Justification for Other Than Full and Open Competition Under 10 U.S.C. 2304 (c)(l) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements Minotaur Mission System Server Purchase

Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by Federal Acquisition Regulation (FAR) Subpart 6.3 and in accordance with the requirements of FAR 6.302-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.302-1 as follows:

(1) Agency and Contracting Activity.

Aviation Training Center, Mobile Alabama, proposes to enter into a contract on the basis of other than full and open competition.

(2) Nature and/or description of the action being approved.

This requirement is for the U.S. Coast Guard (USCG) Aviation Training Center to procure hardware equipment This Justification and Approval (J&A) authorizes and approves the issuance of a sole source Firm Fixed-Price contract action to Systel Inc. to procure the Minotaur Mission System (MSS+) servers. The estimated total value of the proposed action is - and will be funded with Fiscal Year 2021 Training (34) funds.

The Original Equipment Manufacturer (OEM) source-of-supply for the Minotaur hub system is:

SYSTEL, Inc.

1655 Industrial Blvd., Sugar Land TX, 77478 CAGE: 1VRD0

(3) Description of supplies.

Components consist five (5) industrial rack mount computers for Minotaur Mission System (MSS+) servers approved to operate the software version18.2.4 and above aircraft hard drives. MSS+ servers are vital for effectively and efficiently training airborne operators in a classroom environment. All the required parts have been outline in the list below.

(4) Identification of the justification and the rationale.

The statutory authority permitting other than full and open competition is 10 U.S.C.

2304 (c)(l) as implemented by FAR 6.302-l(a)(2)(ii) entitled "Only one responsible source and no other supplies or services will satisfy agency requirements." This section states, "Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in:

(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or

(B) Unacceptable delays in fulfilling the agency's requirements. (See 10 U.S.C.2304(d)(l)(B) or 41 U.S.C.3304(b )(2)."

(5) Demonstration that the nature of the acquisition requires use of the authority cited.

The USCG owns and operates a fleet of fixed wing aircraft that use MSS+ as a key component of their role as search and rescue and maritime surveillance aircraft. The aircraft transfer collected data to a ground station server ensuring that USCG operations and intelligence centers have almost real-time data gathered from flight operations. ATC has been mandated by CG-711 for ensuring the MSS+ operators can effectively manage the fully integrated sensor and intel data manage software. Soliciting industry for an alternative server would pose an undue burden on the agency as the proper unit has already been identified by the Navy program of record (PMA-290E) and the price deemed adequate by USCG contracting. Additionally, USCG CG-933 Aviation ISSO has only approved these systems to operate aircraft versions of the Minotaur program in ground facilities. The Minotaur software is programmed for very specific processing and video components/capabilities. Selection of a different vendor increases risk of incurring special programming costs for ATC each time an update is fielded for the fleet. Selection of a company would risk significant delays as Navy approval would also be required. ATC intends to directly procure from SYSTEL inc. to mitigate any risks and costs.

(6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable.

No efforts to solicit industry have been made. The Navy program sponsor (PMA-290E) has determined that this equipment is to be used for interoperability and industry would not yield adequate results.

(7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable.

The Contracting Officer anticipates the price(s) will be fair and reasonable by use of one or a combination of various price analysis techniques and procedures in accordance with the following:

a. FAR 15.404-l(b)(2)(ii), comparison of proposed prices to historical prices paid for the same or similar items.

b. FAR 15.404-l(b)(2)(v), comparison of proposed prices with Independent Government Cost Estimates (IGCE).

c. FAR 15 .404-1 (b )(2)( vi), comparison of proposed prices with prices obtained through market research for the same or similar items.

(8) Description of market research.

Market research was conducted and completed in January 2020 for additional suppliers, completing internet queries and utilizing ALMIS for prior procurement history. Results of the market research identified only one source capable of providing an adequate solution for MSS+ Minotaur server, SYSTEL Inc. To date, no alternate sources have been identified for the requirement. All terms and conditions (including payment, delivery, inspection, acceptance, and warranties) are not expected to differ from customary terms and conditions in the marketplace or standard Government practices.

(9) Any other facts supporting the use of other than full and open competition.

None

(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

None.

(11) A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for required supplies or services.

None.
