This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement and attachments constitute the only solicitation; quotes are being requested and a written solicitation will not be issued. Consider this solicitation (140L3724Q0076) as a Request for Quotes (RFQ). This solicitation documents incorporate provisions and clauses in effect through Federal acquisition Circular 2019-03. This solicitation is set-aside for small business. NAICS 115310 – Support Activities for Forestry – Fuels Management Services. The small business size standard is $34.0 million. Product Service Code F014 – Natural Resources / Conservation – Tree Thinning. The resulting purchase order will be a firm-fixed price type contract. (SEE ATTACHMENTS FOR COMPLETE STATEMENT OF

STATEMENT OF WORK

Project Purpose

Clearing and thinning of pinyon-juniper, mountain mahogany forest shall be conducted in the area as outlined in the statement of work to preserve intact forests, protect wildlife species, and provide a reduction of hazardous fuels.

Location of Project

The project area is located on Bureau of Land Management (BLM) administered lands about 13 miles southwest of Red Hill, New Mexico in Catron County. It is close to the border of Arizona and New Mexico, 8 miles south of NM Highway 60. The project area is a variable mix of closed to moderately open woodlands and meadows encroached by woodlands on low to moderately steep terrain on rolling hills.

Boundaries of Project Area

Boundaries will be explained on the ground and flagged or identified on a map. The number of acres thinned will be dependent upon funding availability and cost per acre, not to exceed available funds. The thinning will occur in sections 3, 10, and 11 of Township 3 South, Range 21 West. (See attached map)

Access

Directions to Vevarosa Thinning Unit parking. From Springerville, Arizona, take US Highway 60 (also called 191) to County Road 4225 (South side of highway). Travel on County Road 4225 for about 4.5 miles and take the left at the Y –It is called Sandy Lane that you will be on, going into the Escudilla Bonita Community. Travel on Sandy Ln to Shaw Lane - Turn Right Travel Shaw Lane to Pinon, Turn Right. Travel Pinon to Corner Road. Take Corner Road to Badger Road. Turn right, south on first two-track into BLM Lands. (See Travel route map)

Threatened and Endangered Species Mitigation

Mexican wolves are known to be in the general area where the thinning will occur. Crews will be requested to report sightings to BLM personnel, who will relay this information to USFWS wolf biologists. Mexican Wolves den between April 1 and May 1. If a den was found in the area or within a ½ mile buffer, the thinning area would be adjusted to accommodate this. The thinning prescriptions would all remain, just the geographic area will change.

Project Size

The project shall consist of an estimated 300 acres. Vendors are encouraged to offer up their best overall pricing.

*There is a possibility to add additional acres if additional funds become available before the contract is completed.

Project Prescriptions for Entire Project Area.

Treatment will be done by hand-cutting (chainsaws and other hand equipment).

Desired spacing would be a mix of the following three prescriptions:

• Average tree spacing will be 30 feet.

• Retention of 1-2 small groups of trees per acre (approximately 6-10 trees per group) is acceptable, with an average spacing around groups of 50 feet.

• The encroached meadows with mostly smaller trees will have all small trees removed with up to 5 larger trees per acre left uncut. All trees under 10 feet will be cut in these meadows.

No Cutting of any shrubs or oak trees.

No girdling or pruning.

Target species are One-seed Juniper (Juniperus monosperma), Alligator Juniper, (Juniperus deppeana), and Piñon (Pinus edulis).

Leave tree preference – 1st Ponderosa Pine, 2nd Healthy tree, 3rd Piñon Pine (Pinus edulis), 4th Larger tree, 5th Alligator Juniper (Juniperus deppeana).

Due to stem characteristics of Juniper and Piñon, stem diameter will be measured 6 inches above ground surface on the high side for cutting (DRC, Diameter at Root Crown), not DBH.

Retain all ponderosa pine (Pinus ponderosa).

Within meadow edges, slopes/hillsides, and canyon bottoms, healthy (free of mistletoe etc.)

piñon and juniper trees up to 12-16 inches Diameter at Root Crown (DRC) and smaller shall be removed. Larger diameter healthy trees (12-16 inches DRC or larger) of Piñon and juniper would be retained as leave trees. Max DRC (12-16 DRC) will be dependent on-site characteristic of each site/stand and can be modified as needed to maintain enough leave trees.

Due to stem characteristics of Juniper and Piñon, stem diameter will be measured 6 inches above ground surface on the high side for cutting (DSH-diameter at stump height), not DBH.

Cut any live Piñon and Juniper tree that does not meet the above criteria for leave trees.

Cut smaller seedlings and saplings growing under larger leave trees.

Cut all piñon and juniper trees within 30 feet of ponderosa pine trees.

Ponderosa pine will be included when determining average tree spacing in the woodland stand.

Cut stumps should be 6 inches or less in height.

Cut and felled material shall be bucked into lengths of 4-5 feet.

Cut material that is less than 3 inches in diameter will be placed in arroyos and erosion “cuts” located within 1 chain (66 feet) of cut trees to help slow head cutting and soil erosion.

Cut smaller seedlings and saplings growing under larger leave trees.

Cut trees shall be completely severed from the stump, with stump height 6 inches or less in height, measured on the high side of the tree.

