STATEMENT OF WORK
Isleta Elementary School
Special Education Teacher Staffing Services
1.0 BACKGROUND
The Bureau of Indian Education (BIE) is seeking contract services for a Special Education (SPED)
Teacher to support the Isleta Elementary School (IES) in Albuquerque, New Mexico for the 2024-2025 school year (SY).
The BIE serves as a branch of the State Education Agency (SEA) responsible for providing educational services for several elementary and secondary schools and dormitories serving students across 23 states.
The IES is operated by the BIE under the direction of the Associate Deputy Director, Bureau Operated
Schools (ADD-BOS) and the Education Program Administrator (EPA), Albuquerque Education Resource
Center (ERC).
The mission of the BIE is to provide quality education opportunities from early childhood through life in accordance with a tribe’s needs for cultural and economic well-being, in keeping with the wide diversity of Indian tribes and Alaska Native villages as distinct cultural and governmental entities. Further, the BIE is to manifest consideration of the whole person by considering the spiritual, mental, physical, and cultural aspects of the individual within his or her family and tribal or village context. Isleta Elementary
School (IES) serves grades K through 6 and serves approximately 100 students. The vision of IES is to educate the whole child based on the core community values so each child has the knowledge and skills to be successful. Built in 2006, visual interconnectedness is what you will find as you walk through the doors of Isleta Elementary School. Every aspect of the school, from the tile colors and placement to the directional stationing of the front, help honor and set the representation of the rich cultural history and tradition of the Pueblo of Isleta, as viewed from their Elders, Parents, Staff Members, and Students. As you enter the building and glance up, you will see a flock of geese flying North, telling us it is time to plant. Walk into the courtyard, and you will find two cisterns that collect rainwater that is to be used in the school garden and the landscaping throughout the school grounds. Cross over the bridge and you will be led to the gymnasium, which is a generous building designed for students/community gatherings and celebrations. Lively green is the color scheme used to represent the primary wing (lower grades K-3), where planting, cultivating, and watering is done. The blue tiles represent the water, and the purple tiles represent the mountains. This is a place where students sprout and are nourished like a tender plant reaching the sun. The warm fall orange and tan colors are in the intermediate wing (upper grades 4-6), which represent the harvest. This is a place for older students to collect knowledge and to mature. The subdued color scheme is welcoming and calming. Tile placement throughout the playground area adds to represent the Rio Grande, a river that has sustained life for hundreds of years. A traditional outdoor horno was built. This is a place to bake, gather, and feast on homemade treats, made by students and staff.
1.1 PURPOSE OF THE CONTRACT
The purpose of this contract is for a certified and licensed Special Education (SPED) Teacher
(Contractor), to provide qualified contract Special Education Teacher to IES, while the BIE continues its efforts to permanently hire a person into the position. This will immediately address the staffing shortage; and will lend to greater consistency and continuity of classroom and school operations at IES.
2.0 SCOPE OF WORK
The Contractor will provide full-time special education services at the IES in Albuquerque, NM for the
2024-2025 School Year.

2.1 TASKS AND RESPONSIBILITIES OF THE CONTRACTOR
The Contractor shall:
a. Provide professional staffing services for a Special Education Teacher.
b. Recruit, screen, and interview applicants to fill the position prior to contract award.
c. Validate the applicant's qualifications to ensure the individual meets the minimum educational, experience, conditions of employment, and licensure qualifications as outlined in Sections 2.3 &
2.4.
d. Present a minimum of three potential applicants to BIE within 5-days of award.
e. Schedule an interview with the applicant, Principal of IES, and the Education Program
Administrator for the ABQ ERC. Final approval to proceed will be granted by the Principal and
EPA.
f. All potential applicants must have the skills, competencies and experience as defined in the
Position Description for the position.
g. Upon BIE’s approval, hire and assign the person to perform the type of work described in Section
2.2 under the direct day-to-day supervision of the IES Principal and, COR, as needed.
