DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: TBD

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 12, Great Lakes Acquisition Center (GLAC), on behalf of the Jesse Brown Veterans Affairs Medical Center (JBVAMC), 820 S. Damen Avenue, Chicago, IL 60612. This is a justification for Other than Full & Open Competition. Purchase Request: TBD.

2. Nature and/or Description of the Action Being Processed: Sole source Intensive Care Unit (ICU) Registered Nurse Services contract to SolVet Services, LLC, 345 Doucet Road, Suite 230, Lafayette, LA, 70508. The resultant contract will be a firm-fixed price contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The JBVAMC requires two Registered Nurses (RNs) to work in both COVID and Non-COVID ICU and/or step down areas. Staffing services are required 24-hours a day, seven (7) days a week, including weekends and federal holidays.

The base period of performance is for six months, with one option to extend for another three months. Performance is requested to begin as soon as possible.

4. Statutory Authority Permitting Restricted Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by Federal Acquisition Regulation (FAR) 6.302-5 (Authorized or Required by Statute).

contracting officers (CO) may use the non-competitive (sole source) procedures authorized in VA Acquisition Regulation (VAAR) 819.7007 or 819.7008 up to $5,000,000.00. Check the specific VAAR clause used below:

(X) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business; or ( ) 819.7008 Sole source awards to a verified veteran-owned small business

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above: The authority above allows sole source awards to Service Disabled Veteran Owned Small Businesses (SDVOSB) based on 38 U.S.C. 8127(c). SolVet Services, LLC is a SDVOSB concern that has been determined to be a responsible source with respect to performance. Additionally, SolVet Services, LLC meets eligibility requirements in 819.7003.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The CO considered other vendors that had provided similar services in the past, and determined that soliciting SolVet Services, LLC is in the best interest of the Government as it is an economically sound, timely, and practicable method of meeting the Government’s needs.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The anticipated cost will be fair and reasonable based on comparison of pricing to other firms, market rates, and the Independent Government Cost Estimate.
