SECTION C – STATEMENT OF WORK

The purpose of this purchase order is to provide reforestation and maintenance services for the Roseburg District's 2023 planting season. Detailed maps and unit specifications will be provided at pre-work conference(s). Work will be performed primarily in the Archie Creek fire area and will focus on low-density planting of 300-400 TPA (A), seedling protection in those planted units (C), and Manual Brushing in previously planted units (F). Work may be elsewhere on the district as determined in the prework. The Start Work Date is dependent on acceptable planting conditions as determined by the COR as well as seedling availability. Tree planting and protection activities are expected to begin on 11/01/2022, pending acceptable conditions and availability of materials. Manual cutting activities may begin 10/01/2022, pending fire season restrictions. Waivers to work in IFPL II or higher will not be supported.

1.0 GENERAL

1.1 Description of Services – This purchase order is to contract reforestation and seedling maintenance services for the Roseburg District BLM 2022-2023 planting season. Detailed maps and unit specifications will be provided at pre-work conference(s). The Start Work Date is dependent on acceptable planting conditions as determined by the COR as well as seedling availability. Tree planting and protection activities are expected to begin on 11/01/2022, pending acceptable conditions and availability of materials. Contractor shall furnish all necessary management, labor, supervision, equipment, materials, transportation, and any other incidentals to perform silvicultural treatment service activities designed and prescribed for reforestation. This includes planting, mulching, and tubing. Contractor shall comply with all applicable Federal, state, and local safety requirements in the performance of this work.

1.2 Location of Project - All project units are located within the South River and Swiftwater Resource Areas, Roseburg District BLM, Oregon. Project area maps will be provided at pre-work. Work will primarily be within the Archie Creek fire area but may include other areas on the district.

1.3 Boundaries of Units - Project unit boundaries not clearly defined by roads, adjacent timber stands, natural or manmade features are marked with flagging, paint, or tags. Upon agreement between COR and Contractor, virtual boundaries may be used if appropriate.

1.4 Access to Project Areas

1.4.1 Access is passable with a 2-wheel drive vehicle, although a 4-wheel drive vehicle may sometimes be required. Foot travel up to ½ of a mile may be required as designated on individual project unit maps. If foot travel is more than ½ mile to the project unit boundary, additional pay shall be negotiated between the contractor and the government.

1.4.2 Standard Access: Access is defined as (1) passable with a 2-wheel drive vehicle although a 4-wheel drive may sometimes be required or (2) foot travel to the closest project area boundary is up to 0.5 miles. Foot travel over 0.5 miles to individual project areas will be compensated as follows:

0.51 – 1.0 miles 10% Compensation*

1.10 - 1.5 miles 15% Compensation*

1.51 - 2.0 miles 20% Compensation*

2.10 + miles 25% Compensation*

*Compensation percentage will be applied to the cost per acre for the unit(s) requiring foot travel.

1.4.3 If an all-terrain vehicle is used, it shall be of such design that it will travel over rough, uneven terrain and not create wheel ruts and channels. The all-terrain vehicle must be approved by the Government.

1.4.4 Use of 2-wheel and 4-wheel drive vehicles on dirt roads is permitted only with the Government’s approval.

1.4.5 Locked gates restricting access will be noted on the unit maps. Access behind locked gates shall be for the purpose of conducting work under this contract only. Gates with locks shall be locked immediately after entry or exit by the Contractor for each project unit. Keys may be issued to the Contractor by the BLM, Roseburg District Office. Gate keys shall be returned to the COR or PI within 5 days of completing unit(s) of work. A deposit of $200.00 will be assessed for each gate key lost or returned in an unusable condition.

1.5 Security of materials - The Contractor may leave its equipment at the work site. However, the Contractor shall be responsible for the equipment if it should be lost, stolen or damaged.

1.6 Sequence of Work - The sequence of work will be determined by the COR or PI at the pre-work conference and may be subject to significant change. Certain project areas may be designated as higher priority units which would require an earlier completion than the bulk of the contract units. Reasons may include, but are not limited to: snow hazards and biological requirements.

1.7 Operating Permit - State law requires a permit to operate power driven machinery. Permits must be obtained from the Oregon Department of Forestry prior to the operation of power driven machinery. This requirement applies to chainsaws and brush cutters.

1.8 Camping on BLM Administered Land - The Contractor shall obtain authorized permission from the COR prior to camping on BLM administered lands.

