FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. The software identified below is brand name and competition is precluded for reasons also indicated below. There are no substitutes available for this software.

2. Restricted to the following source. Provide original manufacturer’s (OEM) name.

3. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1), as implemented by FAR 6.302-1(c) Only one responsible source and no other supplies or services will satisfy agency requirements.

4. Identification of the justification rationale. The acquisition is being conducted under the procedures of Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(G) – Exception to the fair opportunity process-brand name only. The justification rationale is that software renewal and technical support for BriefCam Protect & Insights and Investigator software are needed to upgrade existing NCIS BriefCam products. Other software or technical support will not be applicable to NCIS’ BriefCam capability.

5. Description of the item or service required, statement that the requested material or service represents the minimum requirements of the government, the estimated cost, and required delivery date or performance period.

NCIS requires software renewal and technical support for one (1) BriefCam Protect & Insights Software and two (2) Investigator Software applications to continue receiving BriefCam software updates, access to BriefCam partner portal to submit help and technical requests, and access to BriefCam’s training library.

The estimated value of this effort is:

Base Year: $36,890.88.

Option Year 1: $33,201.78.

Option Year 2: $29,512.68 Option Year 3: $29,512.68 Option Year 4: $29,512.68

Total for Base + 4OYs: $158,630.70

Delivery: 30 days after award of contract.

Software maintenance and technical support for a product other than BriefCam will be of zero value or use to NCIS. There are no other current software available to fulfill the agency’s needs and procuring a new software to substitute the entire current infrastructure would be a great monetary expense to the government.

Market research indicates there are multiple resellers capable of providing software maintenance and technical support for BriefCam products.
