DETERMINATION

For

BRAND NAME SOURCE SOLICITATION - FAR 13 (≤SAT)

1. Contracting Agency: Department of Defense Education Activity (DODEA) on behalf of the Department of Defense Office of Inspector General (DoD OIG).

2. Description of Action: This is a brand-name justification for the purchase of Cellebrite Advanced Services.

3. Description of Supplies: OIG, Defense Criminal Investigate Service (DCIS) has a new requirement for

(60) Cellebrite Advanced Services (CAS) unlock action tokens. Cellebrite CAS the ability to unlock and extract forensic of data from password protected and/or encrypted mobile device using iOS, Android or other mobile operating systems.

A firm fixed price contract is planned with an estimated purchase price of The anticipated delivery date will be September 30, 2020. FY20 Operating and Maintenance (O&M) funds are available.

4. Identification of the statutory authority permitting other than full and open competition: FAR 13.106- 1(b)(1) Soliciting from a single source. (Brand Name)

5. Demonstration of Contractor’s Unique Qualifications or Nature of Acquisition Requiring the Authority Cited: Cellebrite CAS unlocks and extract forensic of data from password protected and/or encrypted mobile device using iOS, Android or other mobile operating systems. All known vendors supplying similar software for mobile device unlocking and decryption were evaluated and none were able to provide the integrated capabilities found in Cellebrite CAS.

There comparable software offered compatible advanced unlock and decryption capabilities for a limited number of Android mobile devices, however it does not offer advanced unlock capability for mobile devices with the iOS operating system. Without these advanced unlocking and decryption capabilities the software would not meet the requirements of the DCIS Investigations Division.

6. Effort to Obtain Competition: Despite every effort to seek further competition, Cellebrite CAS proprietary software has significantly reduced the ability to increase competition. Efforts to remove barriers will continue to be sought in future purchases.

7. Determination by the Contracting Officer of Fair and Reasonable Cost: The contracting officer has a reasonable expectation that the anticipated costs will be fair and reasonable based on the a comparison of prices paid for previous acquisitions and current market price for this product.

8. Description of the Market Research: Market Research was conducted searching for various commercially-available tools that allow for the forensic imaging of encrypted or locked mobile devices.

It identified similar software, however none of the software reviewed provided the ability of advanced unlocking capabilities iOS operating systems and limited ability on Android mobile devices.

11. Effort to remove barriers to/increase competition: The program office will continue to monitor the market to identify other products that can meet the Government’s needs and will recompete depending on the results of that market research.