2.0 DEFINITIONS

2.1 Planting

Bare root seedlings - tree seedlings grown from one (1) to two (2) years in the ground at a seedling nursery. Most soil is removed from the roots before the seedlings are packed for shipment.

Containerized seedlings - tree seedlings grown in plastic or styrofoam containers in nursery greenhouses. The rooting medium is planted with the trees.

Culling - the discarding of individual tree seedlings from the seedling lot being planted.

Micro-site planting – choosing a planting spot that gives a seedling the best chance to survive and grow. These spots that have good soil, away from dense competing vegetation, and provide a protected environment. Examples of these areas could be planting adjacent to a skid trail instead of planting in the compacted area of the skid trail or planting on the north side of a stump or log to provide shade for a seedling.

Minor Species - any tree species other than Douglas-fir, such as western redcedar, incense-cedar, Port- Orford-cedar, western hemlock, ponderosa pine, sugar pine, and grand fir.

"Other" trees - natural, previously planted or newly planted conifers which can be readily seen by the planter, and measure 6” or more in height. Trees to be counted will include trees that are not chlorotic or damaged.

Pruning - the cutting or tearing of tree seedling tops, roots or branches with pruning clippers, other tools or by hand.

Scalping - removal of all movable slash, debris, gravel, humus, ash and living vegetation including surface roots down to mineral soil using hand tools to a minimum of 12” × 12” square.

Space Blanket - a reinforced plastic tarp having a facing of aluminum foil on one side used to provide tree seedlings protection from direct sunlight, frost and wind. Blanket shall be equal to International Reforestation Supplier's "Heat Shield" seedling protection tarp.

2.2 Tubing

Stake - round bamboo stake 36 inches in length used to support tubes.

Terminal leader - the uppermost portion of the stem of the seedling from the uppermost whorl to the top of the seedling.

Tube - tubular plastic mesh (vexar) 18 inches in length.

2.3 Paper Mulching

Landscape Staple - a wire staple, 6" × 1" × 6", of 12 gauge minimum diameter.

Paper Mulches - 3' × 3' sheet of kraft paper with asphalt interlining, slit crossways in the middle.

Glass fiber scrim reinforcing may or may not be present.

CONTRACTOR-FURNISHED ITEMS

3.1 The Contractor shall provide all tools, materials, equipment, labor, supervision and transportation to satisfactorily complete the work. Except for those items provided by the government (see section 4.1 below under GOVERNMENT PROVIDED MATERIALS).

3.2 Planting tools, materials, and containers for carrying trees during planting operations shall be of a design normally used in tree planting work. Planting bags shall prevent seedling roots from drying out. Planting hoes or shovels shall be capable of opening a hole at least 4" wide and 12" deep, perpendicular to the ground surface, and broken on three (3) sides.

3.3 Crew Requirements

3.3.1 The Contractor is responsible for the crew(s) and complying with the requirements of the contract including, but not limited to, seedling care, proper planting, spacing requirements, project area location, scalping, clearing and materials installation requirements. The Contractor is fully responsible for the proper planting of the trees by the crew(s). The Contracting Officer’s Representative (COR) will not supervise the crews. The Contracting Officer (CO) and COR will ensure compliance to the contract.

3.3.2 Provide a supervisor for each crew that is not a working member of the crew who is required to stay with the crew while work is in progress. No more than eleven (11) workers are to be supervised by one supervisor.

3.3.3 Crews must be kept together at all times working as a crew under control of a supervisor rather than as individuals in separate areas. Twenty-four hours prior notice must be given to the COR if there is to be a significant change in crew composition or productivity.

3.3.4 State safety regulations require that crew members shall not work alone and accessibility to emergency transportation shall be provided by the Contractor at all times.

3.4 Supervisor Requirements

The supervisor must, effectively supervise and direct the crew by (1) making periodic inspections of the crew's work, (2) advising them as to deficient work, and (3) providing instructions for correcting such deficiencies. This person shall be capable of speaking and reading English proficiently to ensure good communications with the COR. The supervisor shall ensure proper seedling care and handling. Should the supervisor fail to adequately perform these duties, the Government may require substitution. Any changes in supervisory designations initiated by the Contractor must be submitted in writing to the COR at least 24 hours prior to the change taking effect.

4.0 GOVERNMENT PROVIDED MATERIALS

4.l The Government will furnish tree seedlings, paper mulches, landscape staples, bamboo stakes, and tubing.

