4. Statutory Authority Permitting Other than Full and Open Competition:

(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The system 9 supplies provided by Stryker are highly specialized in nature to include:

- ergonomically designed to accommodate inverted cutting for total joint procedures, reducing the number of pressure points while cutting.

- Battery power is visible during setup to ensure that personnel knows when the power tool is ready for use.

- Anodized coating with IPX 9 rating for lasting performance to withstand pressurized water and harsh chemicals.

- Improved safety features

- Cordless system with endurance to cut, drill, or ream in sports medicine/ortho/podiatry/trauma procedures The procurement of the above-mentioned items are direct replacements for existing equipment at the VA Medical Center location. Attempting to replace with a similar item could result in reduce care or surgical mishaps. Stryker (and their authorized resellers) are the only companies capable of providing the System 9 Drilling equipment. The current Stryker System 7/8 is obsolete and at is end of life. Stryker System 9 will replace System 7/8. System 9 is the latest, innovative version of powered drill sets. The equipment comes together as a system and requires all parts to arrive at the same time to render it operable.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: An RFI was posted publicly to locate potential sources.

Direct communication with the manufacturer, Stryker, confirmed their capability and authorized partners.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Competitive pricing will be offered and evaluated as the manufacturer has more than one authorized reseller.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Based on market research, Stryker has at least 3 authorized SDVOSBs that can provide the requested items without exception.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The commercial market will be surveyed to determine any new additions to the market.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
