About this file

This document is a Sole Source/Brand Name Justification for the procurement of a Skydio unmanned aerial systems (UAS) platform and corresponding software under the Simplified Acquisition Threshold. The Naval Surface Warfare Center Carderock Division intends to award a firm fixed price contract for these items on a brand name basis. The justification explains the absence of competition for this acquisition, as Skydio is the only manufacturer able to meet the Navy's strict flight compliance and vetting requirements for American-made UAS platforms. The estimated cost of the procurement is approximately and the estimated delivery date is August 29, 2024. The justification cites Skydio's extensive history providing UAS solutions to the U.S. Navy and DoD, as well as the risk of utilizing a different UAS company that may not meet mission requirements and would incur additional costs to attempt flight clearance.

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 3 Template Effective February 2023

MEMORANDUM FOR FILE

FROM:

CODE: 882

TO: Code 02 SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &

Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE

NSWCCD Code 882 requires an unmanned aerial systems (UAS) platform and corresponding UAS software to support multiple needs from sponsor

MANUFACTURER: SKYDIO COMPUTER COMPANY

3000 Clearview Way, San Mateo, CA 94402 POC: Orderadmin@skydio.com

Based upon initial market research, the estimated cost of the procurement is approximately and the estimated date of delivery is AUGUST 29,2024

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Skydio has an extensive history of providing UAS solutions to the United States Navy and DoD. Our group requires a UAS platform as well as the software that manages and controls it. The platform meets very specific sponsor requirements for experimentation in the realm of warfighter research.

A market survey was performed, checking other UAS platform providers, however they do not meet Navy requirements for flight compliance and vetting for American-made UAS platforms. Chinese companies control 70-80% of the drone production market, putting the United States at an enormous disadvantage in purchasing UAS platforms that will contain any form of Chinese Spyware. Skydio has filled the manufacturing gap by consistently providing reliable UAS platforms for defense, public safety and energy utilities. It is the only company able to meet strict DoD flight clearance requirements for the needed experimentation and manufactured in the USA. Utilizing a different UAS company would not only run the risk that the platform will not meet the mission profile, but also incur the extraneous costs of at least $35,000 in labor to attempt to attain clearance, which is not guaranteed and in fact unlikely.