4.2 Distribution Sites - Roseburg BLM Fire Warehouse, 2300 Aviation Drive, Roseburg, Oregon or Roseburg District Office, 777 N.W. Garden Valley Blvd., Roseburg, Oregon or Roseburg BLM Myrtle Creek Maintenance Shop 161 Klimback Street, Myrtle Creek, Oregon or Sutherlin Maintenance Shop, Old Highway 99, Sutherlin, Oregon.

4.3 Distribution and Care of Government-Furnished Items

4.3.1 Seedlings and materials will be issued Monday through Friday between 6:30 a.m. and 8:00 a.m.

PT unless other arrangements are made with the COR. The Contractor is responsible for the loading and unloading of tree seedlings and materials. A receipt shall be signed by the Contractor and COR each time seedlings and/or materials are issued or returned. Deliver all Government-furnished material to the project area.

4.3.2 Seedlings will not be issued in the morning if inclement weather conditions indicate planting cannot be performed on the project site.

4.3.3 The amount of seedlings issued will be limited to the estimated quantity that will be planted in one (1) day and the nursery's ability to lift and process the trees without damage. The amount of materials issued will be limited to the estimated quantity to be installed on a unit or the amount that can be installed within two (2) days, whichever is greater.

4.3.4 Transport the seedlings and materials directly to the unit with no intermediate storage points.

Seedlings and materials may only be moved from one unit to another with prior approval of the

COR.

4.3.5 The Contractor shall be responsible for the care, security, and maintenance of all Government-provided material. Return all damaged seedlings and materials unsuitable for its intended use to the location approved by the COR and place in an orderly manner. The Contractor will be charged for all lost, damaged, wasted or stolen seedlings and materials.

4.3.6 Remove from the site any individual(s) involved in the improper care and/or disposal of Government-provided material. The Government may also, by issuance of a written order, suspend the Contractor's right to proceed for improper care and disposal of Government- provided material.

4.3.7 Count and re-bundle all unused and surplus materials and seedlings in a manner in which the count is obviously displayed. Return unused/surplus supplies to the storage point where the property was issued during regular business hours. Any unit containing unused materials will not be considered complete.

4.3.8 Flatten and stack all empty seedling shipping boxes and bags, and stack all pallets and packing materials in an area designated by the COR. Dispose of the shipping boxes and bags and pallets and packing materials with the approval of the COR.

4.3.9 Return all unused seedlings to the District storage facility no later than 6:00 p.m. each day. Non-return or late return of unused tree seedlings may be treated as improper disposal.

5.0 SPECIFIC TASKS

5.1 Tree planting - Plant tree seedlings on forest lands modified by timber harvest, fire, or other causes.

5.1.1 Planting Stock – The age class and species of stock to be planted in each unit will be specified prior to planting. Stock is typically 1-2 year old bareroot or container stock.

5.1.2 Care of seedlings - Protect seedlings against damage to tops and roots, including damage from freezing, heating and drying. The following requirements shall be adhered to.

a. Transport seedlings from seedling storage to project areas in fully enclosed trailers or pickups with canopies. Seedlings shall not be transported in heated vehicles.

b. Upon arrival at the project area, store seedlings in a manner that protects them from direct sunlight, frost, and wind and provide for proper air circulation around bundles or boxes.

Cover seedlings with a space blanket when necessary to provide protection. The COR must approve the location and method of storage at the project area.

c. Do not mistreat or mishandle seedlings in any manner. Provide and transport water to the work site. Immediately upon removal from the nursery packages, dip seedlings in water from their root collar to the tips of the roots. Excess water may be allowed to drain from dipped seedlings. Do not slap or squeeze seedling roots to remove excess moisture. Immediately place dipped seedlings into planting bags or other containers. Comply immediately with any requests or instruction by the COR regarding the care of seedlings.

d. Restrict the number of seedlings placed in a planting bag to a number that allows removal of individual seedlings without damage to the seedling roots.

e. During the planting operation, remove only one (1) seedling at a time from the planting bag or other container and only after the planting hole has been prepared.

f. Do not perform root or top pruning or culling except with the approval and under the direct supervision of the COR.

g. Notify the COR immediately if the seedlings and/or seedling roots are too large or small, dryness of roots, mold or other evidence of damage to the seedlings.

h. Return unused seedlings to the storage site if inclement weather conditions occur during the planting operation which will damage seedlings, such as freezing or high temperature, drying winds, low humidity, or snow which prohibits the planting operation from continuing.

