Statement of Work (SOW) For
Nenahnezad Community School
Navajo North Agency Fruitland, New Mexico
May 9, 2022
STATEMENT OF WORK:
PART 1- GENERAL REQUIREMENTS:
The statement of work for the demolition and disposal of two banks of wooden bleachers.
Bleachers are to be replaced with two banks of Hussey Maxam bleachers in the main gymnasium located at Nenahnezad Community School.
1.01 Site Location: The project is located within the community of Fruitland, New Mexico, on San Juan, County, and approximately 15 miles west of Farmington, New Mexico off County Road 6675.

1.03 Scope of Work:
The contractor shall furnish and pay for all supervision, labor, equipment, materials, insurance, New Mexico Gross Receipt taxes, Navajo Nation Business Activity taxes, transportation/ mobilization, lodging, and other necessary incidentals in accordance with attached SOW.
Contractor will be responsible to pay for all local, State and Navajo Nation permits.
The Statement of Work is as follows and may not be sequential order:
1. Removal of two banks of existing wooden bleachers;
2. Installation of two banks (2) 7 row Hussey Maxam 26 Electric telescoping bleachers; Color:
504 Burgandy with 241) spacing. Length with rails 78'5"

3. Standard curtains (BH) to both banks curtains for the end of the bleachers;
4. Xtreme logo to both banks - The tiger head on the bleachers as seen in the rendering.
5. General clean up after work completion.
6. Prospective Contractor and or it's representatives are required to make a mandatory site visit prior to bidding the project to verify lineal footages, square footages, types of repairs, etc.
PART 2 - SPECIAL REQUIREMENTS:
1. NAVAJO NATION AND STATE OF NEW MEXICO TAXES:
The Contractor is responsible and required to pay the Navajo Nation Business Activity Tax equal to 5 percent of their total bid amount. In addition, local and state gross receipt taxes shall be paid by the Contractor.
2. DELIVERY REQUIREMENTS:
Five months after ARO.
3. Inspection and Final Acceptance Requirements:
Inspections will be conducted by the School, BIA Navajo Region and Northern Navajo
Agency office representatives.
Upon completion of the project, a final inspection will be performed. At that time, the entire system will be accepted or rejected based on completion, materials, or workmanship. The
Contractor shall notify in writing the Contracting Officer in three days to the final inspection.
4. Contractors Minimum Qualification:
General Contractor or Subcontractor performing the actual work must have a least a minimum of 5 years' experience on the above listed SOW items.
5. Temporary Services:
Water Services:
Existing water service near the site is available. Contractor is required to pay for and provide water by means of metering for use and testing. Contractor shall make arrangements with the
Navajo Nation Water Code Administration office to pay for water use.
Sanitary Facilities: The Contractor shall provide and maintain necessary, sanitary conveniences for the use of those employed on or about the work. The sanitary facilities shall be properly secluded from public observation and be at such locations as approved by the Government Project COR; and their use shall strictly enforced. Sanitary conveniences shall be fully enclosed and properly ventilated. Chemical toilets may be used. The premises shall be kept in a neat and sanitary condition at all times.
6. Contractor must be licensed in any State:
Provide a copy of Contractor's License to the COR.
7. Release of Claims:
After completion of work and prior to final payment, the Contractor shall furnish to the
Contracting Officer a Release of Claims against the United States arising out of the contract other than claims specifically accepted from the operation of the release.
8. Warranty:
Except as otherwise expressly provided in this contract, the Contractor shall remedy at this own expense any failure of the work (including equipment) to conform to contract SOW and any defect of materials, workmanship, provided that the Government gives the Contractor notice of any such failure or defect promptly after discovery, but no later than One-Year after final acceptance of the work.
Should the Contractor fail to remedy any such failure or defect within a reasonable time after receipt of notice thereof, the Government shall have the right to replace, repair or otherwise remedy such failure of defect at the Contractors expense.
9. Debris Disposal:
The Contactor owns all debris generated by or caused by the work in this contract. The
Contractor bears all responsibility and all costs connected with or related to the removal and disposal of all debris from properties of the United States Government. The Contractor is required to comply with applicable Environmental Protection Agency (EPA} regulations, Federal, State and Local Government laws and regulations while engaged in the removal and disposal of debris. The Contractor shall remove the debris off the boundaries of Nenahnezad Community
School to an EPA approved landfill. The Government is not responsible in any way, financial or otherwise, for the success or failure of arrangements for disposal of debris between the
Contractor and other parties.
10. Hours and Days of Work:
The performance time allowed under this contract is based on a five-day week, eight hours per day, Monday through Friday. Accordingly, work requiring inspection by Government personnel generally will not be permitted on Saturdays or Sundays. Also, on those days recognized as legal holidays for Government employees, construction work requiring
Government inspection generally will not be permitted.
11. Contract Safety Program Requirements:
The Contractor shall abide by all local, state, federal, OSHA safety regulations and protocols.
The contractor must also provide an emergency notification plan in the event of an accident.
12. Kickoff Safety Meeting:
Representatives of the Contractor shall meet the COR, Agency Project Inspection and Agency
Safety Officer prior to commencement of work to review all pertinent terms and conditions under contract to include the scope of work and discuss health and safety provisions. The Contractor should be prepared to discuss in detail the measures to be taken to control the hazards incident to the major phases of the work under contract.
This meeting shall be devoted mainly to a discussion of the manner in which the Contractor intends to administer the Health and Safety Program, and delegation and a determination of what shall be presented in the written safety program.
13. Barricades:
The Contractor shall furnish and install all necessary barricades, fences, guards or other temporary protection to prevent injury to the staff, students, visitors, general public and Contractor employees. Contractor shall conduct and execute his work so as to avoid hazards to persons or property. Property damaged by their failure to provide protection shall be replaced or repaired by the Contractor at no additional cost to the Government.
14. Contractor Housekeeping Requirements:
Good housekeeping, including routine debris and scrap removal, shall be maintained in all areas within the Contractors scope of operation. Any and all garbage shall be stored and removed to an approved EPA landfill site. All trench excavation shall meet OSHA requirements. Proper notification and signage is required for open trenches. No project activity shall jeopardize the safety and welfare of the staff, students, visitors, general public and government property.
