OKLAHOMA CITY AIR LOGICTICS COMPLEX (AFMC)

TINKER AIR FORCE BASE OKLAHOMA

SUBJECT: Sole Source Justification for Serv M21-042 Bruker Optics Tensor Spectrometer

1. The Contractor shall provide all labor, tools, equipment, test equipment, material, quality control, transportation, and inspection manuals necessary to perform annual Platinum Maintenance Service Agreement on one (1) Bruker Optic Tensor 27 Fourier Transform Mid-Infrared Spectrometer & HYPERION 2000 microscope at the Oklahoma City-Air Logistics Complex (OC-ALC).

2. 76 MXSS/MXDTAA provides day on-call support of compressed breathing air quality IAW T.O.

42B-1-22 with the Bruker Optics Tensor Spectrometer. The equipment supports USAF investigation of polymer, solids, liquids, and gas samples. OBCA reached out to the original equipment manufacturer (OEM), Bruker Scientific LLC, on 28 February 2021 to verify if they are the sole vendor capable of providing the requested services or if they possess any other contractors that are able to satisfy this service requirement. The OEM stated that they are the only company authorized to service the equipment and that if any other service provider were to service the equipment, all warranty and service contract coverage would become void.

3. Market research was performed reviewing Dynamic Small Business Search and System for Award Management databases using North American Industry Classification System Code 811219 looking for companies that could provide a 5-year Preventive Maintenance contract for the Bruker Optics Tensor Spectrometer. A review of small businesses to include 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide a preventive maintenance contract for the Bruker Optics Tensor Spectrometer. In review, due to the proprietary data rights that the OEM possesses, OBCA recommends that this requirement be purchased through sole source acquisition procedures to Bruker Scientific LLC.

4. In the future, the Government will continue to monitor the market to find both small and large businesses that are capable of providing the requested services as outlined in the performance work statement. Market research for this requirement is ongoing.

5. I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