5.1.3 Planting location

a. Plant all spots designated at prework, unless they meet one or more of the following conditions.

(1) Soil covering slash or debris.

(2) Rock outcrops, talus slopes and areas of stones, cobbles or gravel over 12" deep.

(Note: Some soils contain up to 70% rock fragments and are plantable.)

(3) Other areas as designated by the COR.

b. Plant in areas of slash up to three (3) feet in depth. Cut holes and/or remove slash in order to establish a plantable spot. Where paper mulching is required, the spot must be large enough to properly install a paper mulch.

c. Plant seedlings in patches of dense brush and slash.

5.1.4 Planting methods

a. Proper selection of planting site is important and clearing efforts shall be required to prepare the site for planting. Examples of unplantable and plantable areas will be indicated by the COR on the project site.

b. Plant seedlings in spots distributed over the area at the intervals prescribed provided that, for individual seedlings, the specified average spacing, if required, may be varied as much as 25 percent in any direction to find a suitable planting spot or the best micro-site. Planting in micro-sites is preferred. COR may designate wider spacing variance on a unit-to-unit basis.

c. On items designated for mixed species planting, the approximate mixture of species to be planted is prescribed prior to planting.

5.1.5 Scalping of a planting spot - Scalping shall be performed using hand tools before seedlings are planted. The cleared area shall be a minimum of 12” × 12” square. Chain saws and/or other tools may be required to remove slash and vegetation in order to establish a plantable spot.

5.1.6 Tree seedling placement

a. Plant the seedling in the center of the cleared area. Set seedling firmly in the ground with moist soil filled in and well firmed around the roots so that no air pockets are around or adjacent to the tree roots. After firming around the tree, soil should be at the ground level with no deep depression or high mound at the stem. Plant the seedlings so that roots approximate a natural position; not twisted, tangled, compacted together, curled or bent from a position perpendicular to the ground surface. . Roots will be ten (10) inches in length and may vary twenty (20) percent, more or less (see Illustration Nos.1 and 2.) Acceptable and Not Acceptable planting are shown on Illustrations No. 3 and 4.

b. Suspend the seedling near the center of the hole with roots in a near natural arrangement at a depth that, after filling, packing, and leveling, the root collar is even with or slightly below the firmed soil level. Do not expose any portion of the roots (see Illustration No. 1.)

c. Plant seedling erect, vertical to the ground surface with allowance for slope on steep ground. Acceptable and Not Acceptable planting are shown on Illustrations No. 3 and 4.

5.2 Paper Mulch Installation

For mulching, place paper mulches around all newly-planted seedlings to reduce competition from herbaceous vegetation. See Exhibit D for placement of mulches.

The planting area shall be scalped at a 12” × 12” area at the time of planting. Clearing is needed for a total area of 3’× 3’, with the seedling in the middle. Chain saws and/or other tools may be required to remove slash and vegetation in order to establish a mulchable spot.

Place one mulch sheet per seedling so as not to damage the planted seedling and install to properly cover the area around the seedling.

Center the seedlings in the middle of the cut openings, or in the downhill slit.

Install mulches by stapling down each corner with a six (6) inch by one (1) inch wire landscape staple of twelve (12) gauge minimum diameter. As measured from the corner, fold six (6) inches of each corner toward the center underneath the sheet. Set each staple firmly in six (6) inches of soil by placing the staple approximately three (3) inches from the folded edge and passing through both layers of the paper mulch. When a seedling is less than 5 inches tall above ground,install a fifth staple in the center area of the mulch to hold it down.

In rocky areas, staples may be unable to penetrate the ground adequately. Alternative methods may be used to secure paper mulches such as placing debris or rocks. Alternatives may be used only with approval of the COR.

Mulches may be folded for placement next to immovable objects as long as the mulch has at least one-half of its effective area around the seedling. This will be demonstrated by the COR, upon request.

5.3 Tube installation

Install tubes and stakes to protect seedlings from animal damage such as browsing and clipping by deer, elk, rodents and rabbits throughout the seedlings' establishment period.

Tube newly planted seedlings as designated on maps and in the prework. Specific seedling species may be prescribed. Install tubes in a systematic manner to prevent skips and to ensure adequate coverage of the unit.

Tube installation shall occur within three (3) working days of any new planting. If mulching is also required, the contractor has the option of tubing the trees and then mulching later. Inspection of the tubing will not occur until the mulch and tubing are complete. Contractor shall schedule, pick up, transport and deliver all materials to the project site in a timely manner during normal working hours.

