INVITATION
The City of Weslaco hereby requests the electronic submission of Statement of Qualifications for the following:

Electronic submission of Qualifications addressed to Homer Rhodes, Purchasing Agent, will be accepted only via “BIDNET” (link provided in RFQ document). Statements of Qualifications deadline 11:00 AM on
August 4, 2025, at which time responses will be opened via Zoom meeting and read aloud (Zoom link provided in RFQ document).

The City of Weslaco reserves the right to accept any and all RFQ responses and to waive any informalities and/or to accept the SOQ response to be the best and most advantageous to the City and to hold SOQ responses for a period of sixty (60) days from the date of the RFQ opening without acting for the purpose of reviewing and investigation of the qualifications of each response prior to award. Statement of Qualification responses will not be accepted past the due date and time or through any other median other than the BIDNET electronic submission portal.

INSTRUCTIONS TO RESPONDENTS
DEVIATION FROM SPECIFICATION/REQUIREMENTS
Please read your requirements thoroughly and be sure that the RFQ offered complies with all requirements/specifications noted. Any variation from the solicitation requirements must be clearly indicated by letter, on a point by point basis, attached to and made a part of your RFQ response. If no exceptions are noted, and you are the successful respondent, it will be required that the service(s) be provided as specified.
PURPOSE
The purpose of these requirements and proposal documents is to award multiple Professional Services Contracts for: Construction Materials Testing (CMT) & Geotechnical Services
SUBMITTAL OF RFQ
Respondent shall submit an electronic PDF file through BIDNET portal no larger than 20 bound pages (not including cover pages or required forms). Properly name electronic file with Firms name and RFQ/SOQ number 2024-25-39 and must be submitted through BIDNET portal before the deadline. City will not accept hard copies of SOQ’s. Failure to meet RFQ requirements may be grounds for disqualification.
TIME ALLOWED FOR ACTION TAKEN
The City of Weslaco may hold SOQ’s 60 days after deadline without taking action.
RIGHT TO REJECT/AWARD
The City of Weslaco reserves the right to reject any or all responses and to waive any or all informalities or technicalities, and to make such awards of contract as may be deemed to be the best and most advantageous to the City of Weslaco.
ASSIGNMENT
Respondents are advised the City of Weslaco shall not allow the successful respondent to sell, assign, transfer, or convey any part of any contract resulting from this RFQ in whole or in part, to a third party without the written approval of the Purchasing Department for the City of Weslaco.
AWARD
Respondents are advised that the City of Weslaco is soliciting Request for Qualifications in compliance with Government Code 2254 “Procurement of Professional Services Act” and award shall be made to the respondent in the opinion of the City of Weslaco is the best and most advantageous.
STATUTORY REQUIREMENTS
It shall be the responsibility of the successful respondent to comply with all applicable State & Federal laws, Executive Orders and Municipal Ordinances, and the Rules and Regulations of all authorities having jurisdiction over the work to be performed hereunder and such shall apply to the contract throughout, and they will be deemed to be included in the contract as though written out in full in the contract documents.
ALTERATIONS/AMENDMENTS TO RFQ
RFQ CANNOT be altered or amended after opening time. Alterations made before opening time must be initialed by respondent guaranteeing authenticity. No RFQ may be withdrawn after opening time without acceptable reason in writing and only after approval by the City of Weslaco.
LIST OF EXCEPTIONS
The respondent shall attach to his/her RFQ a list of any exceptions to the specifications/ requirements.
RESPONDENT’S EMPLOYEES
Neither the respondent nor his/her employees engaged in fulfilling the terms and conditions of this Professional Services Contract shall be considered employees of the City. The method and manner of performance of such undertakings shall be under the exclusive control of the selected vendor placed on contract. The City shall have the right of inspection of said undertakings at any time.
