Sole Source Justification (SSJ)
Test Program for Certain Commercial items for procurements exceeding the Simplified Acquisition Threshold (> $150,000) pursuant to FAR Subpart 13.5, including Brand Name

Pursuant to the requirements under the authority of the Simplified Procedures for certain commercial items at 41 U.S.C. 1901 or the authority of 41 U.S.C. 1903 Special Emergency Authority as implemented by Federal Acquisition Regulation (FAR) Subpart 13.501 and consistent with the content requirements of FAR 6.303-2.
1. Agency and Contracting Activity.
U.S. Customs and Border Protection (CBP), Office of Acquisition (OA).
2. Nature and/or description of the action being approved.
CBP intends to award a single award Indefinite Delivery/Indefinate Quantity (IDIQ) contact to Envisage Technologies, LLC (101 W Kirkwood Ave, Suite 200, Bloomington, IN 47404-6132) without providing for competition.
The current contract with the incumbent was competitively awarded on April 1, 2013 and contained a one year base period with four one year option periods. This one year sole source contract will have a period of performance of April 1, 2018 through March 31, 2019. This contract is required to ensure continuity of service.
3. Description of Supplies/Services.
The requirement is for proprietary software licenses, help desk, and maintenance services for ACADIS to continue current software functions to operate training academies and manage legally required law enforcement training data for the Office of Training and Development (OTD), CBP; as well as the Department of Homeland Security’s component, Federal Protection Service. The software currently services 20 different academies and 700+ locations for FPS and CBP. The total estimated price is $3,397,609.64. This total price is inclusive of services and licenses for both CBP and Federal Protective Services (FPS).
4. Identification of the authority. This action is being taken under the authority of the Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901.
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
Envisage Technologies, LLC is the only vendor who provides ACADIS software; the only known law enforcement data management software written specifically to manage legally required training for law enforcement agents. ACADIS is currently being utilized to manage required training for law enforcement officers and agents for both CBP and FPS 20 academies and 700+ locations. ACADIS is the only software that currently has http://uscode.house.gov/ http://uscode.house.gov/ http://uscode.house.gov/
2-met the required DHS security requirements to be utilized by DHS components as well as to manage the training requirements for law enforcement officers and agents.
No software may be utilized by a DHS component without having required security features as designated by DHS. CBP’s ACADIS software also currently contains 10 years or more of CBP Law Enforcement Training Data as required as as required by Congress.
Envisage Technologies, LLC is the only vendor who can provide continuation of services for ACADIS software licenses, software customization, maintenance, help desk support, and travel in support of CBP and FPS as there are no resellers for this software.
ACADIS software is a law enforcement data management software to manage legally required training for law enforcement agents. ACADIS is currently being utilized to manage required training for law enforcement officers and agents for both CBP and FPS.
ACADIS is the only software that currently has met the required DHS security requirements to be utilized by DHS components as well as to manage the training requirements for law enforcement officers and agents.
The ACADIS software was developed by Envisage Technologies, LLC specifically for law enforcement agenices to manage their training academies and legally required training data. The existing software is proprietary; and only Envisage can make the modifications and provide maintenance services as no resellers are utilized to market and support ACADIS software. In order to use an alternate source, DHS would have to procure new software, software licenses, and provide training to CBP personnel responsible for using this software. Transitional services by both Envisage and the new vendor would be required to transition to a new law enforcement training data software system. A new vendor would also be required to meet the required security measures as required by DHS, a review which can currently take up to a year to obtain. As Envisage owns the source code to ACADIS, they are the only source who can provide transitional services to transport data from ACADIS to another software system. Envisage is the only company with a CBP Authority to Operate for this type of software system.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.
This sole source justification will be posted to FedBizOpps as required. The market is researched annually to determine if a comparable academy/law enforcement training management software source has become available.
7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The contracting officer will determine that the anticipated pricing will be fair and reasonable based on pricing offered on the current contract a review of the proposed costs, and the Independent Government Cost Estimate (IGCE).
8. Description of market research.
ACADIS is a the proprietary software sold by Envisage who has no authorized resellers or companies authorized to code ACADIS.
9. Any other facts supporting the justification.
This one year sole source contract will ensure that CBP OTD and FPS will meet their assigned mission to train Agents and Officers as well as maintain legally required law enforcement training data. The sole source bridge cannot be for less than one year due to the fact that a one year licencing agreement is the shortest time period offered by the vendor. Without this one year sole source contract, there will be a break in service which would impair the ability of CBP and FPS to manage the required data management for training for law enforcement Agents and Officers. This is a critical requirement as CBP is ramping up the hiring of CBP officers as directed by Congress. Without the continuation of services, CBP would not meet its’ mission to protect the US Borders, as the completion of training for new hires would be delayed significantly without a software to manage the required training.
10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.
No other source has expressed an interest in providing ACADIS software and maintenance to manage training for law enforcement officers.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required. (Include a statement of actions taken or will be taken to increase competition for future acquisitions of the same item/service).
Envisage has provided a Law Enforcement Training Management software and support to CBP (and U.S. Border Patrol, prior to the creation of CBP) since 1999. In 2012, solicitation HSBP1012R0075 was issued on a competitive basis, set aside for small business, using FAR Parts 12 and 15 procedures. Only one proposal was received.
HSBP1013D000003 was awarded to Envisage to renew ACADIS software and maintenance as a result of the solicitation.
During the one year bridge, CBP will analyse all factors associated with implementing a program shift to a different Law Enforcement Training Data system to include associated
Threshold (> $150,000) pursuant to FAR Subpart 13.5, including Brand Name
4-costs, time, and accessabiliity to archived data. A determination will be made as to whether it is in the government’s best interest to remain with the ACADIS system in the long term, or entertain other options for Law Enforcement Training Data Systems.
12. CBP intends to post the requirement pursuant to FAR 13.501(a)(1)(iii) and 6.305(a) or for brand name FAR 13.501(a)(1)(iv) and 5.102(a)(6).
13. Technical/Requirements Personnel Certification. I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