The terminal leader and lateral branches that are protected by the tubing must be in an upright position and treated to allow the terminal leader to stand erect and free to grow within the tube.

Prevent damage to the seedling as the tube is placed over it.

Install tubes and stakes as follows:

a. One (1) installation per seedling consisting of one (1) stake, woven through the plastic tube

(see Exhibits A, B and C).

b. Install the stake into the ground a minimum of nine (9) inches deep. Insert the largest end into the ground. Place the stake no more than three (3) inches from the base of the seedling.

c. Tube eight (8) inches, protecting the leader. If seedlings are shorter than eight (8) inches, the entire seedling shall be leader protected.

d. The maximum lean allowed from vertical is two (2) inches relative to the seedling as measured from the top of the tube.

E.1 QUALITY CONTROL

E.1.l Tree Planting - Quality of work and conformance with planting specifications will be determined by e surveys as described in E.1.2.

The Contractor is encouraged to observe the inspections and will be notified of the inspection results.

When requested by the Contractor, a copy of the inspection results will be provided to the Contractor.

E.1.2 Surveys will be performed across planting rows at constant intervals to obtain a representative sample of each planter's planting quality. Plot size used for planting inspection will be determined based on specifications provided for each unit.

Each planted tree found on the survey plot will be examined for (1) site preparation, proper selecting of planting spot and spacing as required by the planting method designated and described in the specifications; (2) planting depth; (3) position of stem; (4) root placement and (5) firmness; (6) damage to seedling.

E.1.3 For Units with strict spacing requirements, both planting quality and spacing of seedlings will be inspected. Adequacy of spacing, underplanting and overplanting will be determined by the presence or absence of trees on individual plots and/or actual spacing measurements between planted trees.

If quality of planting or spacing are found deficient on these surveys, the Contractor or its authorized representative will be instructed to take immediate action to correct these deficiencies at no additional cost to the Government, which may include replanting of unacceptable areas.

E.1.4 For Units with variable spacing, plots falling on plantable areas without one or more trees (planted or natural) may indicate under-planting as determined by the COR. Over-planting is indicated by plots that fall on plantable area and contain two or more trees (one or more which is planted) within two square foot.

The Contractor or its authorized representative will be instructed to take immediate action to correct deficiencies at no additional cost to the Government, which may include replanting of unacceptable areas. Should planting AQL fall below 70% on a given day, work for that day will be stopped and resume the following day.

E.l.5 Average (mean) percentages for planting densities are determined through analysis for improper planting; underplanting; and overplanting. A variance of no more than 10% of the planting density for a specific area as provided in the Unit Information, regardless of spacing, will be accepted.

E.2 Paper Mulching, Tubing, and Stand Maintenance Items - Quality of work and conformance with specifications will be determined by a series of inspection points across the project area at constant intervals. Data for determination of work quality and as a basis for the project acceptance and payment will be collected from these points and calculated on a per-unit basis. A minimum of 25 inspection points, whichever is greater, will be taken on each unit. Additional points above the minimum required may be inspected at the discretion of the COR. The tree closest to the inspection point will be examined for contract compliance and conformance to specifications. One (1) tree per inspection point will be examined for compliance with specifications. Untreated trees will be examined to determine if treatment should have been applied. Inspection points will either pass or fail based on compliance with the specifications.

E.2.1 The Contractor is required to perform quality control. The COR may request the Contractor to provide documentation of quality control plot data collected on planted units. Documentation shall include the following: Unit number, plot number, tree data for all trees on plot, and spacing. Plot center shall be marked with flagging and labeled with a waterproof marker. The color of flagging must be approved by the COR. The plot shall be located and shown on the project area map.

Sampling intensity shall be sufficient to a standard error within 10%.

E.3.0 PAYMENT

E.3.1 Payments will be calculated and issued on a per-unit basis.

E.3.2 Tree Planting Items – Units with an AQL of 90% or higher will receive full payment. Payments for units with an AQL less than 90% will be made for the amount of acceptable work. Payment for acceptable work is based on acreage shown for each unit on the project maps and the percentage of work determined acceptable.

E.3.3 Mulching, Tubing, and Stand Maintenance Items - An AQL of 90% or higher will result in full payment. Units that fall below 90% work quality shall require rework at no additional cost to the Government. Should additional supplies be required, the Contractor shall be paid less the cost of additional supplies. In some instances, the COR may deem rework detrimental to seedling survival. In those instances, payment will be made for the amount of acceptable work.

