Full and Open Competition
1. Contracting Activity: ACC-NJ-JA, Bldg. 9, Picatinny Arsenal, NJ 07806-5000
2. Description of Action: The Research, Development, and Engineering Command (RDECOM), Armament Software Engineering Center (Armament SEC), a Capability Maturity Model Integration (CMMI) Level 5 Organization requires HID maintenance for a base year plus four option years to meet biometric templating requirements of the warfighter. This will be a firm fixed price (FFP) purchase order with HID, 1550 Crystal Drive, Suite 505, Arlington, VA 22202.
An Acquisition Plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement (DFARS) 207.103(d)(i)(B).

5. Reason for Authority Cited:
a. As described at FAR 6.302-1(a)(2)(iii)(B), when services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirement.

The procurement has a unique requirement to use HID and HID because HID proprietary software does not allow any vendor or government organization to meet the requirement. Delivery requirements, distribution needs, geographic limitation / issues are not applicable.
The use of any other contractor would cause an unacceptable delay and result in failure to meet the government’s requirements.
b. Program Delays: It is estimated that if CCDC AC was required to utilize a different software program, to update all of our biometric template files and get a new software product in service, which is an unacceptable delay and would be detrimental to the program. This will severely impact CCDC AC’s ability to execute key services to the warfighter and our technological partners.
c. Analysis of Alternatives to Other than Full and Open Competition: An alternative to the current strategy is not truly possible due to the proprietary nature of the software. HID is used by the

The schedule risk of competing this requirement for another software is next to impossible for another contractor to become familiar and understand all the various components/systems. If we were forced to change software now, it

(iii) Cost Risk: Without adequate specialized resources required, Armament SEC will not be able to meet its obligations and maintain the ability to create HID proprietary “ causing operational users to fail their requirements.
(iv) Performance Risk: Currently, the Government is unable to perform the work without the support of the contract. Inability to bring the contractor on board in the near term will have significant performance risk to several ongoing efforts who will not be able to execute HID to justify and validate performance.
(v) Conclusion: Due to the nature of the HID software competition would present an unacceptable level of performance and severely impact planned services to be in place.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered.
a. Effective Competition: Because this is a sole source action, effective competition is not applicable.
b. Subcontracting Competition: HID is a large business. Subcontracting opportunities do not exist for licenses and maintenance.
7. Actions to Increase Competition: Any future procurement for this effort, full and open competition procedures will be used to the greatest extent possible, unless justified in an approved J&A.

8. Market Research: Market research has shown that HID is the proprietary, single owner, single vendor and single sustainment company capable of meeting the requirement for the warfighter that uses this specific equipment. The thoroughness of the market research was based on speaking with subject matter experts from government and industry to identify whether HID themselves or any other possible resellers of and existed. Request for Information (RFI) were posted on both CHESS and GSA. Through the research, no other resellers were able to be identified.
No existing contract vehicles are able to be leveraged. The products fall within the commercial items definition as it is customarily used by the general public and has been sold, leased, or licensed to the general public. Source selection risks are not applicable as the products must be procured from a single source. Specific contract terms of the software maintenance are described in HID purchase invoices. The government is one buyer of these products among many and it is cost prohibitive to purchase data rights to the software and / or purchase custom software development from HID to ensure a specific software baseline that would need to be maintained separately is able to be procured. The acquisition strategy to be used is only to directly contract with HID, a large business because they are the only entity able to meet the requirement.
