SIMPLIFIED ACQUISITION THRESHOLD MEMO

SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &

Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE

Code 7113 requires the purchase of three (3) CoCo-70x Portable Machinery Vibration Analyzers. The estimate cost for three units is .

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

3. Other Reasons: The Navy’s Submarine Vibration Monitoring Program (VMP) is directly responsible for monitoring vibrations from all rotating equipment aboard every submarine in the Atlantic and Pacific Fleet on a quarterly basis. Machines are monitored in an effort to ensue against catastrophic failure of critical ship equipment and unnecessary maintenance of machinery, maximizing operating time, and ensuring mission completion. The Naval Surface Warfare Center, Carderock Division (NSWCCD) uses the CoCo-70x to convert and process time domain signals from accelerometers mounted on submarine machinery and hydrophone sensors into numerical and spectral data that can be analyzed by NSWCCD personnel.

Only Crystal Instruments’ CoCo-70x analyzer meets the Government’s requirements without substantial duplication of costs. NSWCCD is currently using Crystal Instruments’ CoCo-70x system. NSWCCD owns and maintains expert system software that is external to the CoCo-70x system. This expert system is used to process vibration data and generate messages that are issued to the fleet. It has taken over three years to create an application program interface (API) that will allow the data collected from the CoCo-70x to be loaded into the NSWC expert system software.

Therefore, only the requested material will permit continued operation of the existing data acquisition and analysis system while expanding capability to acquire submarine structure borne data. If the requested material is not procured, the submarine vibration data acquisition and analysis system will eventually have to be replaced, resulting in research and procurement costs that could exceed . This cost is based on three man years’ worth of NSWCCD labor that was funded to create and test the API to allow data to be transferred between the CoCo- 70x and the NSWCCD expert system software, along with funding for the vendor to modify their software.