h. Status of SPED Teacher: “Nonpersonal Services”: This is a nonpersonal service contract for temporary help service in which the individual is an independent contractor. The Government may evaluate the quality of professional and administrative services provided but retains no control over the contractor staff. The Contractor shall indemnify the Government from any liability producing act or omission by the contractor, its staff and agents occurring during contract performance. The contractor shall maintain liability insurance, in a coverage amount acceptable by the Contracting Officer, which is no less than the amount normally prevailing within the local community. The SPED Teacher will remain exclusive employees of the contractor. Because the
SPED Teacher is not an employee of the BIE or IES, the SPED Teacher is excluded from participating in any fringe benefit plans or programs of the BIE or IES, including, but not limited to, health, sickness, accident or dental coverage, life insurance, disability benefits, severance, accidental death and dismemberment coverage, unemployment insurance coverage, workers’ compensation coverage, and pension or Thrift Savings Plan (401(k)) benefit(s). Thus, the contractor is the common law employer of the SPED Teacher, and is responsible for the following:
i. Pay the SPED Teacher wages and provide them with the benefits that the staffing firm offers to them, if any.
ii. Pay, withhold, and transmit payroll taxes; provide unemployment insurance and workers’ compensation benefits; and handle unemployment and workers’ compensation claims involving the SPED Teacher.
iii. Require the SPED Teacher to sign agreements acknowledging that they are not entitled to holidays, vacations, disability benefits, insurance, pensions, or retirement plans, or any other benefits offered or provided by the BIE; and
iv. Require the SPED Teacher to sign confidentiality agreements before they begin their assignments to the BIE.
v. Comply with federal, state and local labor and employment laws applicable to contracted staff, including the Immigration Reform and Control Act of 1986; the Internal Revenue
Code (“Code”); the Employee Retirement Income Security Act (“ERISA”); the Health
Insurance Portability and Accountability Act (“HIPAA”); the Family Medical Leave Act;
Title VII of the Civil Rights Act of 1964; the Americans with Disabilities Act; the Fair
Labor Standards Act; the Consolidated Omnibus Budget Reconciliation Act (“COBRA”);
the Uniformed Services Employment and Reemployment Rights Act of 1994; and, the
Patient Protection and Affordable Care Act (ACA).
vi. Comply with all provisions of the ACA applicable to SPED Teacher, including the
Isleta Elementary School - Special Education Teacher Contract| 3 employer shared responsibility provisions relating to the offer of “minimum essential coverage” to “full-time” employees.
i. Facilitate the federal background check with assigned BIE Security Personnel and the BIE, IES point of contact, to ensure the SPED Teacher completes the federal onboarding, vetting and background clearance process required by BIE. The SPED Teacher must receive a preemployment determination and/or a favorable clearance before they can enter on duty at the
IES. An enter on duty date will not be established until IES receives the approval from BIE
Security to do so.
j. Make reasonable efforts to provide a similarly qualified replacement in case the SPED Teacher does not report to work. A replacement must be identified within 15-business days.
k. Fill staff vacancies without creating expectations of long-term employment. The length of placement at IES will be short-term but is contingent upon when BIE selects, hires, and onboards a permanent BIE staff person to fill the position.
l. Require the SPED Teacher to provide on-site services at the IES, as this position is not eligible for telework or remote work.
m. Require the SPED Teacher to participate in required school staff meetings and required, BIE training as identified by the IES Administration.
n. Ensure SPED Teacher is provided with the lodging, transport and other tools required for the provision of the services.
o. Ensure the SPED Teacher does not claim or work additional hours unless it is expressly agreed and approved by the BIE, IES Principal or designee in advance of the additional overtime hours being worked.
p. Identify a Project Manager to coordinate contract activities. The Project Manager is not a chargeable labor category under the contract.
q. Invoice monthly.
