Combined Synopsis/Solicitation

This is a combined synopsis/solicitation for commercial supplies prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

Solicitation number 140R1024Q0039 is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-05 dated May 22, 2024.

This is a Hubzone Business set-aside under North American Industry Classification System (NAICS) code 115310 with an associated small business size standard of 11.5 million employees.

It is anticipated that a firm-fixed-price purchase order will be awarded on a competitive basis as a result of this combined synopsis/solicitation for seeds by Columbia Pacific Northwest Region (CPNRO) Office.

DIAR 1452.201-70 AUTHORITIES AND DELEGATIONS (SEP 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award.

The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.

Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph

(d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

(d) Comptroller General Examination of Record. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(a) Definition. As used in this clause–

Commercial and Government Entity (CAGE) code means–

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or

a) Performance of the work under this contract shall be subject to the technical direction of the Reclamation Contracting Officer's Representative (COR). The term "technical direction" is defined to include, without limitation: (1) Inspecting and accepting or rejecting work performed under the contract. (2) Representing the Government in technical phases of the work. The COR is responsible for the technical administration of the contract and will provide instructions and interpretations to the Contractor on all technical matters relating to the contract. The COR will supervise or oversee all Government technical and administrative personnel assigned to assist the COR. (3) Reviewing and, where required by the contract, approving submittals of technical data, shop drawings, samples, literature, plans, or other data required to be delivered by the Contractor to the Government. (b) The Contractor will receive a copy of the written COR designation from the Contracting Officer. It will specify the extent of the COR's authority to act on behalf of the Contracting Officer.

(c) Technical direction must be within the scope of work stated in the contract. Only the Contracting Officer is authorized to determine if a change is within the scope of the contract; therefore, the COR does not have the authority to, and may not, issue any technical direction that - (1) Constitutes a direction of additional work outside the Contract requirements; (2) Constitutes a change as defined in the contract clause entitled "Changes;"

A. Description of Work

Purpose: The US Bureau of Reclamation (BOR), Columbia Pacific Northwest Regional Office (CPN) is restoring rangelands burned by wildfire. This seed contract is for a seed mix that will be broadcast during the dormant season. Seed dispersal will take place as soon as possible, After Receipt of Award (ARO).

The seed is needed as early as possible to achieve the desired planting dates and anticipated results. Please provide origin of seed and overall price quote for entire mix, but also quote prices per PLS pound for each species.

B. Schedule of Items/Price Schedule

1. Please complete attached Excel spreadsheet titled “Schedule of items.”

2. Potential Contractors may quote on all or a portion of the items; Breakdown costs by individual species, indicating price per pound. Preference will be provided to Contractor who can provide most items, if not all.

3. All seeds are to be combined and quote is to include mixing cost of all seed.

II. Seed Specifications

A. Seed Source and Quality

All seed materials shall conform to the following requirements:

1. Any seed received by the US Bureau of Reclamation (BOR) Columbia Pacific Northwest Regional Office (CPN) that does not meet these specifications will be rejected and returned at the Vendor's expense.

2. All seed shall be guaranteed by the Vendor to be true to genus/species name and variety.

3. All seed offered must meet all requirements of the Federal Seed Act (FSA) (7 U.S.C. §. 1551-1610 incl.) and the seed laws of the states of Arizona, California, Colorado, Idaho, Nevada, New Mexico, Montana, Oregon, Utah, Washington, and Wyoming, as applicable.

4. Seed must be of current 2023 crop. Crop year 2022 seed will be acceptable with current and adequate Pure Live Seed (PLS) documentation and prior notification to Project Manager.

5. Seeds must be of appropriate provenance, wild origin and source must be from:

a) Central or southeast Washington State (Columbia River basin, Columbia River plateau, Snake River basin);

b) North-central Oregon (Columbia River basin, Columbia River plateau);

c) Northwest Idaho, British Columbia (Columbia River basin, Columbia River plateau, Snake River basin).

6. The BOR will consider seed sourced outside of this area on a case-by-case basis. Vendor must receive prior approval for seed source if outside of the above-described seed provenance.

