Please explain:

MDF Technologies has partnered with NOVA to assist with Military Type Packaging and repair estimates. NOVA encourages USCG to contact MDF directly when seeking all RFQ’s for orders. The parts are both repaired & manufactured by NOVA, but all Quotes, RMA’s, and / or packaging needs are addressed by MDF Technologies. MDF Technologies is the only Partner Company that’s approved to assist the OEM (Nova Power) with Solicitations for both Buys and Repairs.

The CG does not possess technical design data, tolerances, and other information needed to evaluate alternate parts from other sources. To ensure all parts purchased / repaired meet the systems configuration requirements, and their integrity remains during transport between vendors, only the OEM or a vendor recognized by the OEM as an Authorized Distributor / Repair Facility may provide / repair the specified parts above. If the vendor is not a recommended source or Partner of the OEM, the interested party (Bidding Party) MUST provide documentation direct from the OEM showing they are an Authorized OEM Distributor / Repair Facility in order to be considered for award.

Both Nova Power / MDF Technologies have advised they will not be responsible for any damages / issues caused by repairs / buys from non-authorized distributors or repair facilities. Due to this, CG will NOT utilize any other Repair Facilities or Distributors unless they have documentation from the OEM stating they are approved by the OEM to either Distribute or Repair Nova Power UPS.

Having repaired / supplied Nova Power UPS for other Government Agencies and / or CG Agencies previously cannot be used as a justifiable factor to be considered for award. The requested documentation is a requirement and required for the bidding party / vendor being considered for award.

If the answer to No. 4 is “no” please indicate other reasons for restricting competition.

In accordance with Commandant Instruction 4130.6B COAST GUARD CONFIGURATION MANAGEMENT MANUAL, it is very important to maintain cutter configuration. Performing maintenance and making repairs to the Cutters that are consistent to each requirement enables the Coast Guard to maintain cutter configuration, increase efficiency and reduce costs. The fundamental purpose of configuration management is to ensure that these assets meet their requirements. These cutters are assets that are used to satisfy a need for the Coast Guard’s mission. The configuration of these high value assets specifically impact safety, security, performance, schedule, cost and the environment. This configuration information is paramount to making timely and effective decisions regarding mission execution, mission support, and financial stewardship, and it is therefore imperative that consistency be maintained between these critical assets, their documented configuration and the driving requirements. Due to CG Configuration requirements, any part that has not been tested, approved, and signed off by the USCG and their Product Lines Engineering Department cannot be confirmed as a Fit, Form, and Functional option that meets our cutters configuration requirements, therefore alternate parts or PN's cannot be considered for purchase in lieu of the PN's requested above.

1. In accordance with FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements (2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. (4) When the agency head has determined in accordance with the agency’s standardization program that only specified makes and models of technical equipment and parts will satisfy the agency’s needs for additional units or replacement items, and only one source is available. See Commandant Instruction 4130.6B COAST GUARD CONFIGURATION MANAGEMENT MANUAL.