2.2 TASKS & RESPONSIBILITIES OF SPED TEACHER
The Special Education Teacher shall provide instruction at the professional level, as a classroom teacher, as a team teacher or a remedial or special services teacher according to the setting and organizational structure of the school. The SPED Teacher shall:
a. Be responsible for planning, implementing, and evaluating instructional activities under stated guidelines. The instructional areas will normally be elementary academic studies.
b. Provide on-site services at the Isleta Elementary School located at 1000 Moonlight Drive
Albuquerque, NM 87105 at a schedule determined by the IES Administrator.
c. Complete required online trainings to access BIE systems and to establish a BIE email and to gain access to the Native American Student Information System (NASIS).
d. Participate in required school staff meetings and required BIE training as identified by the IES
Administration.
e. Required to participate in any mandatory parent/teacher conferences and IEP meetings.
f. Follow the 25 Code of Federal Regulations, all applicable curriculum identified and provided by
IES, and state standards, where applicable.
g. Work alongside and collaborate with other related service providers like the occupational therapist, speech language therapist, social worker, physical therapist, and other related services providers working with the student to address the requirements of the IEP.
h. Contractor will participate in Student Intervention Team (SIT) process and assist to gather data and process work samples and provide recommendations to team. The documentation package may be forwarded with permission to evaluate to a diagnostician.
i. Conducts classes assigned using a variety of skills and teaching techniques, appropriate to the students diagnosed as learning disabled. The incumbent is assigned to instructional levels
Kindergarten through Sixth grade. The age of students ranges from five to twelve years.

k. Expect to spend the first 30-days reviewing student files and IEP Infromation, to get up to speed on each student’s needs. This includes looking the school’s test score, alternative testing, diagnostic reports, social checklists, family case history, etc.
l. Prepares daily lesson plans based on individual students' Individual Education Plan (IEP).
m. Teach IES students by selecting, developing, adapting, and implementing appropriate instructional methods and techniques, utilizing available resources, to insure continual achievement for each student.
n. Continuously evaluates individual and group progress through evaluation methods and instruments appropriate to each student's IEP. Redesigns instruction, as necessary, to meet individual needs. Makes progress reports to parents and confers with parents and other concerned individuals.
o. Maintains personal knowledge of and interest in each student in order to practice effective counseling. Within established guidelines, maintains control of assigned class and handles discipline independently, except for extreme and chronic behavior problems.
p. Manages and conducts classroom instruction within an environment which will provide and promote opportunities for the students to develop a positive self-image.
q. Knowledge of procedures to establish a learning environment and classroom management system which will promote the child's optimal physical, intellectual, and personal development to compensate for or overcome their learning-disabled condition.
r. Comprehensive knowledge of both the general and special education educational materials and techniques designed for the Learning disabled and the ability to adapt them to meet the individual needs of the students.
s. Knowledge and skill in applying a clinical teaching approach to effectively deal with complicated, specialized, and persistent learning difficulties of learning-disabled students.
t. Skill in relating the subject matter to the students' learning levels, interests, and backgrounds to motivate students' learning response.
u. Knowledge of and ability to select, develop, administer, and interpret various assessment and evaluation instruments to obtain information needed for effective instruction of the learning-disabled students.
v. Knowledge of and ability to apply, practical counseling methods and techniques to facilitate students' achievement.
w. Use teacher prepared instructional plans.
x. Evaluate student progress.
y. Modify materials and techniques.
z. Counseling students
aa. Conferring with parents and other concerned persons. When teaching or conferring with parents, guardians, or students regarding progress, behavior, and adjustments to the class or school routine, this phase of the assignment varies with the particular handicap and other needs of the students and requires initiative and a high degree of resourcefulness. The specific problems of the
Learning Disabled may be complicated by such conditions as differences in background, culture, and language, and social maladjustment of the learners.
2.3 CONDITIONS OF EMPLOYEMENT OF SPED TEACHER
a. Appointment may be subject to a suitability or fitness determination, as determined by a completed background investigation.
b. Must be able to obtain and maintain a background clearance.
c. Must be certified by a state's Department of Education. Emergency, provisional, or conditional certificates may be accepted under the conditions they are issued by the State teacher licensure department.
d. Valid State Teacher certification for appropriate grade levels (K-6) with Special Education endorsement (required to obtain and maintain)

e. Must obtain and maintain valid state driver's license.
f. Experience working in Native Communities, is preferred.
g. A minimum of 2-5 years of experience working as a Special Education Teacher.
