3. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1), as implemented by 6.302-1(c) Only one responsible source and no other supplies or services will satisfy agency requirements.
4. Identification of the justification rationale. The acquisition is being conducted under the procedures of Federal Acquisition Regulation FAR 13.106-1(b)(1)(i) – Soliciting from a single source. The justification rationale for restricting competition is that Foster+Freeman is the only manufacturer of the automated FLS feature on its flashlights. This features automatically selects the corresponding image filter to optimize evidence visualization. There are no other products that will meet the full capabilities of the Foster+Freeman crime flashlights. .
5. Description of the item or service required, statement that the requested material or service represents the minimum requirements of the government, the estimated cost, and required delivery date or performance period.
Crime-lite AUTO:
The unit integrates the camera, wavelengths and filters needed for processing. Providing complete portability and ease of use for a single operator, the Crime-lite AUTO is an essential tool for criminal investigators and includes all of the technology required to reveal evidence including body fluids (semen, saliva, urine, etc.); blood on dark fabrics; fingerprints; gunshot residues; and traces of physical evidence (glass, fibers, hairs, bone, teeth, etc.). It is used in the documentation of bruising and gunshot residues. The Crime-lite Auto is designed to streamline the workflow to a single operator where previous units require multiple personnel. The Crime-lite Auto differentiates itself from every other FLS by automatically selecting the corresponding imaging filter to optimize evidence visualization. No other unit researched has this capability. All-in-one Camera/Light Source/Filters • UV-VIS-IR 20 MP camera • Up to 55x illumination wavelengths • Motorized filter wheel • Large video display - No goggles necessary • Non-proprietary Makita battery • AC mains/car adaptors available • Multi-light selection available • Capture and enhance images

This kit includes individual rectangular, high-powered flashlights that are ultraviolet (UV), violet, blue, blue-green, and green, and all necessary safety goggles and camera filters to be able to filter the input light and visualize resulting light indicative of the presence of evidence. As this kit does not include a needed infrared (IR) light, the IR light included on the quote, is purchased separately from the 82S kit.
Replacement lights:
One NCIS 82S kit is missing three needed lights, which are included on the “replacement kit” quote:
blue, UV, and IR.
Estimated Cost: Delivery Date or Period of Performance: Mid-May
6. Specific characteristics of the material or service that limit the availability to this/these source(s) (unique features, function of the item, etc.). Describe in detail why only this/these suggested source(s) can furnish the requirements to the exclusion of other sources. Provide a description of the market research conducted among schedule holders.
Foster & Freeman is the only US-based company that manufactures an automated FLS. They manufacture the NCIS FLS already in use agency-wide. It is important for continuity of scene investigative procedures and agency training that investigators utilize the same gear at NCIS offices globally. OFS has set up an advanced training course for the NCIS Major Case Response Teams (MCRTs) agency-wide to be able to use and train on the same equipment. This is important for agency interoperability as SAs move and change locations and disciplines throughout their careers.
The advantages of an automated FLS over a kit containing individual hand-held FLS flashlights is that the Crime-lite Auto kit is substantially smaller and lighter than the Crime-lite 82S. Portability is important for OFS FCs who must travel CONUS and OCONUS in support of investigations, already carrying heavy gear to include a camera, 3D laser scanner system and accessories, and other specialty scene processing kits. The Crime-lite Auto, while more expensive than the 82S kit, provides greater utility due to ease of use and transport.
Product research in support of making additional Crime-lite 82S purchases includes that OFS maintains 11 current 82S kits, which all utilize the same Makita battery and charging system, which can be relied upon for future gear compatibility. This is in addition to maintaining interoperability with use of the FLS itself and requisite training required for its use.
OFS conducted open-source internet-based research on the availability of competitors and the FLSs they manufacture. Competitors include, but are not limited to the following vendors, provided directly by the vendor, or through larger resellers:
• Horiba-SPEX
• Rofin
• FoxFury
• Lumatec Of these vendors, only Lumatec sites having a multi-spectral device available for purchase. Lumatec is a Europe-based vendor, who does not have a US-based distributor.
