About this file

This document is a justification for other than full and open competition regarding a solicitation for Milestone Systems software and Axis Communications video surveillance equipment. The Bureau of Reclamation's Denver Security Office needs to upgrade security cameras and hardware at multiple facilities using Axis Communications equipment and Milestone Systems software, which are fully compatible and compliant with security standards. No other products meet requirements due to proprietary integration between the hardware and software. The solicitation will be set aside for small businesses and issued via open market procedures given limited responses under existing contract vehicles. Interested vendors must be certified resellers of the brand name products. Delivery within 120 days is required.

41 U.S.C. 1903 FAR 13.501 Special emergency procurement authority

41 U.S.C. 3304(a)(1) FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements

41 U.S.C. 3304(a)(1) FAR 6.302-1(c) Application for brand-name descriptions

41 U.S.C. 3304(a)(2) FAR 6.302-2 Unusual and compelling urgency

41 U.S.C. 3304(a)(3) FAR 6.302-3 Industrial mobilization; engineering, developmental or research capability; or expert services

5. Demonstration of Contractor’s Unique Qualifications (FAR 6.303-2(b)(5)).

The listed equipment is used widely across Bureau of Reclamation facilities including Folsom, New Melones, ECAO, Yakima, Hoover, and more than ten existing Milestone video recording systems. All communication between the software and hardware is proprietary; there are no other products that are compatible.

Axis Communications works closely with Milestone Systems, Milestone is the common video surveillance recording system across Reclamation facilities, to ensure that all their cameras and hardware fully compatible with Milestone. Axis is currently the only camera manufactures that is fully compliant with the John S. McCain National Defense Authorization Act. Use of any other cameras could cause a lapse in security due to lack of training and knowledge along with extensive cost to obtain training and changing current systems to support other hardware at Reclamation facilities. It’s estimated that it would cost more than $10,500,000.

Milestone has an agreement with Lenel security systems that allows it to fully integrate for seamless security applications. No other video recording system has this agreement or capability. An estimate to change the current systems to support other hardware at Reclamation facilities is more than $12,000,000.

6. Description of efforts made to maximize competition (FAR 6.303-2(b)(6)).

This requirement will be a Name Brand Only as there are no equal hardware of software that will meet the agency’s needs. Market research was conducted and coordinated with the customer who has extensive knowledge of the hardware & software and vendors are required to be certified authorized resellers of Axis and Milestone hardware of software.

In order to maximize competition, this requirement will be solicited as open market as none of the vendors on NASA SEWP indicated they could provide both the Axis and Milestone hardware and software and the vendors that did respond to a sources sought notice indicated they do not have many of the items on their GSA schedules.

7. Determination of Fair and Reasonable Cost (FAR 6.303-2(b)(7)).

The program office received a quote directly from Milestone for the hardware and software and since vendors need to be certified resellers of Milestone & Axis it is expected that pricing will be similar. A price evaluation will be required, and the Government will ultimately decide based on the evaluation that the total price is fair and reasonable.

8. Description of Market Research Conducted (FAR 6.303-2(b)(8)).

A search was conducted via NASA SEWP for Milestone & Axis hardware and software, and no vendors could be located that listed both Milestone & Axis on their schedules. A sources sought notice was posted to NASA SEWP and only one vendor expressed an interest in providing all the required equipment.

A search on GSA eLibrary using NAICS code 334310 – Audio and Video Equipment, resulted in 69 small business contractors. A sources sought notice was emailed to all 69 vendors. Eight responses were received from the sources sought: 1 vendor indicated they could not provide the required items, another vendor indicated they could only provide the Axis items, and the 6 other vendors indicated they could provide all items; however, they did not have all items listed on their GSA schedules and would have to provide an open market quote.

Due to the responses to the sources sought notice posted to NASA SEWP and the GSA contract holder, this requirement will be solicited open market, small business set aside.

9. Any Other Supporting Facts (FAR 6.303-2(b)(9)). N/A

10. Listing of Interested Sources (FAR 6.303-2(b)(10)).