For example: 89% × Bid price per acre – cost of additional supplies = Payment.

Tubing = Tubing installation performed for reforestation services under thousand shall be paid based on unit cost/1000 x number of tubes installed = payment amount.

CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (JULY 2010)

(a) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR42.15.

(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.

(c) We request that you furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.

(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically-generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at http://www.cpars.csd.disa.milJ. The CPARS User Manual, registration for On Line Training for Contractor Representatives, and a practice application may be found at this site.

(e) Within 60 days after the end of a performance period, the Contracting Officer will complete an interim or final past performance evaluation, and the report will be accessible at http://www.cpars.csd.disa.mil/. Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment. Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in the Assessing Official's narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1 - 17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection actions. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating ''No comment" in Block 22, and then signing and dating Block 23 of the form. Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 30 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment." Your response is due within 30 calendar days after receipt of the CPAR.

(f) The following guidelines apply concerning your use of the past performance evaluation:

(1) Protect the evaluation as "source selection information." After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.

(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 30- day review period.

(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.

ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS – INVOICE PROCESSING PLATFORM (IPP)

(APR 2013)

Payment requests must be submitted electronically through the U.S. Department of the Treasury’s Invoice Processing Platform System (IPP).

“Payment request” means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions – Commercial Products and Commercial Services included in commercial products and commercial services contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

1. Invoice billed according to contract line items and rates.

2. If final payment is billed, the last invoice shall state “FINAL”.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contract (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 – 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

SECTION H – SPECIAL CONTRACT REQUIREMENTS

H.1.0 ACCESS

In the event of a site/facility closure, the Contractor shall not perform or make deliveries to the site/facility until it is reopened by the Government, unless otherwise instructed by the Contracting Officer or their designated representative.

H.2.0 WORK HOURS

Unless otherwise specified in Section C, Specifications, work hours under this contract shall be limited to the time between one-half hour before sunrise to one-half hour after sunset each day. No work will be done on Saturday, Sunday, or Federal holidays unless authorized by the COR.

H.3.0 ENVIRONMENTAL INTERRUPTION OF WORK

H.3.1 Environmental - The Contracting Officer, by issuance of a suspend work order, may direct the Contractor to shut down any work that may be subject to damage due to weather conditions, fire danger, or because it is impracticable to work during the winter season. The Contractor will be given a resume work order which will document the date the work suspension ends. An allowance has been included in the contract time for all environmental delays. The count of contract time will therefore continue during all periods of suspension due to normal weather conditions, including fire danger. The Contractor will not be entitled to additional contract time for any suspensions except to the extent that they are due to unusually severe weather conditions. The Contractor will not be entitled to additional monetary compensation for such suspensions regardless of duration.

H.3.2 Endangered Species - The Government may direct the Contractor to discontinue all operations in the event that listed or proposed threatened or endangered plants or animals protected under the Endangered Species Act of 1973, as amended, or Federal candidate (Category 1 and 2), sensitive or state listed species, identified under BLM Manual 6840, are discovered to be present in or adjacent to the project area.

H.4.0 PRESERVATION OF HISTORICAL AND ARCHEOLOGICAL DATA

H.4.1 Public Law 93-291, May 24, 1974, provides for the preservation of scientific, prehistorical, and archeological data (including relics and specimens) which might otherwise be lost due to alteration of the terrain as a result of any Federal construction project.

H.4.2 The Contractor agrees that should any contractor employee, in the performance of this contract, discover evidence of possible scientific, prehistorical, historical, or archeological data the contractor will notify the Contracting Officer immediately in writing giving the location and nature of the findings.

H.4.3 Where appropriate by reason of discovery, the Contracting Officer may order delays in the time of performance and/or changes in the work. If such delays and/or changes are ordered, the time of performance and contract price shall be adjusted in accordance with the applicable clauses in the Contract Clauses Section of this contract.

H.4.4 The Contractor agrees to insert this requirement in all subcontracts which involve the performance of work on the terrain of the site.

