The final task order issued against contract VA251-15-D-0009 ends on 03/30/2021. The resulting contract will be a firm-fixed price, indefinite delivery, indefinite quantity (ID/IQ) contract.

3. Description of Supplies/Services : This procurement is for a Community-Based Outpatient Clinic (CBOC) for providing Primary Care and Mental Health Services in a private hospital, office or clinic environment. The CBOC will provide services to veterans primarily residing in Sanilac County; Macomb County; and St. Clair County, Michigan. The CBOC shall be located around the vicinity of Yale, Michigan. The Parent Facility for this CBOC is the John D. Dingell VAMC (JDDVAMC) in Detroit, Michigan. Unless otherwise noted, hereafter within this document, singular terms

Contractor shall provide a community-based outpatient clinic solely dedicated to veterans. The hours of operation for services rendered will be Monday Friday from 8:00 am to 4:30pm, with one weekday clinic extending to 6:00pm as well as one Saturday clinic per month. The extended weekday clinic and monthly Saturday clinic will be determined by JDDVAMC.

5. Demonstration that the C Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The proposed awardee is the incumbent and has an established facility, staff, and all other required materials/qualifications to continue providing the services required. Award to another contractor would require substantial lead time for buildout, hiring, background checks, and other requirements to ensure full performance of the contract. Accordingly, McLaren Port Huron is the only firm capable of providing the services described in Section III above without the Veterans Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to the reasons explained in Section V above, no efforts were made to solicit offers from other than the incumbent. RFP 36C25019R0129 has been drafted and is being submitted to the Medical Sharing Office (MSO) for approval to solicit. The solicitation is for a long-term solution for a five-year contract. Market research was performed for the long term procurement and the acquisition will uti lize full and open competition due to a lack of small business competition. The anticipated issue date of the long-term solicitation is June 30, 2021 and award of the long-term contract is anticipated by September 26, 2021.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Pricing will be evaluated and determined fair and reasonable prior to award.

Fair and Reasonable Pricing is expected to be established based on historical pricing.

However, if needed, the Contracting Officer will use any of the other price analysis techniques identified in FAR 15.404-1(b) to determine the price reasonableness.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Used the VIP database to identify verified capable SDVOSBs and VOSBs. In accordance with VAAR 810.001-70, the CO queried the VIP Database on 03/15/2021. NAICS 621498. No results were identified No other market research was conducted due to the reasons explained in Section V above. Based on market research, the CO has a reasonable expectation that offers/quotes will not be received from at least two capable SD/VOSB concerns. Based on market research, the CO does not have a reasonable expectation that award can be made at a fair and reasonable price offering best value from an SD/VOSB concern. The VA Rule of Two has not been met for this requirement.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A follow-on RFP, 36C25019R0129, is currently being drafted for review by MSO.