RIGHT TO AUDIT
The City of Weslaco reserves the right to audit the service provider’s books and records relating to the performance of this contract. The City of Weslaco, at its own expense, shall have the right at all reasonable times during normal business hours and upon at least twenty-four (24) hours’ advance notice, to audit, to examine, and to make copies of or extracts from the books of account and records maintained by the service provider with respect to the Service Contract. If such audit shall disclose overpayment by City to service provider, written notice of such overpayment shall be provided to the service provider and the amount of overpayment shall be promptly reimbursed by the service provider to the City. In the event any such overpayment is not paid within ten (10) business days after receipt of such notice, the unpaid amount of such overpayment shall bear interest at the rate of one percent (1%) per month from the date of such notice until paid.
SYNONYM
Where in this solicitation package SERVICES is used, its meaning shall refer to the request for Statement of Qualifications for CONSTRUCTION MATERIALS TESTING AND GEOTECHNICAL SERVICES as specified.
PAST PERFORMANCE
Respondents are advised that past performance as it relates to product(s) and/or service(s) on Purchase/Service/Supply Contracts previously held with the City shall be a factor in the evaluation and award of this RFQ. Respondents that have not complied with their obligation(s) to the City of Weslaco on previous projects will not be considered for award of this bid. The City’s position on this matter shall be final.
JURISDICTION
The Contract executed as part of this solicitation shall be subject to and governed under the laws of the State of Texas. Any and all obligations and payments are due and performable and payable in Hidalgo County, Texas.
HUB CERTIFICATION
State Certified “HUB Vendor(s)” are asked to provide a copy of their certification, if they have not previously done so (information to be e-mailed to the Purchasing Manager).
INTERPRETATIONS
Any questions concerning the RFQ specifications/requirements with regards to this solicitation for statement(s) of qualifications shall be directed to Homer Rhodes, Purchasing Agent. Such interpretations, which may affect the eventual outcome of this request for statements of qualifications, shall be furnished in writing to all prospective Respondents via Addendum and posted on BIDNET. No interpretation shall be considered binding unless provided in writing by the City of Weslaco in accordance with paragraph entitled “Addenda and Modifications”.
CONFLICT OF INTEREST
Respondents are advised that they must follow the below mentioned law:
CHAPTER 176 OF THE TEXAS LOCAL GOVERNMENT CODE
Effective January 1, 2006, Chapter 176 of the Texas Local Government Code requires that any vendor or person considering doing business with a local government entity disclose in the questionnaire Form CIQ, the vendor or person’s affiliation or business relationship that might cause a conflict of interest with a local government entity. By law, this questionnaire must be filed with the records administrator of the City of Weslaco not later than the 7th business day after the date the person becomes aware of facts that require the statement be filed. See Section 176.006, Local Government Code. A person commits an offense if the person violates Section 176.006, Local Government Code. An offense under this section is a Class C misdemeanor. MISDEMEANOR. ADDENDA AND MODIFICATIONS
ADDENDA AND MODIFICATIONS
Any changes, additions, or clarifications to the RFQ are made by amendments (addenda).
Any respondent in doubt as to the true meaning of any part of the RFQ or other documents may request an interpretation from the Purchasing Agent. Such addendum and/or notice of addendum will be posted on BIDNET portal and will become part of the RFQ package having the same binding effect as provisions of the original RFQ. It shall be the respondent(s) responsibility to ensure they have received all Addenda in respect to this solicitation. Furthermore, respondents are advised they must recognize, comply with, and attach a signed copy of each Addendum which shall be made part of their Submittal.
Respondent(s) signature on Addenda shall be interpreted as the respondent’s “recognition and compliance to” official changes as outlined by the City of Weslaco and as such are made part of the original RFQ documents.
Failure of any respondent to receive any such addendum or interpretation shall not relieve such Respondent from its terms and requirements. Addendums are available online at https://www.bidnetdirect.com/texas/cityofweslaco. No verbal explanations or interpretations will be binding. In order to have a request for interpretation considered, the request must be submitted in writing and must be received by 7/25/2025 end of business day 5:00 P.M.
VENUE
The parties agree that venue for purposes of any and all lawsuits, cause of action, arbitration, and/or any other dispute(s) shall be in Hidalgo County, Texas.