2.4 EDUCATIONAL QUALIFICATIONS OF SPED TEACHER
a. Possess a bachelor’s degree (or higher) from an accredited education institution, and applicants must also have had at least 24 semester hours (or equivalent) of course work in each of the principal fields of instruction.
b. All professional educators must meet the certification standards for the position in the State where the position is located.
c. Emergency and provisional certificates may be accepted under the conditions they are issued by the State certification authority.
2.5 SPECIAL CONSIDERATIONS
IES special education caseload is approximately 27 students, which is 25% of the student population. Of the 27, IES has several students with Autism. The Special Education Teacher will be working closely with all of these students and must be able to support the educational social, emotional, and behavioral needs of students with Autism.
3.0 GENERAL REQUIREMENTS
3.1 PERIOD OF PERFORMANCE
Base Year: August 12, 2024, through August 11, 2025 and Option One thru Option Four
3.2 PLACE OF PERFORMANCE
Location: Isleta Elementary School
Address: 1000 Moonlight Drive Albuquerque NM 87105
3.3 HOURS OF OPERATION AND ESTIMATED WORK HOURS
Service shall occur during school hours and will be evaluated according to need during the school year. A minimum of 8 hours will be required per day. Hours may vary to meet the needs of the school and students. The school day for students is between 8:00am and 3:00pm Mountain Time. The SPED Teacher will be required to report to work each school day at 7:30am and work until 4:00pm MDT to cover school hours. The SPED Teacher is entitled to a 30-minute lunch during this time, which is not chargeable.
Hours are estimated based on government need. The government does not guarantee that all hours will be requested or worked. The SPED Teacher will not be expected to work on days the school is closed to accommodate Holidays, Snow Days, or other school closure events, as outlined on the IES’s calendar.
The SPED Teacher is expected to participate in staff development days or other staff events, identified by the school leadership team.

3.4 TRAVEL
The contractor shall be required to travel:
a. To and from his/her home to the school on a daily basis.

4.0 CONTRACTOR PERSONNEL ONBOARDING TIMEFRAME
The Contractor is responsible for recruiting a SPED Teacher with the necessary level of expertise to support the tasks and requirements in this Statement of Work. The Contractor will provide only candidates whose experience and education meets or exceeds the minimum requirements. The following outlines the key steps and projected timeframes, for the Contractor and BIE to onboard and vet the
Contract Teaching Staff to IES.
• The Contractor shall identify and provide potential candidates for the position, within 20-days of
Contract Award.
• The Government will review the applicant package to ensure it meets the minimum requirements of the contract. BIE will review the package within two business days of receiving it from the
Contractor. If the potential candidate meets all the basic minimum requirements of the position, BIE will notify the Contractor.
• BIE and the Contractor will schedule a call with the candidate(s), the school and the ABQ ERC for an interview.
• The Contractor must submit the BIE Personnel Security Intake Package (PERSEC Intake) within
5-business days after the government gives the approval to proceed with the potential candidates.
• The background check process may take up to 4 to 6 weeks.
• Contract Teaching Staff are required to report to IES within two weeks of the BIE Personnel
Security Office providing a favorable background check and an entering on duty date.
4.1 WORK ENVIRONMENT
Most of the work is done in a school-environment and on the IES school campus.
4.2 PERSONAL CONTACTS
Personal contacts are with students, co-workers, Area/Agency employees, Federal and non-Federal agencies, parents, other professional educators, social services agencies, law enforcement agencies, and community members, who work at or in partnership with IES.
4.3 SUPERVISORY CONTROL ON-SITE
The IES Principal or his/her designee shall provide the daily supervision and oversight of contract personnel.
Under the supervision of the Principal or his/her designee, contract teaching personnel shall:
• Communicate and work directly through the IES Principal or his/her designee on daily work assignments, issue or concerns that arise, and on all matters related to the performance of their tasks and responsibilities. The Principal or his/her designee serves as the first line of communication for the contracted teaching personnel.
