently has two contracts for the required item – a Corporate Exigency Contract (CEC) with North American Rescue (NAR), a manufacturer, and a Vendor Managed Inventory (VMI) contract with Phoenix Textile, a distributor for Z-Medica, LLC.

Z-Medica, LLC does not possess a Medical Readiness Contract which eliminates them as a competitor.

The Combat Gauze is a fast-acting gauze for wound care dressing that stops blood flow, it’s immobile and non-allergenic. This gauze can be used for several size and shape wounds.

The Military uses a hemostatic gauze to pack into those areas that are not conducive to tourniquet use, those are usually the “junctions” of out body that have been injured.

Hemostatic products wok by delivering a specialized agent directly to the point of the injury (injured vessel), in conjunction with good packing techniques, and subsequent direct pressure. This “QuikClot” hemostasis product puts life-saving technology directly into the hands of corpsmen and medical personnel, giving them the power to treat severe traumatic bleeding directly in the field and save lives. The Combat Gauze is designed for the needs of combat and tactical medical personnel.

(5) The Contracting Officer determined Phoenix Textile’s price of $78.46 to be fair and reasonable based upon Phoenix Textile’s Distribution and Pricing Agreement (DAPA) price.

This acquisition represents the best value to the Government consistent with FAR 16.505(b)(2)(i)(B) and will result in the lowest overall cost alternative to meet the Government’s needs.

(6) Market Research has revealed that there are currently three (3) manufacturers who produce

Combat Gauze – XL: Z- Medica LLC, Tribal Company, and North American Rescue. Z- Medica currently does not have a Medical Readiness contract therefore the company has not been considered for an award. In December 2020, Z-Medica was purchased by Teleflex Medical Inc. Medical Readiness will be in contact with Teleflex for the purpose of soliciting

Dressing, Hemostatic Combat Gauze – XL interest in pursuing a CEC contract. Tribal Company also does not have a Medical Readiness contract therefore the company has not been considered for an award. Phoenix Textile is however the distributor who offers the required item under its VMI contract. Medical Readiness can also access the Combat Gauze through its CEC contract with North American Rescue; however, its price is higher than Phoenix’s proposed price. North American Rescue indicated its current DAPA price was the lowest price it could offer.

Changes in the medical surgical industry, specifically as they may apply to the required item, will be monitored by the Readiness Program Manager.

(7) There are no other facts supporting the use of this JEFO.