INDEMNIFICATION CLAUSE
The bidder hereby agrees to protect, defend, indemnify and hold the City and its employees, agents, officers and servants free and harmless from all losses, claims, liens, demands and causes of action of every kind and character including, but not limited to, the amounts of judgments, penalties, interests, court costs, legal fees, and all other expenses incurred by the City arising in favor of any party, including claims, liens, debts, personal injuries, including employees of the City, death or damages to property (including property of the City) and without limitation by enumeration, all other claims or demands of every character occurring or in any ways incident to, in connection with or arising directly or indirectly out of this contract. Bidder agrees to investigate, handle, respond to, provide defense for and defend any such claims, demand, or suit at the sole expense of the bidder. In addition, the bidder protect, defend, indemnify and hold the City and its employees, agents, officers and servants free and harmless from all losses, claims, liens, demands and causes of action relating to, for, or on account of the use of patented appliances, products or processes, and he/she shall pay all royalties and https://www.bidnetdirect.com/texas/cityofweslaco charges which are legal and equitable. Evidence of such payment or satisfaction shall be submitted upon request of the Purchasing Manager, as a necessary requirement in connection with the final estimate for payment in which such patented appliance, products or processes are used. Bidder also agrees to bear all other costs and expenses related thereto, even if the claim or claims alleged are groundless, false or fraudulent. This provision is not intended to create any cause of action in favor of any third party against bidder or the City or to enlarge in any way the bidder's liability but is intended solely to provide for indemnification of the City from liability from damages or injuries to third persons or property arising from bidder's performance hereunder.
STANDARD INSURANCE REQUIREMENTS
The Certificate of Insurance should be made to the City of Weslaco, 255 S. Kansas Ave, Weslaco, TX 78596, and should reference the operation.
All certificates must be received prior to commencement of service/work. All Certificates of insurance shall be approved by the Risk Manager and/or his/her designated representative prior to the commencement of any work.
In the event the insurance coverage expires prior to the completion of this contract, a renewal certificate shall be issued thirty (30) days prior to said expiration date. The City must be notified at least thirty (30) days prior to any material change in and/or cancellation and/or non- renewals of such policies.
The term “City” shall include The City of Weslaco and their employees, officers, officials, agent, and volunteers in respect to the contracted services. Any failure on the part of the City to request required insurance documentation shall not constitute a waiver of the insurance requirement.
The City reserves the right to make reasonable requests or revisions pertaining to the types and limits of that coverage.
During the term of the Contract, the successful contractor/respondent/selected firm shall acquire and maintain, for the duration of the contract period the following insurances:
A. Comprehensive Commercial General Liability: The Contractor/Respondent/Selected Firm shall provide minimum limits of $250,000 each occurrence, $500,000 annual aggregate
B. Business Automobile Liability: The Contractor/Respondent/Selected Firm shall maintain limits of no less than
Additional Insured Requirement:
To the fullest extent of coverage allowed under Chapter 151 of the Texas Insurance Code, the City of Weslaco shall be included as additional insured under the or endorsements providing equivalent coverage, including products completed operations.
C. Builder’s Risk/Fire & Extended Coverage (if applicable)
The Contractor shall insure the building or other work included in this contract on an all risk (special causes of loss) policy, with an insurance company or companies acceptable to the Owner. The amount of the insurance always to be at least equal to the amount paid on account of work and material and plus the value of the work or materials furnished or delivered but not yet paid for by the Owner. Builder’s Risk Policies shall cover loss of materials by theft, vandalism, malicious mischief or other loss whether materials are incorporated in the work or not.
The policies shall be in the names of the City and the Contractor, as their interests may appear, and certificates of insurance shall be delivered to the Owner before monthly partial payments are made. The policy shall provide for the inclusion of names of all other contractors, subcontractors and other employed on the premises as ensured and shall stipulate that the insurance companies shall have no right to subrogation against any contractors, subcontractors or other parties employed on the premises for any work building alterations, construction or erection to the described property.
