About this file

This document is a Brand Name Justification for the simplified acquisition of 12 Colt M4 Carbine Enhanced Patrol Rifles, Model CR6921-ERP, for Valley Forge National Historical Park. The approximate cost is $$$$$. The justification explains that the Colt brand name rifle is essential because it meets the strict National Park Service qualifications for law enforcement patrol rifles, while other similar rifles do not. The park currently uses a mix of aging M16A2 and M16A1 rifles that need to be replaced. The additional 3 rifles requested will cover seasonal law enforcement officers and projected future full-time employees. The Contracting Officer has certified that the Colt brand name is essential and the anticipated price will be determined fair and reasonable.

The related federal contract opportunity is Solicitation Number 140P4224Q0096 for the VAFO PATROL RIFLES, issued by the Department of the Interior National Park Service Northeast Region. The solicitation is for the purchase of the patrol rifles described in the Brand Name Justification.

BRAND NAME JUSTIFICATION

SIMPLIFIED ACQUISITIONS

OVER $2,500 AND UNDER $250,000

Date: 07/21/2024 PR Number: 0040665477 To be filled in by contracting officer

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

Park seeks to purchase a 12 Colt M4 Carbine Enhanced Patrol Rifles, Model CR6921-ERP.

Approx. Cost is $$$$$.

2. Brand Name Justification rationale: The particular brand name, product, or feature is essential to the Government's requirements, and market research indicates other companies' similar products or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs.

Explain below:

Valley Forge National Historical Park currently has nine patrol rifles for field use by full time employees. The rifles are a mix of M16A2 rifles manufactured by FN for the NPS in the early 2000s and US Military Surplus M16A1s manufactured by Colt. These rifles are heavily used and worn. The cost to repair or rebuild these rifles exceeds the costs of replacement.

Currently VAFO has a nine M16 rifles for field use. The additional 3 rifles requested take into account Seasonal Law Enforcement Officers and projected future full time employees.

The Colt brand name rifle must be purchased because it’s the only rifle, that meets the strict guidelines of the National Park Service qualifications to be considered a law enforcement rifle.

Other brands similar but they fail to meet the specifications needed by the park. Purchasing similar rifles, would be outside the guidelines of the park, and mostly importantly will not be able to be used as law enforcement patrol rifles.

3. Market survey. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest):

Market research is not required for acquisitions under $250,000

If this is a determination for brand name justification, the Contracting Officer certifies:

a. The particular brand name, product, or feature is essential to the Government's requirements, and market research indicates other companies' similar products or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs.

b. The anticipated price will be determined fair and reasonable using standard price analysis techniques described in FAR Subpart 15.