• Receive daily work assignments from the Principal or his/her designee. The IES Principal or his/her designee has the authority to make and change assignments as needed in order to meet the priorities of the school.
• Receive approval for all unexpected and scheduled leave, including:
o Requesting scheduled leave minimally three days in advance.
o Receiving approval from the IES Principal or his/her designee before taking leave.
o Completing the BIE leave request forms to document the request.
• Work additional hours, as requested by the IES Principal or his/her designee, to support school operations and workload needs. The SPED Teacher will be paid for the additional work hours and overtime. Additional hours may include but is not limited to, supporting after-school activities like Back-to-School nights, parent-teacher conferences, IEP Conferences, school-community based events, one-on-one student educational support, or other events, which may occur after normal schoolwork hours.

• Ask for professional advice from the IES Principal or his/her designee as needed to fulfill the job requirements and tasks.
• Performance will be evaluated through general observations, in-person conferences, and through direct work with the IES Principal or his/her designee.
5.0 SECURITY
Background Investigations are required for the position All contract positions with duties and responsibilities involving regular contact with or control over Indian children are subject to a background investigation and determination of suitability for employment. Accordingly, all such positions require a favorable background screening by the Bureau of Indian Education (BIE), Personnel Security and
Suitability Program and a favorable background investigation by the Defense Counterintelligence Service
Agency (DCSA). There are additional clearance requirements for Contractors working in school locations. Contractor personnel under this contract, are required to submit to suitability clearance procedures, and shall not commence work under the contract until the COR and/or Government Contract
Officer have cleared them to be on site. All Contract Teaching staff must be United States citizens. The information collected during this effort is considered unclassified, sensitive; therefore, Moderate Risk
Public Trust, is the sensitivity level. The Contractor will be provided access to BIE computers and information. The Contractor shall report suspected computer security breaches at IES as soon as the breach is received, heard of, or found to the Indian Affairs Information Technology (IAIT) help desk.
The Contractor shall adhere to government requirements on IT usage and access to service IA users, equipment, and software; under no circumstance is the Contractor permitted to make use of Government computer systems, information, equipment, software, supplies, or accounts for purposes other than the performance of this contract. Personal or Contractor-owned computers are not permitted on any of the government networks. The Contractor shall abide by United States Federal policies and procedures, the
DOI policies and procedures, IA policies and procedures, and court orders.
6.0 DATA RIGHTS & DOCUMENT OWNERSHIP
The Government requires unlimited rights in any material first produced in the performance of this SOW, in accordance with the FAR clause at 52.217-14. The BIE shall have unlimited rights to, and ownership of all deliverables provided under this SOW. The Contractor, agrees, that any IES student, staff, or parent data, collected in support of this agreement, will not be used, or shared. The implementation and outcome data collected, analyzed, and used in support of the Contract Requirements, Tasks and Deliverables are explicitly for the benefit of the BIE, IES. Upon the expiry or termination of the service contract, the
Service Provider will return to BIE any property, documentation, records, or confidential information which is the property of BIE.
7.0 CONFIDENTIALITY & PRIVACY ACT
The BIE recognizes that Contract Teaching Staff, may have access to confidential information concerning
BIE, IES, IES Students, Families, and other community members in the fulfillment of their job duties.
Contract Teaching staff agree to maintain the confidentiality of all such Confidential Information.
In particular, and without limiting the foregoing, the BIE acknowledges and understands the confidential information to which Contract Teaching Staff will gain access is the confidential and proprietary information of the BIE and IES. Thus, Contract Teaching Staff agree:
• not to disclose any confidential information to anyone other than an employee of the BIE, IES who has a need to know such information.
• Prevent any unauthorized use or disclosure of the confidential IES student, family, or employee information.
• Promptly notify the BIE, IES of any unauthorized use of which the Contract Teaching Staff or staffing firm learns of.

• To use such confidential information for the sole purpose of fulfilling the performance under the
SOW.
Further, work on this Contract will require Contract Teaching Staff to have access to Privacy Information.