D. Workers' Compensation: The contractor/respondent/selected firm shall provide and maintain workers’ compensation insurance for all employees in the full amount required by statute and full compliance with the applicable laws of the State of Texas. Employer's Liability insurance shall be provided in amounts not less than $500,000 per accident for bodily injury by accident; $500,000 policy limit by disease; and $500,000 per employee for bodily injury by disease."
In addition, a Waiver of Subrogation Endorsement shall be provided by the contractor naming the City of Weslaco in said policy for Worker’s Compensation Insurance.
Contractor/Respondent/Selected Firm shall further ensure that all its sub-contractors maintain appropriate levels of workers’ compensation insurance.
E. Professional Services - Insurance Provisions: Errors & Omissions
(Professional Liability): $1,000,000 Each Claim Limit $1,000,000 Aggregate Limit.
If coverage is written on a claims-made basis, the retroactive date shall be on or prior to the date of the contractual Agreement. The certificate of insurance shall state that the coverage is claims-made and include the retroactive date. The insurance shall be maintained for the duration of the contractual Agreement and for four (4) years following completion of the services provides under the contractual Agreement or for the warranty period, whichever is longer. An annual certificate of insurance submitted to the City shall evidence coverage.
F. Deductible Clause: Contractor/Respondent/Selected Firm to declare self-insured retention or deductible amounts in excess of $25,000.
G. Other Provisions: All insurance carriers shall be rated A6 or better and be published on a current A.M. Best Rating Guide, or some other recognized equivalent rating service (e.g., Moody’s, Standard & Poor’s). The City may request a copy of the insurance policy according to the nature of the project. City reserves the right to accept or reject the insurance carrier. All Certificates of Insurance shall be provided on the Acord Form 25. All insurance requirements are imposed and must be complied with by any and all subcontractors, and/or lower-tier sub-contractors. A copy of endorsements providing Additional Insured, Primary Insurance and Waiver of Subrogation wording shall be attached to the certificates of insurance.
STATEMENT OF QUALIFICATIONS PREPARATION COSTS
Issuance of this RFQ does not commit the City of Weslaco, in any way, to pay any costs incurred in the preparation and submission of an RFQ. All costs related to the preparation and submission of this RFQ shall be borne by the respondent.
EQUAL EMPLOYMENT OPPORTUNITY
Respondent agrees that they will not discriminate in hiring, promotion, treatment, or other terms and conditions of employment based on race, sex, national origin, age, disability, or in any way violate Title VII of 1964 Civil Rights Act and amendments, except as permitted by said laws.
CONFIDENTIALITY OF INFORMATION AND SECURITY
Should the successful respondent become the holder of and have access to confidential information in the process of fulfilling its responsibilities in connection with an awarded contract the successful respondent agrees that it shall keep such information confidential and will comply fully with the laws and regulations of the State of Texas, ordinances and regulations of the City, and any applicable federal laws and regulations relating to confidentiality.
TERMINATION OF CONTRACT
The City of Weslaco reserves the right to terminate the contract if, in the opinion of the City of Weslaco, the successful vendor’s performance is not acceptable, no funds are available, or if the City wishes, without cause, to discontinue this contract. Termination will be in written form allowing a 30-day notice.
ANTI-LOBBYING PROVISION
During the period between RFQ submission date and the contract award, respondents, including their agents and representatives, shall not directly discuss or promote their RFQ with any member of the Weslaco City Commission or City staff except in the course of City- sponsored inquiries, briefings, interviews, or presentations. Violation of this provision may result in the rejection of the respondent’s RFQ.
AUTHORIZATION TO BIND RESPONDENT TO STATEMENT OF QUALIFICATIONS
RFQs MUST give full firm name and address of respondent and be manually signed.
Failure to do so will disqualify your RFQ. Person signing bid must show title or AUTHORITY TO BIND HIS/HER FIRM IN A CONTRACT. Firm name and authorized signature must appear on each page that calls for this information. The legal status of the Respondent whether corporation, partnership, or individual, shall also be stated in the RFQ. A corporation shall execute the RFQ by its duly authorized officers in accordance with its corporate by-laws and shall also list the state in which it is incorporated. A partnership Respondent shall give full names and addresses of all partners. All partners shall execute the response. Partnership and Individual Respondent/Bidder shall state in the response the names and addresses of all persons with a vested interest therein. The place of residence of each Respondent, or the office address in the case of a firm or company, with county and state and telephone number, shall be given after the signature.