7. All seed shall meet the following PLS and quality requirements:

a) All species are being requested on a PLS basis. PLS shall be defined as (purity) x (total germination). Total germination is defined as (germination + hard seeds + dormant seeds).

Tetrazolium Chloride (TZ) can be substituted in lieu of germination if necessary.

b) Vendors must indicate in their response if their seed is not available on a PLS basis. Copies of original seed tests from independent seed testing laboratories must be attached to the exterior of or included with seed packaging when received by the BOR.

c) Preference will be given to PLS seed over "bulk" seed. Thus, the BOR highly encourages all Vendors to submit offers for PLS seed.

d) Any seed that is not available by Vendors as PLS must still be tested for purity. The pure weight must total the amount ordered, with additional seed being supplied to meet 100% purity by bulk weight (e.g.: 1.11 bulk pounds at 90% purity equals 1.00 pure pounds).

e) Species with seed that loses viability rapidly after ripening must be stored at appropriate temperatures to maintain viability prior to delivery.

f) No substitution of species will be accepted except through prior written agreement by Project Contact.

B. Debearding and Cleaning Requirements

1. All "bearded" or "fluffy" species are requested on a de-fluffed/de-bearded (pappas removed) basis.

Vendor must indicate in their response if their seed is not available on a de-fluffed/de-bearded basis. It is requested for seed to be de-fluffed/de-bearded, so it is flowable through a seed drill designed for planting native range seed.

2. All seed shall be cleaned so that no stems or debris longer than ¾ inch remain unless stated otherwise in these specifications. Awns removed from seeds shall be cleaned out of the seed.

3. Bottlebrush Squirreltail: Debearding – seed shall be processed and cleaned so that a minimum of 90% of the individual seeds have less than 1/8” in length of the awn remaining. The remaining 10% of the seeds shall have awns less than ½” in length.

4. Needle and Threadgrass: Debearding – Needle and Thread seed shall be processed, and awns cleaned so that a minimum of 90% of the individual seeds have less than 1/8” in length of the awn remaining. The remaining 10% of the seeds shall have awns less than ¼” in length.

5. Fourwing Saltbush: Cleaning - Fourwing seed shall be dewinged and cleaned.

6. Winterfat: Cleaning: Winterfat seed shall be cleaned of all stems and other debris to pass through a 5/16-inch mesh screen.

C. Seed Inoculation and Seed Treatment

1. BOR requests all legume species to have the appropriate inoculants supplied with seed, if possible.

2. All alfalfa seed shall be inoculated with an inoculant specifically manufactured for alfalfa and shall be applied as specified by the manufacturer. Shelf life of the inoculant shall be a minimum of 12 months from delivery of inoculated seed. All seed bags shall be tagged with the name of manufacturer and expiration date of inoculant.

3. A Safety Data Sheet (SDS) is required upon delivery of any seed which has been treated with an inoculant or any type of coating.

4. If seed other than alfalfa and other legume seed is inoculated or coated with treatments of other kinds, that seed can be offered, but the inoculant must be identified and a SDS or a product data sheet must be submitted with the bid. This inoculant or seed treatment must be identified in the offer and can be a factor in the selection.

III. Packaging and Delivery

A. Packaging

1. Packaging for all species shall be clearly labeled on the outside of the bag with the following information:

a) Scientific name (genus/species);

b) PLS value, PLS weight, and bulk weight;

c) Pure weight and bulk weight if seed is not available as PLS;

d) Proper documentation of seed tests must be attached or included with the packaging for all species at time of seed delivery;

e) Year of seed production.

2. All seed bags shall be sound, clean, and made from standard poly or woven sacks of similar strength and characteristics. Burlap bags will not be accepted. If the seed is treated with a chemical, then a lined paper bag is the only accepted packaging with special markings and Safety Data Sheet information. ANY

BAGS RECEIVED WHICH ARE NOT SOUND WILL BE REJECTED, AND MUST BE REBAGGED

(to the exact pounds/bag specified above), BY THE VENDOR, OR REPLACED. Needle and Thread grass seed shall be double bagged.

