Specific characteristics of the material or service that limit the availability to a sole source
(unique features, function of the item, etc.). Describe in detail why only this suggested source can furnish the requirements to the exclusion of other sources.
Commander, Navy Region Mid-Atlantic (CNRMA), began researching the automation of the jury selection process due to process improvement initiatives and forthcoming congressional requirements in FY2017-2018. Funding was secured and had to be delayed due to the onset of
COVID 19. Following Covid 19, funding was reinstated for a pilot program at CNRMA. The
CNRMA Lean Six Sigma (L6S) Team pursued federal and state sources in the civilian sector and discovered the use of a certified system utilized by federal and state district courts. Following a presentation of the program and after meeting with various stakeholders, customers, and end
NAVSUPINST 4200.85D, Encl (1) 2 of 3 users, the team recommended deployment of a randomization/automation jury management system.
The FY23 NDAA amends Article 25(e), UCMJ, by requiring the randomized selection of qualified personnel to serve as members (i.e. jury) on a court-martial panel. This amendment does not change the requirement that the Convening Authority select members best qualified under Article 25(e)(2), UCMJ. Rather, this amendment may impact the number of members detailed and the method that SJAs use to prepare convening orders, but will not impact the rules governing voir dire and empanelment. Hence, the intent is to use the EJURUR platform to randomly select qualified members for court-martial.
Search for other DoD assets to support randomization were unsuccessful. L6S team pursued federal and state certified randomization systems and recommended Avenue Insights &
Analytics’ Clearview Jury Management System following a study, review and demonstration in a local district court. Service provider is certified in 50 states and over 3000 plus state and local governments in complete computer randomization jury selection. Entity can provide testimony and certification of the randomization process in response to any challenges presented by the courts. Time constraints required expedited implementation of the system to meet congressional deadline. Failure to sole source could result in failure to comply with congressional mandate.
