About this file
This document is a brand name justification for the procurement of an EXFO Optical Loss Test Set from the Department of the Navy Naval Sea Systems Command. The justification specifies that the EXFO MAX-945-NAV-M2042-UNIT is required to establish a remote feedback loop for calibrating other EXFO OLTS and ORLM units used across multiple Calibration Labs. No other brand would meet the requirement of providing the necessary remote feedback loop. Procurement of another brand would delay the Navy's GPETE program efforts by at least one year and require repurchasing all related equipment and components at an estimated additional cost of millions.

2 | 4 between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value).]
FAR 16.505(b)(2)(i)(D) It is necessary to place an order to satisfy a minimum guarantee.
3. Rationale Justifying Use of Cited Regulatory Authority.
a.) The Items Described in Paragraph 1 Must Be Compatible In All Aspects
(Form, Fit And Function) With Existing Systems Presently Installed.
b.) A Patent, Copyright, or Proprietary Data Limits Competition.
c.) The Items Described in Paragraph 1 are Direct Replacements
Parts/Components for Existing Equipment.
d.) Foreign Military Sales (FMS) Supported By A Case Letter.
e.) Unusual and Compelling Urgency.
f.) Other: If required, discuss any other rationale that supports the use of a brand name/sole source for this effort.
4. Implication of Procuring another Brand/Manufacturer.
a.) Unacceptable Delays in Fulfilling the Agencys Requirements.
This item is required at multiple Calibration Labs. The Model MAX-945- NAV-M2042-UNIT is a Fiber Optical Loss Test Set (OLTS) and Optical Return Loss Meter (ORLM) that provides the labs with a lab asset that will be set up to Standards and equipment to establish a remote feedback loop when calibrating other EXFO OLTS and ORLM units.
No other brand will meet the requirement of providing the necessary remote feedback loop for calibration other than the EXFO MAX-945-NAV-M2042-UNIT.
This unit communicates and recognizes only units made by the same manufacturer.
3 | 4 b.) Substantial Duplication Of Cost To The Government That Is Not Expected
To Be Recovered Through Competition.
c.) Other: If required, discuss any other implication of procuring another brand/manufacturer.
5. Actions to Remove Barriers to Competition.
CERTIFICATION
I certify that the facts and representations under my cognizance, which are included in this justification and its supporting data/documentation, are complete and accurate to the best of my knowledge and belief.
Procurement of any other optical loss test set/return loss meter would not work with the proprietary communication protocol of the MAX-945-NAV-M2042-UNIT.
The is being deployed to the fleet by the GPETE program to check lines on ships and submarines. It is expected that there will be more in use over the next few years. In addition, this Unit has proprietary internal software and communication protocol that limit the to use only the EXFO model to create the feedback loop required in calibration. In order to calibrate these OLTS they need to be in a feedback loop setup; the unit under test (UUT) on one end of a line, the second on the other end of the line.
Procurement of another brand would be a waste of funds, it would delay the GPETE programs efforts a minimum of one year, and would require the re-purchase of all program-related equipment and components, estimated to cost , to meet the new brands calibration standards.
For the reasons set forth in paragraphs 3 and 4 of this Justification, the Corona Division has no plans at this time to compete future contracts for the type of supplies/ services covered by this document. If another potential source emerges, the Corona Division will assess whether competition for future requirements is feasible.