3. The weight of the actual bags shall not be included in the stated weight of the seed delivered.

4. The lot number for all seed shall be marked on the bag (stenciled or marked with indelible ink).

B. Delivery

1. All seed shall be delivered in 50 pound bags except for:

a) 40 pound bags: Sagebrush

b) 25 or 50 pound bags: all forbs

c) Other “fluffy” seed as determined on case-by-case basis.

2. NO DEVIATIONS IN BAG SIZE WILL BE ACCEPTED UNLESS NOTED ABOVE.

3. All seed and accompanying seed test documentation as outlined above are requested as early as possible. Delivery of seed is to be coordinated with Project Manager, prior to shipping. Indicate freight carrier that is being used and tracking number. There shall be no seed delivered to or received by the BOR on weekends or holidays.

4. Delivery of seed shall be arranged with POC provided upon award.

5. All deliveries of seeds shall be packaged and delivered to ensure the viability of the seed material upon delivery to the BOR. All seed shall be packed and covered in such manner as to insure adequate protection against leakage, damage, rodents and to maintain dormancy while in transit.

6. All delivery/shipping costs shall be integrated into the seed per lbs. itemized cost. Separate shipping/delivery cost shall NOT be allowed.

Seeds must be of appropriate provenance, wild origin and source must be from Central or southeast Washington State (Columbia River Basin, Columbia River plateau, Snake River Basin); North-central Oregon (Columbia River basin, Columbia River plateau); and Northwest Idaho, British Columbia (Columbia River basin, Columbia River plateau, Snake River basin).

The BOR will consider seed sourced outside of this area on a case-by-case basis. Vendor must receive prior approval for seed source if outside of the above-described seed provenance.

DIAR 1452.215-71 USE AND DISCLOSURE OF PROPOSAL INFORMATION -- DEPARTMENT OF

THE INTERIOR (APR 1984)

(a) Definitions. For the purposes of this provision and the Freedom of Information Act (5 U.S.C. 552), the following terms shall have the meaning set forth below:

(1) "Trade Secret" means an unpatented, secret, commercially valuable plan, appliance, formula, or process, which is used for making, preparing, compounding, treating or processing articles or materials which are trade commodities.

(2) "Confidential commercial or financial information" means any business information (other than trade secrets) which is exempt from the mandatory disclosure requirement of the Freedom of Information Act, 5 U.S.C. 552. Exemptions from mandatory disclosure which may be applicable to business information contained in proposals include exemption (4), which covers "commercial and financial information obtained from a person and privileged or confidential," and exemption (9), which covers "geological and geophysical information, including maps, concerning wells."

(b) If the offeror, or its subcontractor(s), believes that the proposal contains trade secrets or confidential commercial or financial information exempt from disclosure under the Freedom of Information Act, (5 U.S.C. 552), the cover page of each copy of the proposal shall be marked with the following legend:

"The information specifically identified on pages of this proposal constitutes trade secrets or confidential commercial and financial information which the offeror believes to be exempt from disclosure under the Freedom of Information Act. The offeror requests that this information not be disclosed to the public, except as may be required by law. The offeror also requests that this information not be used in whole or part by the government for any purpose other than to evaluate the proposal, except that if a contract is awarded to the offeror as a result of or in connection with the submission of the proposal, the Government shall have the right to use the information to the extent provided in the contract."

(c) The offeror shall also specifically identify trade secret information and confidential commercial and financial information on the pages of the proposal on which it appears and shall mark each such page with the following legend:

"This page contains trade secrets or confidential commercial and financial information which the offeror believes to be exempt from disclosure under the Freedom of Information Act and which is subject to the legend contained on the cover page of this proposal."

(d) Information in a proposal identified by an offeror as trade secret information or confidential commercial and financial information shall be used by the Government only for the purpose of evaluating the proposal, except that (i) if a contract is awarded to the offeror as a result of or in connection with submission of the proposal, the Government shall have the right to use the information as provided in the contract, and (ii) if the same information is obtained from another source without restriction it may be used without restriction.

(e) If a request under the Freedom of Information Act seeks access to information in a proposal identified as trade secret information or confidential commercial and financial information, full consideration will be given to the offeror's view that the information constitutes trade secrets or confidential commercial or financial information.
