NSWCCD Sole Source/Brand Name Justification SAT rev 1 Effective September 2020

USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN

SIMPLIFIED ACQUISITION THRESHOLD MEMO

FROM:

CODE: 10413

SUBJECT: Brand Name Justification

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

The Carderock Division has an RDTE network spanning the West Bethesda campus and all its detachments and has made in investment in an existing IT inventory system which includes 3 installations of Alloy Navigator Enterprise. The renewal of the associated software support is imperative in allowing Code 1041 the ability to continue to track IT inventory and continue to track RDTE assets.

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

Hardware supporting this product has already been acquired and deployed throughout the campus and Carderock detachments. Various inventory tools exist in the marketplace, but replacing the current solution already in place would equate many man hours lost and money to not only replace the current solution, but the money already spent in acquiring Alloy. It is estimated that on-site training alone would equate to in addition to the man-hours lost for personnel attending the training. Conservative estimates for man hours spent in training are for the amount of users and days of training. Man-hours spent collecting the same data we already collected (if database migration is not possible) is over . Data collection previously took months from multiple employees in each technical code. Software acquisition, licensing, and support for the product is estimated at

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required. Only Alloy Navigator branded support can make use of the current IT inventory data. Any other product would require data migration or a full inventory of items already accounted for in inventory.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).