Contract Teaching Staff shall adhere to the Privacy Act, Title 5 of the U.S. Code, Section 552a and applicable agency privacy rules and regulations and remain compliant with HIPAA.

▪ The staffing firm will invoice the BIE for Contractor Services monthly.
▪ Invoices shall be accompanied by timesheets for each billed Contract Teaching Staff with the respective billing rate for each Contract Teaching Staff.
▪ Timesheets shall be signed by the IES Principal or his/her designee prior to invoicing.
▪ It will be important for the contractor to provide a detailed informative, all-inclusive monthly status report outlining all efforts under the Contract that will contribute to the successful fulfilment of services at IES. The Contractor will invoice by the 5th day of each month through
IPP and send a copy of the invoice and supporting documentation to the COR or Principal in writing monthly on the 5th of each month.
Final Report Requirement:
The contractor shall provide a final report to the IES Principal and Contracting Officer Representative. at the conclusion of the period of performance. This report shall summarize objectives achieved, significant issues, problems, and recommendations to improve the process in the future. In addition, the following information must be included in the Final Report:
• A narrative on work performed and progress made on all tasks levied under the resulting contract.
Including any key accomplishments.
• Recommendations on next steps and ways to improve staffing services at IES based on the
Contract Teaching Staff’s personal experience.
• Final Costs Breakdown for all Contract Teaching Staff and Positions over the lifetime of the contract including outlining the position, total number of days worked, total costs, and billing rate per position.
9.0 IES RESPONSIBILITIES (GOVERNMENT FURNISHED ITEMS)
IES will provide the Contracted SPED Teacher with the following:
▪ Classroom Space & Furniture
▪ Land line phone service, if needed.
▪ Internet access
▪ Laptop or Computer for Student Information Access to NASIS and BIE email.
▪ Paper supplies – including paper, pen, pencils, textbooks, notebooks, and other paper products, as needed to perform the duties of the position.
▪ Provide contractor with the pre-requisite training after pre-employment clearance, FISSA, and
IMT.
▪ Upload the contractor training within DOI Learn to activate DOI Active Directory Account.
▪ Work with the Contractor to obtain a PIV Card prior to starting.
▪ Ensure the individual has access to NASIS and other BIE systems within 2-weeks of start date.
▪ Provide necessary training to NASIS.
10.0 IES REVIEW
▪ Oversight and review of the contract will be provided by the IES Principal and Contracting
Officer Representative.
▪ Certification of necessary reports or deliverables

▪ Utilize scope of work as a basis for review and certification.
11.0 INSPECTION AND ACCEPTANCE REQUIREMENTS
▪ Quarterly performance reviews will be conducted by the IES Principal, and/or Contracting
Officer Representative.
▪ Any corrective actions will be addressed in a timely manner with the Contract Teaching Staff.
12.0 TERM AND SEVERABILITY. The contract position under this SOW s intended to be a short-term, and temporary fix to address the staff shortages and vacancies at IES.
12.1 GOVERNMENT. The government reserves the right to sever the contract upon hiring a permanent BIE employee into the position.
a. Upon IES selecting and onboarding a permanent full-time BIE employee into the position supported by this SOW, the BIE reserves the right to discontinue services under the contract and will notify the contractor in writing.
b. The SPED Teacher (Contractor) will be released of his/her duties from IES. However, the contracted SPED Teacher will remain at IES until the BIE Employee is onboarded. A minimum of a one week overlap with the contracted SPED Teacher and BIE SPED Teacher will occur to allow the transition of special education activities and cases.
c. BIE will provide a fifteen (15) day written notice when this occurs, to adequately notify the contractor that the SPED Teacher’s contracted time with the BIE is coming to an end and to develop an exiting plan.
12.2 CONTRACTOR. The contractor will provide a fifteen (15) day written notice if the SPED
Teacher plans to leave or vacate the contract. The SOW is driven and contingent upon key personnel, thus if the contracted SPED Teacher is unable to stay until a replacement is onboarded and leaves without adequate notice, this will directly impact the performance of the contract and be reflected in the CPAR rating.
