SOLE SOURCE STATEMENT

1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY: This is a Sole Source Statement. The Naval Medical Logistics Command is the contracting activity, acting on behalf of the Department of Defense (DOD) Drug Demand Reduction Program, specifically the Army Forensic Toxicology Drug Testing Laboratory (AFTDTL) Fort Meade.

2. NATURE/DESCRIPTION OF CONTRACT ACTION: This is a requirement for the award of a firm fixed priced contract on an other than full and open competition basis to Research Triangle Institute (RTI), 3040 Cornwallis Road, Research Triangle Park, North Carolina 27709-2194, for the National Laboratory Certification Program to be used by the military drug testing laboratory at Fort Meade, Maryland for maintenance of certification as required to continue performing urine testing under the Federal Workplace Drug Testing Program.

3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed acquisition is for the National Laboratory Certification Program (NLCP) to be used by the military drug testing laboratory Fort Meade, Maryland for testing civilian personnel for the presence of drugs of abuse.

Army Operation and Maintenance Fiscal Year 2016 funds in the amount of $69,600 will be used to fund this procurement action.

4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR DEMONSTRATION

OF CONTRACTOR’S UNIQUE QUALIFICATIONS: The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and FAR 13.106(b)(1), only one responsible source and no other supplies or services will satisfy agency requirements.

The drug testing laboratory at Fort, Meade, Maryland has a requirement for a National Laboratory Certification Program for the maintenance of certification as required to continue performing urine testing under the Federal Workplace Drug Testing Program.

Market research has determined that RTI is the only one responsible source and no other supplies or services will satisfy agency requirements. Pursuant to Executive Order 12564 and Public Law 100-71 (Section 503), the Department of Health and Human Services (DHHS) has been given the responsibility to establish the requirements for the Federal Workplace Drug Testing Program. To accomplish this mission, DHHS developed the Mandatory Guidelines for Federal Workplace Drug Testing Programs.

The Mandatory Guidelines were first published in the Federal Register on April 11, 1988 (53FR 11979), revised twice with the latest revision on April 13, 2004 (69 FR 19644). The last revision was implemented on October 1, 2010. The Mandatory Guidelines establish the scientific and technical standards that are used to certify the laboratories that test specimens collected by Federal agencies. When the guidelines were established, DHHS awarded a contract to develop a laboratory certification program that satisfied the requirements specified in the Mandatory Guidelines. The certification program would be titled the “National Laboratory Certification Program (NLCP)”. Substance Abuse and Mental Health Services Administration’s (SAMHSA) Division of Workplace Programs awards the NLCP contract. The AFTDTL Fort Meade is assigned, by the Department of Defense, the mission of testing specimens collected by Federal agencies under the Federal Workplace Drug Testing Program. This mission requires the AFTDTL Fort Meade to maintain certification by the DHHS/ SAMHSA’s, National Laboratory Certification Program. SAMHSA awarded RTI the contract on 26 August 2013, thus making them the mandatory source for laboratory certification.

5. SYNOPSIS OF INTENT TO SOLE SOURCE:

A sources sought notice was posted to FedBizOpps on 10 June 2016 with a closing date of 24 June 2016.

No responses to the sources sought notice were received. A Notice of Intent to Sole Source was posted to FedBizOpps on 21 July 2016 with a closing date of 26 July 2016. No responses to the Notice of Intent to Sole Source are expected.