H.5.0 ENVIRONMENTAL IMPACT

All waste materials generated by any work under the contract performed on a Government installation shall at all times be handled, transported, stored, and disposed of by the contractor and by his subcontractors in accordance with all applicable Federal, state, and local laws, ordinances, regulations, court orders, and other types of rulings having the effect of the law, including, but not limited to Executive Order 12088, 13 October 1978, Federal Compliance with Pollution Control Standards; the Federal Water Pollution Control

Act, as amended (33 U.S.C. 1251 ET SEQ); the Clean Air Act as amended (42 U.S.C. Sec 7401 ET SEQ);

the Endangered Species Act, as amended (16 U.S.C. Sec 1531, ET SEQ); the Toxic Substances Control Act, as amended (15 U.S.C. Sec 2601, ET SEQ); the National Historic Preservation Act, as amended (16 U.S.C. Sec 470, ET SEQ); the Solid Waste Disposal Act, as amended (42 U.S.C. 6901 ET SEQ); and the Archaeological and Historic Preservation Act, as amended (16 U.S.C. Sec 469, ET SEQ). Should the United States Government be held liable for any neglect or improper actions by the contractor or any subcontractor regarding removal or disposal of any hazardous waste, the contractor shall reimburse the Government for all such liability.

H.6.0 HAZARDOUS MATERIALS

Any material suspected of being hazardous that is encountered during performance of a project shall immediately be brought to the attention of the Contracting Officer, at which time a determination will be made as to whether hazardous material testing shall be performed. If the Contracting Officer directs the contractor to perform tests, and/or the material is found to be of a hazardous nature requiring additional protective measures, a contract modification may be required, subject to equitable adjustment under the terms of the contract. The contractor is advised that friable and/or non-friable asbestos-containing material may be encountered in project areas. Friable asbestos-containing material is any material that contains more than one percent asbestos by weight, and that hand pressure can crumble, pulverize or reduce to powder when dry. Non-friable asbestos containing materials are materials in which asbestos fibers are bound by a matrix material, saturation, impregnation or coating.

Non-friable asbestos-containing materials do not normally release airborne asbestos fiber during routine handling and end-use. However, excessive fiber concentrations may be produced during uncontrolled abrading, sanding, drilling, cutting, machining, removal, demolition, or other similar activities. 29 CFR

1910.1001 shall be referenced in the event asbestos-containing materials are encountered. Friable asbestos-containing materials are not authorized for use in new construction or maintenance projects.

H.7.0 GREEN PROCUREMENT REQUIREMENTS

In the performance of this service or construction contract, the Contractor shall make maximum use of products identified on the mandatory environmental purchasing list at the following links, if applicable:

Final payment or other alternative deemed feasible may be withheld until the Contractor has complied with this requirement.

H.8.2 Site and Access Roads – Site and public or private access roads negligently damaged by the Contractor shall be restored to the same condition they were in at the commencement of work, at the expense of the Contractor.

H.9.0 UNAUTHORIZED PERSONNEL

The contractor shall inform all personnel working under his jurisdiction (including subcontractor and visiting supplier personnel) that access to restricted areas outside of the immediate work area; excluding direct haul and access routes, contracting and Civil Engineering offices and points of supply and storage; is prohibited. Circulation of said personnel will be limited to official business only. Persons in violation of the above will be apprehended and appropriately disciplined.

H.10.0 FIRE DANGER SEASON

If the COR allows the Contractor to continue work during periods of declared fire danger or season, the Contractor shall comply with all applicable state laws relating to fire prevention and with all special conditions of work as directed by the COR and outlined in the attachment at the end of this section.

FIRE REQUIREMENTS PROCEDURES OUTLINE

This outline covers the fire protection requirements of a contractor or private party who performs service or construction contracts on BLM land. In western Oregon, the BLM allows Oregon Forest Law (ORS) and Oregon Administrative Rules (OAR) to apply to these operations on BLM lands rather than develop similar rules applicable only to BLM lands.

1. CLOSED FIRE SEASON

The closed fire season means that fire season has been declared. ORS 477.505 gives the State Forester the authority to establish the fire season. The authority has been delegated to the District Foresters around the state who issue public notices through the newspapers and radio when fire season will be closed for their individual districts.

Closed fire season depends upon the drying of forest fuels, rainfall, and time of year. During the closed fire season, the following requirements must be met:

• Fire tools must be on site;

• Fire extinguisher must be in all vehicles;

• Chainsaws must have a .023-inch mesh screen installed in the exhaust;

• Only unmodified saws are to be used in the forest;

• Approved spark arresters must be on all internal combustion engines;

• Watchman service must be provided for 3 hrs after shutdown of power equipment for the day;
