JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity.
Naval Medical Logistics Command (NMLC), Acquisition Management and Analytics Directorate, Code 05, 693 Neiman Street, Fort Detrick, MD 21702.
2. Description of the Action Being Approved.
Approval is requested to award a single contract to CliniComp International Inc. (CCI), on a sole source basis in support of the BUMED’s program to coordinate the necessary standardization of the enterprise’s content and configuration for the varying Modular and Functional Areas (MFAs) within the enterprise.
3. Description of Supplies/Services.
The Military Healthcare System (MHS) licenses the use of CliniComp International’s (CCI) Essentris software as the MHS’s inpatient Electronic Health Record (EHR) solution. The Services (Army, Navy, and Air Force) have identified that a lack of implementation standardization hinders the utilization of Essentris program in the enterprise. Though a “Gold Disk” set of standard notes was developed on the CCI Expert Clinical Library (ECL) Department of Defense (DOD) server, this clinical documentation was not tightly integrated with or bound to the requisite supporting flowsheets, summary screens, tracking boards, published procedures, reports and other clinical tools. Additionally, no feedback mechanism was established to bring enhancements and refinements from the Military Treatment Facilities (MTF) back to enhance the standard. Likewise, there was no process in place to distribute these enhancements throughout the enterprise. In effect, the initial program was deployed with a complete absence of coordinated content and configuration management. Without defining and developing this capability the enterprise would be forced to continue the legacy of labor-intensive, siloed development and inefficient enhancement strategies, which preclude the development of interoperable data or the sharing of enhancements. To address this need BUMED chartered and established the Essentris Optimization Program on 06 APR 11 to coordinate the necessary standardization of the enterprise’s content and configuration for the varying Modular and Functional Areas (MFAs) within our healthcare system.
Content Advisory Groups (CAG’s) were established by the Services to support the various MFA’s in this effort. To address the capability deficiencies CCI will need to (I) develop new clinical and functional tools and workflows, (2) new reporting processes, (3) enhanced status boards, and (4) deliver new ongoing capabilities designed to optimize and manage the standardized clinical content and configuration.
Estimated Dollar Value
FY15 FY16 FY17 FY18 FY19 Total Grand Total $1,171,144 $1,229,701.20 $1,291,186.26 $1,355,745.57 $1,423,532.85 $6,471,309.88
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), One source or limited sources.
5. Rationale Justifying Use of Cited Statutory Authority.
CCI is the sole proprietor of the Essentris software and hardware. To meet the afore-stated requirements will require both (1) internal system level access to CCI's and MHS's Essentris servers and (2)
Page 2 of 3 Source Selection Information – FAR 2.101 and 3.104 authorization to utilize proprietary configuration tools and files that are only accessible to internal CCI personnel in order to implement the requisite software modifications and business process changes.
Currently, no other vendor(s) or contractor(s) outside of CCI possess the necessary authorizations, permissions, and access required for the success of this project proposal.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
This requirement will be synopsized on Federal Business Opportunities (FEDBIZOPPS), pursuant to Part 5 of the Federal Acquisition Regulation, indicating the Government’s intent to award a five year contract on a sole source basis to CCI. A Sources Sought notice was publicized on 4 February 2015. Nine responses were received that included capabilities statements. The capability statements resulted in none of the potential candidates being capable of providing the required services. A Sole Source Intent notice was posted on 16 April 2015 with a closing date of 30 April 2015. If another company submits a written interest in this requirement as a result of the announcement, the company’s information will be evaluated before the contract is awarded to CCI.
In researching the justification for this requirement, the submitter has contacted sources within the government and industry. The sources confirmed that due to the proprietary accesses and authorizations required by the nature of the work being requested, there are no other available options for contracting these services.
7. Determination of Fair and Reasonable Cost. The contracting officer will determine the anticipated cost to the Government of the services covered by this Justification & Approval for Use of Other Than Full and Open Competition will be fair and reasonable by conducting a cost analysis before an award is made.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NMLC has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, NMLC will assess whether competition for future requirements is feasible.
9. Contracting Point Of Contact.
The point of contact at NMLC is Mr. Erik Przygocki who can be reached at DSN 343-0244, commercial
(301) 619-0244 or by email at erik.j.przygocki.civ@mail.mil .