CONFIDENTIAL INFORMATION
Any information deemed to be confidential by the respondent should be clearly noted on the pages where confidential information is contained; however, the City cannot guarantee that it will not be compelled to disclose all or part of any public record under Texas Public Information Act, since information deemed to be confidential by the bidder may not be considered confidential under Texas Law, or pursuant to a Court order.
OMISSIONS
At the time of the deadline for the RFQs, each respondent will be presumed to have read and to be thoroughly familiar with the requirements of the RFQ. The failure or omission of any respondent to examine any form(s), instrument(s) and/or contract document(s) shall in no way relieve the respondent from any obligation in respect to their RFQ submitted.
LIMITATION OF LIABILITY
Vendors that use the services/lease available through this webpage agree that the City of Weslaco shall not be liable for any loss of profits, loss of time, interruption of business, or indirect, special, incidental, or consequential damages of any kind whether under this agreement or otherwise due to your use of this system.

AND TO MAKE SUCH AWARDS OF CONTRACT AS MAY BE DEEMED TO BE THE
BEST AND MOST ADVANTAGEOUS TO THE CITY OF WESLACO.
HOUSE BILL (H.B.) 1295 (Certificate of Interested Parties – Form 1295) Respondents are advised that in 2015, the Texas Legislature adopted House Bill 1295 (H.B. 1295). For contracts entered into on or after January 1, 2016, Texas Government Code Chapter §2252.908 (H.B. 1295) provides that a Texas governmental entity or state agency may not enter into a contract that either (1) requires an action or vote by the governing body of the entity or agency or (2) has a value of at least $1 million, unless the business entity submits a disclosure of interested parties to the governmental entity or state agency at the time the business entity submits the signed contract to the governmental entity or state agency. The Texas Ethics Commission (Commission) has adopted a certificate of interested parties form (Form 1295) and adopted rules requiring the business entity to file Form 1295 electronically with the commission. As a business entity under this law, it is your firm’s responsibility to comply with all disclosure laws including Chapter 2252. The City of Weslaco as a governmental entity must ensure compliance of the same. Therefore, you shall be required to register and create an account on the TEC website. Once registered, you will receive an email containing a password setup link.
Click on the link to set your password. After you have established an account, you will use your email address, password, and user type (Business Entity) to log in to the filing application section to enter the required information on Form 1295. In Section 3 enter the Project Number and Project Name. Print a copy of the completed form which includes a unique certification of filing number assigned by the application. An authorized agent of the business must sign the form and have the form notarized. The completed Form 1295 with the certification of filing, signed, and notarized must be submitted at the time your RFQ response is submitted to the City of Weslaco. Failure to comply may result in your response being declared “non-responsive.”
REQUEST FOR STATEMENT OF QUALIFICATIONS
CONSTRUCTION MATERIALS TESTING (CMT) & GEOTECHNICAL SERVICES
GENERAL CONDITIONS
I. Purpose The City is requesting Request for Qualifications (RFQ) from experienced construction materials testing laboratories and geotechnical firms to perform construction materials testing on various projects and provide multiple entities with copies of the results of the construction materials testing in a timely manner.
The contract for these services shall expire exactly one (1) year after execution of the contract. The City of Weslaco will reserve the right to extend this contract for two additional years in one (1) year increments if the performance is satisfactory and the terms remain the same.
II. Scope of Service The City is seeking construction materials testing firms to provide assistance on city projects for construction material testing services in the following areas:
• Geotechnical Investigation
• Soil Borings
• Backfill Placement
• Subgrade Soils
• Earthwork
• Concrete form work
• Cast-in-place concrete
• Pavement base
• Asphalt
• Laboratory testing for soils, concrete and asphalt
• Geotechnical Reporting
The selected consultants are to have adequate experienced staffing and a workload free from constraints to produce the work required by the City of Weslaco. Staff expertise is to include a Registered Professional Engineer and staff proficient in the latest ASTM, AASHTO, and ACI testing requirements.
