CC16HQR003 – Trial Presentation Attachment 4 – Vendor Questions and Responses
Vendor Questions and Responses Dated 10/28/2015
Q1. Is this a follow-on requirement? If so, could you please provide the incumbent contract number for this opportunity? If not, is this a new requirement?
R1. This is not a follow-on requirement. This is a new requirement
Q2. Should the proposal list pricing based on the CLIN 0001 Trial Presentation, Consulting, Processing of Evidentiary Files, Courtroom Set-up and Presentation or broken down by Scope of Work and Requirements and then finalized by firm fixed price?
R2. The price proposal shall be based on the Contract Line Item Number as a firm fixed price. An explanation of the price proposal is acceptable.
Q3. Do you want two separate CLIN for each trial/hearing and then a total for both or do you wish to have one CLIN price which includes a price for work on both matters combined?
R3. Please provide a separate CLIN for each trial/hearing. The Government reserves the right to award multiple fixed price contracts from Solicitation #CC16HQR0003.
Q4. In prior cases, the judge has requested that the hearing transcripts, once completed, are to have the admitted exhibits embedded/linked in the PDF version of the transcript where the exhibits are referenced and that the admitted exhibits, rejected exhibits, and sealed exhibits are be included in folders on a disk that is filed with the OFIA along with the embedded/linked transcripts. This part of the project is not included in the scope of the work in this solicitation although that is normally part of the trial consultant’s duties to embedded/link the exhibits into the transcript rather than the court reporter. Do you expect that process to be part of a separate solicitation?
R4. The Government will complete if the judge requests this format.
Q5. With regard to the exhibits, will those exhibits be provided to the Contractor with the appropriate Exhibit and Page Number labels applied?
R5. Yes, the exhibit numbers will be branded onto the exhibits.
Q6. With regard to the exhibits, will those exhibits be provided to the Contractor in PDF format?
R6. A PDF and TIF format will be provided for use in the presentation system.
Q7. With regard to the exhibits, will those exhibits be provided to the Contractor with the proper orientation already applied? For example, documents that are to be read at landscape orientation but were imaged at a portrait orientation have been rotated for proper viewing in court.
R7. As a standard, the documents will be delivered in the correct orientation. However, if not, the contractor shall correct documents as stated in the solicitation.
Q8. What is the location of this additional trial/hearing?
R8. The location of the Trials are:
(a) December Trial is at U.S. Court of Federal Claims in Washington DC
(b) January Trial will be in Northern New Jersey TBD.
Q9. The synopsis states six (6) hearing days, but the range of court dates indicates it would be nine (9) hearing days. Which is correct?
R9. December Trial Dates: Trial begins Tuesday, December 15, 2015 at 9:00 am ET and continues thereafter each day from 8:30 am to 4:45 pm for 6 days if necessary. Additional days were built-in; however, the trial may take less days. January Trial Dates: Trial begins January 26, 2016 and is scheduled to February 5, 2016 for 9 days.
Q10. Would meeting in-person with OCC attorneys prior to the start of the trial still be required? And, if so, would that meeting take place in Washington DC or trial location?
R10. The Contractor shall meet with the COR, POC and trial team at OCC Headquarters at least lone week before trial to prep for trial (Listed under Place and Performance of Solicitation).
Q11. In order to insure an accurate response to the issue of conflicts, we will need to know the names of the parties and counsel. Can you provide that to me by a full case caption and/or service list?
R11. No information will be provided at this time.