No live limbs will be left on the stump of cut trees.

Leave Trees Ponderosa Pine Retained trees should be free of diseases (conks, fungus, dwarf mistletoe, etc.), and of good form (no forks in lower portion of piñon).

All hardwood species and snags.

Any tree having signs or survey marks.

All trees along fence lines that have fence wire attached to them.

Trees with cultural significance or obvious wildlife occupation, i.e. cavities or bird nests.

Any tree or group of trees in a leave patch marked with flagging or identified by the authorized officer representative and according to the specified prescriptions. NOTE: All leave trees are not marked. It is the contractor’s responsibility to identify the trees mentioned above.

Slash Management:

Trees felled into drainage bottoms shall be felled with the top of the tree pointed downstream and the end of the trunk of the tree pointed upstream.

The Contractor shall cut, lop, and scatter slash to within 18 inches of the ground ensuring that slash within the polygon or patch is continuous and connected.

Cut and felled material shall be bucked into lengths of 4-6 feet to speed drying.

Remove cut material 30 feet from structures (example: fences, waters) and ponderosa pine trees.

Slash shall be pulled away a minimum of 15 feet from leave trees (large diameter trees or snags, or any other sensitive resource as appropriate.

Felled trees and slash will not be left within 30 feet of any fence, improvement, or access road edge. Standing trees (to be felled) within 30 feet of any fence or road will be felled so they lie on the side of the stump opposite to the road or fence.

Any tree that is cut within 100 feet of an active erosion cut shall have the slash placed in the erosion cut in a manner that will allow the slash to catch sediment and help reduce soil erosion.

Administrative Practices No travel on two track roads when soils are saturated by rain or snow; stay on gravel or pavement.

No cutting in designated areas to protect cultural sites and/or improvements.

No off road driving.

Camping on BLM land to complete the project is permitted.

All cut areas shall be GPSed and all shape files provided to the BLM.

Cut patches shall be spaced, according to the above specified prescriptions and according to verbal specifications provided by the authorized officer. The contracting officer representative (COR) will meet with the crew supervisor as needed while work is in progress to determine status and to ensure work is completed to contract specifications.

Period of Performance Estimated period of performance is May 1, 2024, to July 31, 2024.

Source Selection The Government anticipates to award purchase order to the responsible party whose proposal is responsive and provides the Bes Value to the Government on a Lowest Priced Technically Acceptable (LPTA) basis.

52.212-4 CONTRACT TERMS AND CONDITIONS –COMMERCIAL PRODUCTS AND COMMERCIAL

DIAR 1452.201-70 AUTHORITIES AND DELEGATIONS (SEP 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

(a) Definitions. As used in this clause– Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

(d) Comptroller General Examination of Record. DIAR 1452.215-71 USE AND DISCLOSURE OF PROPOSAL INFORMATION -- DEPARTMENT OF THE

INTERIOR (APR 1984)

(a) Definitions. For the purposes of this provision and the Freedom of Information Act (5 U.S.C. 552), the following terms shall have the meaning set forth below:

(1) "Trade Secret" means an unpatented, secret, commercially valuable plan, appliance, formula, or process, which is used for making, preparing, compounding, treating or processing articles or materials which are trade commodities.

(2) "Confidential commercial or financial information" means any business information (other than trade secrets) which is exempt from the mandatory disclosure requirement of the Freedom of Information Act, 5 U.S.C. 552. Exemptions from mandatory disclosure which may be applicable to business information contained in proposals include exemption (4), which covers "commercial and financial information obtained from a person and privileged or confidential," and exemption (9), which covers "geological and geophysical information, including maps, concerning wells."

(b) If the offeror, or its subcontractor(s), believes that the proposal contains trade secrets or confidential commercial or financial information exempt from disclosure under the Freedom of Information Act, (5 U.S.C. 552), the cover page of each copy of the proposal shall be marked with the following legend:

(e) If a request under the Freedom of Information Act seeks access to information in a proposal identified as trade secret information or confidential commercial and financial information, full consideration will be given to the offeror's view that the information constitutes trade secrets or confidential commercial or financial information. The offeror will also be promptly notified of the request and given an opportunity to provide additional evidence and argument in support of its position, unless administratively unfeasible to do so. If it is determined that information claimed by the offeror to be trade secret information or confidential commercial or financial information is not exempt from disclosure under the Freedom of Information Act, the offeror will be notified of this determination prior to disclosure of the information.

(f) The Government assumes no liability for the disclosure or use of information contained in a proposal if not marked in accordance with paragraphs (b) and (c) of this provision. If a request under the Freedom of Information Act is made for information in a proposal not marked in accordance with paragraphs (b) and (c) of this provision, the offeror concerned shall be promptly notified of the request and given an opportunity to provide its position to the Government.

However, failure of an offeror to mark information contained in a proposal as trade secret information or confidential commercial or financial information will be treated by the Government as evidence that the information is not exempt from disclosure under the Freedom of Information Act, absent a showing that the failure to mark was due to unusual or extenuating circumstances, such as a showing that the offeror had intended to mark, but that markings were omitted from the offeror's proposal due to clerical error.

52.212-2 EVALUATION-COMMERCIAL ITEMS (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. (1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