The consultant should have experience with the City of Weslaco and the Texas Department of Transportation construction methodologies and construction requirements.
III. Proposal Requirements
Each RFQ must address, but may not be limited to, the following issues:
1. Firm name, including the addresses of all firm offices identifying in which office the work will be performed.
2. Name, position, phone, email and fax numbers of contact person.
3. Names of principals in the firm; years firm has been in business.
4. Number of staffs by discipline in the office that will be working on project, copies of their resumes and appointed project manager for proposed projects.
5. List at least three related municipal projects with dates, preliminary testing and geotechnical engineering estimates, final testing and geotechnical engineering cost and the names, addresses and phone numbers of representatives of these municipal projects who can be contacted as references.
6. Current workload of the staff and engineering office that would be responsible for the project(s).
7. Names, disciplines and resume of sub-consultants (if any) proposed for the project.
8. DBE/MBE/WBE and Affirmative Action status of firm and sub-consultants.
9. Listing of all pending litigation against or involving the firm or its agents or employees with respect to any work performed.
10. Amount of professional liability insurance coverage carried by your firm
11. Name and phone number of persons to contact at the bank where the firm does business.
12. Fee Schedule – Provide a list of hourly billing rates for each proposed team member. Hourly billing rates shall include all direct and in-direct labor expenses, transportation, cell phone, computer, sub-consultant fee, mark-ups etc.
13. Any other items, which the consultant deems necessary.
IV. Evaluation Process After the deadline for receipt of RFQ’s, an evaluation committee made up of the City Commission will review all proposals utilizing the evaluation criteria noted below. Based on the committee’s review, it is expected that up to three (3) firms may be shortlisted for further consideration and may be required to submit supplemental information.
Additionally, after review, selected firms may be required to make a formal presentation before the City Commission.
V. Evaluation Criteria Evaluation of consultants will be completed by the Weslaco City Commission based on the submitted RFQ. The selection committee shall evaluate and numerically score each RFQ in accordance with the criteria and point value listed below. Points for each criterion may be awarded from zero to the highest point value indicated. Failure to provide any item will result in zero points being awarded for stated criterion.
The following criteria will be used to evaluate the SOQ and should be submitted in a tabbed format:
1. Demonstrated competence on previous projects done for the City of Weslaco.

2. Recent experience in other municipal projects comparable to the one proposed.

3. Capability to perform all or most aspects of the project, such as environmental evaluations. (if applicable) (Weight Factor 0 to 3)
4. Reputation for personal and professional integrity and competence. (Weight Factor 0 to 2)
5. Key personnel’s professional background, caliber and availability for the proposed project. (Weight Factor 0 to 2)
6. Current Workload. (Weight Factor 0 to 2)
7. Demonstrated ability to meet schedules or deadlines. (Weight Factor -2 to 3)
8. Qualifications and experience of outside consultants regularly engaged by the consultant under consideration. (Weight Factor 0 to 3)
9. Quality of projects previously undertaken. (Weight Factor 0 to 2)
10. Familiarity with and proximity to the geographic location of the project. (Weight
Factor 0 to 2)
11. Knowledge of federal regulations, policies, and procedures (if applicable).

12. Capability of a branch office which will do the work to perform independently of the home office, or conversely, it’s capability to obtain necessary support from the home office. (Weight Factor 0 to 2)
13. Demonstrate an understanding of the project’s potential problems and the City of Weslaco’s concerns. (Weight Factor 0 to 2)
14. Degree of interest shown in undertaking the project. (Weight Factor 0 to 2)
VI. Contract Award The City does not guarantee a contract(s) will be awarded as a result of the RFQ. If a contract(s) award is made, but the contract(s) is not executed, the City does not guarantee the contract(s) will be re-awarded.
